52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

FACTOR I TECHNICAL:

Each factor and subfactor will be rated either acceptable or unacceptable. A rating of unacceptable for any factor or subfactor will result in an overall unacceptable rating and will not be eligible for award.

Technical Ratings Rating Description

Acceptable Proposal meets the minimum requirements of the solicitation.

Un-acceptable Proposal does not meet the minimum requirements of the solicitation.

Sub-factor 1 Korean Business License: The contractor must posse a Business License: Services / Facilities Management Operation (Type)

Sub-factor 2 Personnel Qualification Requirements (PWS, Para 2.2 & 2.3): The offeror shall be evaluated on submitted resume of Contract/Pool Manager, Lead Lifeguard, and Lifeguards as follows:

(a) Contract/Pool Manager: The offeror shall be evaluated on submitted resume of Contractor/Pool Manager. The Contract/Pool Manager shall have minimum three (3) years of experience in management in pool facilities, lifeguard qualifications training, pool maintenance, and water quality standards The offeror shall be evaluated on submitted Contract/Pool Manager’s current and valid American Red Cross Lifeguard Certification with American Red Cross CPR/AED and First Aid Certification, and Water Safety Instructor Certification.

(b) One (1) Lead Lifeguard: The offeror shall be evaluated on submitted resume of

Lead Lifeguard. The Lead Lifeguard shall have minimum two (2) years of experience as lifeguard within the last five (5) years. The offeror shall be evaluated on submitted Lead Lifeguard’s current and valid American Red Cross Lifeguard Certification with American Red Cross CPR/AED/First Aid Certification and Water

Safety Instructor Certification.

(c) Three (3) Lifeguards: The offeror shall be evaluated on submitted resumes which clearly demonstrates a minimum of three months (3) of experience as a lifeguard within the last five (5) years. In addition, the offeror shall be evaluated on their submittal of a current and valid American Red Cross Lifeguard Certification with American Red Cross CPR/AED/First Aid Certification and Water Safety Instructor Certification.

FACTOR II. PAST PERFORMANCE:

Past performance shall be evaluated on an acceptable/unacceptable basis. The Government may ascertain past performance information on the Offeror from sources other than the references provided the past performance will be evaluated for all offeror’s proposals by the Contract Specialist/Contracting Officer in the following manner:

(1) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.

(2) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

(3) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 13.106-2). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”

Past Performance Evaluation Ratings Rating Description

Acceptable

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note above)

Un-acceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

FACTOR III. PRICE:

Proposed price will be reviewed to determine if the offeror’s price proposal is complete and reasonable. The price proposals will be evaluated IAW FAR 13.106-3(a)(1). The following applies to that evaluation.

(1) Completeness. The offeror shall complete the pricing information for all CLINs/Sub-CLINs identified for base period plus one (1) options (total two (2) years). Any underlying assumptions including proposed escalation rates between the 1st and subsequent periods shall be clearly explained.

(2) Price Reasonableness. Price should also reflect fair market value and be reasonable when compared to the independent Government estimate, current market prices for same or similar services and/or when compared among other technically acceptable offerors.

(3) Price is not scored. The Government will review the price proposal to determine the extent to which it is reasonable and consistent with the technical proposal.

The lowest price for award purposes will be the combined total of the effective period of five (5) years from the date of award. Price must include all CLINs/Sub-CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors are instructed that submitted proposals should contain their best pricing.

(4) FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the

Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one- half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, and one-half of the 1st option.

Offerors are required only to price the base and 1st options. Offerors shall not submit a price for the potential one-half year extension of services period.

End of Addendum to FAR 52.212-2 Evaluation – Commercial Items (Oct 2014)

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
