Questions and Answers Solicitation
W90VN9-16-T-0009
1. What do you mean by price breakdown? Will this mean giving the price a bolt that holds an item together?
Government Response: No, it does not mean an offer has to include the price of each item that makes up one item. A price breakdown means there should be a price for each CLIN/BID Item. The Government should be able to clearly discern how an offeror arrived at its total price.
2. On page 4 it states "the parties hereby agree that all LCS work must be accomplished in the ROK its territorial waters and that all equipment and supplies that are to be acquired with ROK Government funds shall be manufactured in the ROK, and all LCS service work shall be carried out by Korean contractor(s), the Korea Railroad Corporation, or the ROK military." However, Lotte E&M is a Korean company, but the items of Lotte E&M are manufactured outside of Korea. Most of the industrial products are made in China or outside of Korea, ordered by Korean companies. Do you really think it is realistic to the offerors?
Government Response: The solicitation terms and conditions that all equipment and supplies be manufactured in the Republic of Korea (ROK) is required in accordance with the International Agreement between the United States and ROK, titled “Amendment to the Implementing Agreement between the United States Forces Korea and the Republic of Korea Ministry of National Defense Concerning Logistics Cost Sharing,” signed by the parties on 14 October 2015. Therefore, any products not manufactured in the ROK are not eligible for award of Logistics Cost Sharing program funds.
3. What is the exact closing date for this tender?
Government Response: 10 March 2016
4. Could we get detailed specifications for each item?
Government Response: Per the solicitation, the items should be equal to or greater than the CLIN items.
The salient characteristics are included in this solicitation.
5. Is this solicitation open to U.S. Owned companies?
Government Response: No. In accordance with the International Agreement between the United States and ROK, titled “Amendment to the Implementing Agreement between the United States Forces Korea and the Republic of Korea Ministry of National Defense Concerning Logistics Cost Sharing,” signed by the parties on 14 October 2015. The agreement states "... all LCS work must be accomplished in the ROK or its territorial waters and that all equipment and supplies that are to be acquired with ROK Government funds shall be manufactured in the ROK, and all LCS service work shall be carried out by Korean contractor(s), the Korea Railroad Corporation, or the ROK military. The term ‘Korean contractor(s)’ is defined as an entity, that, including its parent, is a domestic corporation under the Korean Tax Act and whose domestic status is recorded in the Certified Copy of Register or its successor document.
6. If an offeror does not have relevant experience for this solicitation, could we use a subcontractor who has relevant experience of kitchen equipment?
Government Response: Per the solicitation (page 36 section 4(b)(iii) "If the offeror(s) does not have a record of relevant experience the offeror will not receive a favorable or unfavorable evaluation based on experience." No, an offeror cannot use a subcontractor's relevant experience.
