**The 119th Wing reserves the right to order 15% less or 15% additional quantities of concrete in addition to this estimated requirement of 5,800 cubic yards of concrete. Price for reduced or additional quantities shall be the same as agreed upon unit price at time of contract award. See Clause 52.211-18.
Delivery Timeframe: July 7 – August 29. An estimated number of 16-20 concrete pouring days are anticipated between these dates; subject to change.
Delivery Requirements: All concrete truck deliveries must be done by licensed individuals and will have to be inspected fully by NDANG personnel prior to entry. All trucks will then be escorted by NDANG or project personnel. Anticipate delays to allow for proper security inspections at gate.
**AN ON-SITE REPRESENTATIVE MUST BE PRESENT on days that concrete pouring is taking place over the entire period of performance under this contract-
NO EXCEPTIONS.
**To gain a complete understanding of this requirement, a pre-bid conference will be held on Friday, May 11th at the 119th Wing, located at 1400 32nd Ave. North in
Fargo, North Dakota. Time and location of this pre-bid conference will be 10:00 a.m. Central Standard Time (CST), at the CE Conference Room at Building 100.
This pre-bid conference is not mandatory, but highly encouraged.
General notes and requirements on concrete placement are as follows:
• Placement Sequence: Concrete will be placed via roller screed in 18.75’ lanes (8).
At peak periods, two trucks will be pouring at one time with minimum of 15 minutes between truck intervals. Concrete supplier must be able to meet will-call requirements of up to 400 CY of concrete per day; spaced at the 15 minute intervals as noted previously (assume pour of lane 375’ long x 18.75’ wide).
• Schedule: From July 7-Aug 29: M-Sat (potential for Sunday deliveries).
Depending on weather, could need concrete delivered as early as 4AM and as late as 10PM.
• Concrete trucks must be fitted with, or additional sections provided during placement, a minimum of 10 feet of chute in order to pour from the adjacent lane in front of the screed. At the liability of the concrete supplier, training may be provided to designated project workers to operate the chute controls.
• Concrete trucks are required to washout in designated washout pits or at supplier’s plant.
General Concrete Properties:
• Compressive Strength, when tested in accordance with ASTM C 39/C 39M at 28 days: 4500 psi.
• Fly Ash Content: Maximum 20 percent of cementitious materials by weight.
• Cement Content: Minimum 611 lb per cubic yard.
• Water-Cement Ratio: Maximum 42 percent by weight.
• Total Air Content (exposed slabs only): 6% (+/- 1 percent), determined in accordance with ASTM C173/C173M.
• Maximum Slump: 4 +/- 1 inches.
• Additives: must be able to add retarder at plant during times of peak heat if requested If fresh concrete from truck does not meet the concrete requirements for this project, the project Contracting Officer’s Representative (COR) and/or appointee can reject the truck and request a replacement. Any trucks rejected for not meeting the specification be turned away at no cost to the Government.
Water shall be made available on each truck and shall be added as directed by the
COR or his appointed project representative. High Range Water Reducers and/or plasticizers may be added at the discretion of the COR or his appointed representative in order to increase slump and workability without affecting the water concrete ratio. Any addition of plasticizer or additives shall be included in the cost of the initial concrete.
Air packs or additives to increase air entrainment must be available to be used. Any addition of additives shall be included in the cost of the initial concrete.

CLAUSES INCORPORATED BY FULL TEXT
52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL
CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)
(a) Definition. As used in this provision--
Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203-
19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.
(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing
Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form
312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information
Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
(End of provision)
52.204-9 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL (JAN 2011)
(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24, and Federal Information Processing Standards Publication (FIPS PUB) Number 201.
(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:
(1) When no longer needed for contract performance.
(2) Upon completion of the Contractor employee's employment.
(3) Upon contract completion or termination.
(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.
(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor`s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.
(End of Clause)
52.211-18 VARIATION IN ESTIMATED QUANTITY (APR 1984)
If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Price
2. Technical Acceptablity of commercial items submitted by Offeror(s)
3. Ability of Offeror(s) to meet delivery timeframes specified in this solicitation
In accordance with FAR 15.304, the relative importance of all other evaluation factors, when combined, are equal when compared to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR
