Justification and Approval for Other Than Full and

Open Competition Justification

1. Contracting Activity: NGB-OPARC-S, 43200 Maple Avenue, Bldg 105 Selfridge ANG Base, MI

2. Description of Action: Approval is being requested for a proposed Task Order on the National A-E IDIQ, Exception to Fair Opportunity, FAR16.505(b)(2) Exceptions to Fair Opportunity. The proposed task order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to orders already issued under a Tetra Tech contract. The proposed award is for NGB ANG/A7AR’s Space Optimization and Facility Condition Assessment Spiral 7 project. The contractor is Tetra Tech-Mead & Hunt-JV (TTMH) under Contract W90FYQ-10-D-0004. Type of task order will be Firm Fixed Price; type of funds to be used will be O&M funds.

3. Description of Supplies/Services: The Proposed task order is for A-E services for sustainment of the HQ ANG Space Optimization data within the Air Force (AF) Space Optimization database in accordance with AF Asset Management Transformation, Space and Occupancy Management Program and Space Optimization Implementation.

Services will also include facility condition assessments and its respective data sustainment to support the Asset Management transformation. Place of performance shall be at various ANG installations in the United States. The scope of work is to provide data collection and required support tools for the bases to maintain and support the previous collected space optimization and facility condition assessment data, the “Original S-File and FCA data set”. The goal for this portion of the effort is to provide data collection updates and support to NGB until the infrastructure and workload transition within NGB can support internal data maintenance and sustainment of such data. For new/additional square feet, the Contractor shall visit and collect space optimization data for building at each installation. Facility Condition Assessments (FCA) will be performed to establish the requirements and project programming documentation necessary to restore a contractor asset to a condition substantially equivalent to the originally intended and designed capacity, efficiency or capability.

4. Authority Cited: 10 U.S.C. 2304(c)(1). FAR 6.302-1; Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: AFCEC originally competed this requirement for NGB.

However, in Apr 2014 they declined to execute new task orders for NGB due to excessive workload. Therefore, OPARC-S Contracting Office was assigned this procurement. In the continuity of the subject AE services, it is in the best interest of the Government to acquire the services through TTMH as they have all of the technical capacity, current history, established process and experienced staff to execute the scope of work. TTMH previously collected 40% of FCA, and the proposed task order is to collect another 20 percent. Rather than competing this same requirement under the Brooks Act, FAR 36.6, Architect-Engineer Services, it is more advantageous to maintain existing processes, hardware and software systems in order to minimize start up time and production. TTMH is the sole developer of the technology being used as a tool for this program called the S-File Widget. TTMH also worked closely with the GEObase team. It is necessary that TTMH continue with this project in order to have a product consistent with NGB/A7 goals for asset management. There would be a substantial duplication of cost to the Government that is not expected to be recovered through competition if this requirement were to be competed.

6. Efforts to Obtain Competition: N/A

7. Actions to Increase Competition: N/A

8. Market Research: No other AE IDIQ firm has the technical rights to the software in the execution of this requirement.

9. Interested Sources: N/A

10. Other Facts: Discuss any other facts supporting the use of other than full and open competition, such as the following:

a. Procurement history. Reasonable efforts to retrieve the following items from computer records, contract files, competition advocate office files or other sources are expected:

(1) Contract numbers of the last several awards issued by AFCEC.

b. Acquisition data availability. See item No. 5.

c. Unusual and compelling urgency. N/A

d. Subcontracting competition. TTMH-JV is meeting their subcontracting goals under their original contract.
