About this file
This document is an amendment to a solicitation for hearing conservation technician personal services in Landstuhl and Bavaria, Germany. The amendment responds to vendor inquiries by clarifying that workers' compensation and tax relief will be provided in accordance with DFARS clauses 252.229-7003 and 252.229-7012. It also specifies that hearing tests will be performed on-site at clinics in Vicenza, Baumholder, Kleber, Wiesbaden, Hohenfels and Grafenwoehr, with one technician located at each site. Overtime may be required but will require a contract modification, and training will encompass the hearing conservation section procedures. The Department of the Army Medical Command is the issuing agency.

Q&A'S II
QUESTIONS RESPONSES
1. Reference Solicitation pg 11 Clauses Incorporated by Reference and pg 12 Clauses Incorporated by Text. It does not appear the FAR Clause 52.228-3 or -4 Workers’ Compensation (Defense Base Act – DBA) is included.
Question: Is the requirement for DBA waived?
If not, will this be a separately reimbursed item or shall it be included in the Fully Burdened Labor Rate (FBLR)?
A-1: FAR Subparts 28.305 and 28.309 do not apply to this requirement.
“Public-work contract” means any contract for a fixed improvement or for any other project, fixed or not, for the public use of the United States or its allies, involving construction, alteration, removal, or repair, including projects or operations under service contracts and projects in connection with the national defense or with war activities, dredging, harbor improvements, dams, roadways, and housing, as well as preparatory and ancillary work in connection therewith at the site or on the project
2. Reference Solicitation pg 11 and pg 12; FAR 52.229-6 Taxes—Foreign Fixed Price Contracts, DFARS Clause 252.229-7001 Tax Relief (Germany) and DFARS Clause 252.222- 702 Compliance with Local Labor Laws (Overseas).
Question – As these are not designated NATO SOFA/Logistical Support (under Article 72 – Troop Care) eligible positions, please confirm that employees will be required to pay local applicable German and Italian income and social taxes. Can the Government also please confirm that employees will be required to have German and Italian Work/residence permits (Aufenthaltserlaubnis).
Question - Will the vendor/contractor be granted Tax Relief (Imposta Valore Aggiunto (IVA) for Italy as well (DFARS Clause 252.229- 7012 Tax Exemptions (Italy) is not included in the referenced clauses)?
A-2(i): As per Amendment 0001, the award resulting from this RFQ, will be a non-personal services contract.
It will be responsibility of the Prime Contractor to ensure that candidates/employees are in compliance with local labor laws.
A-2(ii): DFARS Clause 252.229-7003, Army Code 80028250241, will be incorporated in the contract award.
3. Reference pg 53 PWS Section 3.2 – Facilities and equipment. The Government will provide the necessary workstation for use by contractor personnel.
Question: Will workstations also be provided for work from a remote location in case of base closure or restricted access to the installation due to HPCON status/COVID-19?
A-3: No. Hearing monitoring testing cannot be performed remotely, outside the clinic.
4. Reference pg 43 PWS Section 1.13.2 Scheduling Process states: The clinics may schedule additional clinic hours in order to reduce the backlog and may require the hearing technicians to work overtime.
Question – Is there a limit to the amount of actual work hours provided in a given time frame (ie week or bi-weekly)? How will over time hours be managed (ie through comp time or are all OT hours billable)?
A-4: Overtime is atypical.
A contract modification will be issued if overtime will become a requirement.
5. Reference pg 13 PWS Section 1.20. 2.1 MTF Training Requirements refers to the ‘blood donor center’.
Question – Please confirm the reference should be ‘audiology clinic or hearing conservation section’.
A-5: Confirmed. “…MTF local policy and procedures encompassing hearing conservation section.” Erroneous information will be removed in the contract award.
6. Reference pg 41 PWS Section 1.7.12 – Security/CACs
CACs may not be issued to Contractor employees unless a data record authorizing CAC issuance is resident in the Defense Enrollment Eligibility Reporting System (DEERS). The Trusted Associate Sponsor System (TASS) was developed as a secure and authorized means of entering contractor data into DEERS in addition to automating the CAC application and approval process. In order to enter contractor data into TASS, the contractor's data must be resident in an authorized source database. The Joint Personnel Adjudication System (JPAS) is that authoritative source. The Contractor's Facility Security office (FSO) shall ensure its employee(s) has a record in JPAS prior to its employee(s) requesting a CAC be issued.
Personnel eligible for a CAC who are not in JPAS (i.e. certain Contractor employees, Foreign Nationals, and DoD affiliates) will be required to register at a site where an equivalent background vetting will be accomplished In Accordance With (IAW) Federal Information Processing Standard
(FIPS) 201
Question – As we do not have an FSO or access to JPAS, at which site shall we ‘register’ our Contractor employees iaw FIPS 201 per the highlighted section in order to obtain their
CAC?
A-6: CAC may be issued to Local National employees/contractors that are not recorded in
DEERS.
7. Technical Exhibit 3 lists two locations for Performance: Bavaria MEDDAC (Hohenfels & Grafenwoehr) and Landstuhl Regional Medical Center (Kleber, Baumholder, Wiesbaden & Vicenza).
Question: Will the work performed for Landstuhl be performed at each location clinic?
Does the hearing technician need to be located in Vicenza and Wiesbaden or at LRMC?
A-7: Hearing technician will perform work at each hearing test site; i.e. Vicenza, Baumholder, Kleber, Wiesbaden, Hoenfels, or Grafenwoehr. One technician shall be on site at each location.
