W90WL521Q0008 Pre-Award Q&A 1283 HVAC

1. Electrical Power type:

Government Response: 3 Phase 208V

2. The solicitation shows the wage determination as the “Heavy Civil” wages. We believe the “Building” wage determination may be more appropriate, as it includes the HVAC/sheet metal labor categories Government Response: A solicitation modification to replace “Heavy” Davis Bacon Wages with “Building” will be posted prior to Solicitation close.

3. SOW section 2.2.1 – Demolition, paragraph 7 states that the contractor is responsible for demolishing the existing bollards, and repairing the existing concrete/asphalt. In terms of demo/repair, would the government allow us to cut the bollards flush, and then patch with grout? Or is the intent of the government to completely remove the bollards below the surface and complete fill/patch the remaining holes?

Government Response: The Intent is to remove the entire bollards and repair the concrete, it may be necessary to remove the concrete pad to remove the bollards. This would require area to be repaired with asphalt or concrete.

4. SOW section 2.2.2 – Installation, paragraph 5 states that the contractor shall construct concrete pad and bollards (as needed) for the new HVAC equipment. Should we assume the same specification (with the exception of the pad dimensions) for the pad/bollards that are mentioned in paragraph 7 for the propane tank pad/bollards?

Government Response: The same specification is required for the bollards, the equipment pad shall be installed per the HVAC unit specifications.

5. SOW section 2.2.2 – Installation, paragraph 7 states that the contractor shall construct a new pad for the propane tank relocation, and that the pad shall be located “north of the asphalt.” This will place the propane tank fairly close to the overhead powerline. Can the government confirm we have enough clearance from the powerline to store the propane tank (generally 15’ from the fill port to any pole mounted switching equipment/meter, and at least 8’ from the closest point of the overhead lines to the tank).

Government Response: There is no power line in that location, the pole is for lightening protection. The tank pad can be constructed on the edge of the asphalt as not to interfere with the lightening protection box near the base of the pole.

6. When was the insulation on the piping installed and has it been tested for asbestos?

Government Response: The pipe insulation has been tested for asbestos and the results are negative, the report will be provided upon contract award.

7. Is the existing heating system glycol?

Government Response: The existing boiler piping is filled with non-toxic polypropylene glycol anti-freeze and water.

8. Looks like the "work area" is classified Class-1 Division-1. Is there any new electrical requirements for us in that area?

Government Response: No there are no new electrical requirements in the building

9. Notes say to reuse the existing power feed in the mechanical room feeding the boiler, however, there are no notes on the existing wire, conduit or breaker size?

Government Response: See picture below for the boiler disconnect.

10. Does the relocated propane tank require any electrical?

Government Response: No electrical required on the propane tank

11. Will the customer provide contact information for the propane contractor on contract with TEAD?

Government Response: No, the contractor will coordinate with the COR when propane work is required.

12. Form 1442; Section 12A:

It states that Payment and Performance Bonds are not required. Is this correct? However, on in section 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JULY 2000). To be clear if no Payment and Performance Bond is submitted then the contractor must provide an irrevocable line of credit, tripartite escrow agreement, and certificate of deposit for 100% of the contract price for the full period of performance plus one year. Is this correct?

Government Response: The magnitude of this project is estimated to be between $100,000 and $250,000.

FAR 28.102-1 General.

(a) 40 U.S.C.chapter 31, subchapter III, Bonds (formerly known as the Miller Act), requires performance and payment bonds for any construction contract exceeding $150,000, except that this requirement may be waived-

(1) By the contracting officer for as much of the work as is to be performed in a foreign country upon finding that it is impracticable for the contractor to furnish such bond; or

(2) As otherwise authorized by the Bonds statute or other law.

(b) (1) Pursuant to 40 U.S.C. 3132, for construction contracts greater than $35,000, but not greater than $150,000, the contracting officer shall select two or more of the following payment protections, giving particular consideration to inclusion of an irrevocable letter of credit as one of the selected alternatives:

(i) A payment bond.

(ii) An irrevocable letter of credit (ILC).

(iii) A tripartite escrow agreement. The prime contractor establishes an escrow account in a federally insured financial institution and enters into a tripartite escrow agreement with the financial institution, as escrow agent, and all of the suppliers of labor and material. The escrow agreement shall establish the terms of payment under the contract and of resolution of disputes among the parties. The Government makes payments to the contractor’s escrow account, and the escrow agent distributes the payments in accordance with the agreement, or triggers the disputes resolution procedures if required.

(iv) Certificates of deposit. The contractor deposits certificates of deposit from a federally insured financial institution with the contracting officer, in an acceptable form, executable by the contracting officer.

(v) A deposit of the types of security listed in 28.204-1 and 28.204-2.

(2) The contractor shall submit to the Government one of the payment protections selected by the contracting officer.

(c) The contractor shall furnish all bonds or alternative payment protection, including any necessary reinsurance agreements, before receiving a notice to proceed with the work or being allowed to start work.

13. Form 1442; Section 13A:

On Form 1442 Section 13A it states that the sealed offer and 1 copy should be hand delivered to the Tooele Army Depot Contracting Office. Is this the method that you would like these proposals turned or would an electronic submission be acceptable? If hand delivered, will there be a sealed bid opening at the submission time when all bidders proposals will be announced?

Additionally, there is no mention of criteria for evaluation for award or directions on what should be included in a proposal to the government. Is this a low bid RFP or will there be any technical evaluations?

Government Response: One electronic form and one hardcopy form are required. Mail is the preferred method of hardcopy delivery. Both delivery methods should include the Bid Guarantee. This is not a sealed-bid solicitation. The method of evaluation is Best-Value. Please refer to the Solicitation Description; “The Government seeks to award a Firm-Fixed Price Contract utilizing Best-Value method of evaluation of bids.”

14. SOW - HVAC at Tooele Army Depot, 1283 (restroom exhaust & proposed heating/cooling):

The proposed heating and cooling will require approximately 150 CFM per restroom. Each restroom is currently served by a ceiling-mounted exhaust fan. At the site survey, it appeared the existing exhaust fans’ capacity is between 50 to 70 CFM. Considering the new supply air requirements and the existing exhaust, the restrooms will operate in a positive pressure. Would you like us to provide an option for (2) new, ceiling-mount exhaust fans with greater capacity, allowing the restrooms to operate in a negative pressure?

Government Response: No, the restroom exhaust fans will not be replaced under this project.

15. Contract Administration:

What are the required insurance limits for this project?

What utilities are available for contractor usage i.e. water, power, restroom facilities?

Government Response: Please refer to Local Specifications and FAR 52.228-0005 for Insurance requirements in the solicitation.

The facility has water, power and restrooms. The building will be unoccupied during the project; contractors are authorized use of water, power, and restrooms.

16. Just a reminder when designing the HVAC system, per the SOW section 2.2 paragraph 5, operations inside the building require the humidity to be around 40% for maintenance operations. There is a standalone humidifier mounted inside the building that the operators control to get the building to the 40%. The ideal temperature the operators try and keep the building is 68° F ± 5° F. The building 40% humidity requirement is only during operations for 10 hrs. per day from approx. 6:30 am to 4:30 pm.
