W81XWH20Q0077 Amendment 001 The combined synopsis/solicitation is the only controlling, binding document; the responses to the questions are for guidance and clarification purposes only. The Government will only be bound by the terms and conditions of the solicitation and not to the responses to the questions. No more questions will be accepted by the Government after the release of this Amendment.

QUESTIONS AND RESPONSES:

Question 1. I would like to know more about the formatting of the Volume 2 response on the solicitation document page 20. Is it a single document, the completed pricing sheet (attachment 3)? It lists states to also include “completed pricing for CLINs on the above”, is that a separate document that also needs to be included? And if so, what is the format?

Response 1 GOVERNMENT RESPONSE: Volume 2 may be a single document (completed Attachment 3). As long as the pricing in Attachment 3 matches the CLINs, then it is compliant with the requirement. You do not need to submit a separate document for the CLIN pricing.

Question 2. Within the solicitation document from page 2 to 11 there to document the items listed in the pricing sheet, it has a line to enter an amount but I’m assuming this is just documentation that we refer to, i.e. we do not have to enter anything within the solicitation document and include that in our response.

Response 2 GOVERNMENT RESPONSE: Correct, you do not have to enter anything into the solicitation document.

Question 3. The solicitation document has numerous areas were there are blank fields that appear to need to be filled out, do we somehow enter responses to those individual fields and somehow include the solicitation in our response? For instance, on page 13, (b) has: “The Offeror represents that it [___] has or [___] does not have an immediate owner.” (c) has Immediate owner CAGE code: ____ Immediate owner legal name: ___ There are numerous other spots as well.

Response 3 GOVERNMENT RESPONSE: This information should already be completed in your SAM record within your Reps and Certs section so you do not have to enter responses into those individual fields.

Question 4. On page 27 forward, there is a section 52.212-3, if we have an active and up to date SAM account, do we need to go into SAM and make any modifications to insure compliance with the representations and certifications listed in this section? Please provide more details on how we can make sure we send/complete the necessary reps and certs.

Response 4 GOVERNMENT RESPONSE: Your SAM record should always be up-to-date. Please be sure that your SAM record is in compliance with the representations and certifications listed. The Government has the ability to check these independently so you not have to send separately.

Question 5. In Attachment 1, Final PWS 20Q0077, SECTION 3 PERFORMANCE REQUIREMENTS, 3.1, this requirement requests “shall provide a custom landing page specific to USARIEM where a participant will be able to self-generate a unique participant ID”, should our cost for providing this custom landing page be included in the line item 0001 Account Set Up?

Response 5 GOVERNMENT RESPONSE: Yes, the cost for providing this custom landing page should be included in CLIN 0001 Account Set Up.

Question 6. On page 16, (b), is states “offers may be submitted on the SF 1449, letterhead, or as otherwise specified”, I am not familiar with SF 1449, it is not clear what fields on this form that we fill out vs. you. If we use SF 1449, do we need to combine it with the rest of our response for Volume 1 so it is in a single document?

Response 6 GOVERNMENT RESPONSE: The amended solicitation has removed the language referencing SF 1449 as it was included by accident.

Question 7. On page 16, (b) (8) – A completed copy of the representations and certifications – I don’t understand how to respond to this item. If we have our reps and certs in SAM is that all we need to do or is there a specific document that needs to also be included in Volume 1 of our response?

Response 7 GOVERNMENT RESPONSE: As long as your reps and certs in SAM are up-to-date, there is nothing further you need to complete.

Question 8. Just for clarification on the terms of any express warranty. "An express warranty is an agreement by a seller to provide repairs or a replacement for a faulty product, component or service within a specified time period. Under the federal Magnuson-Moss Warranty Act, a company must provide a written express warranty if a product is sold for more than $15." Our FFQ will be under $15/each so does this not apply?

Response 8 GOVERNMENT RESPONSE: The RFQ has FAR Clause 52.212-4 which is incorporated in by reference. This clause has a paragraph that covers “Warranty”.

Question 9. On page 19, It is the responsibility of the Offeror to confirm receipt with the Government point of contact. Do we do this by an email request to let us know you received our response?

Response 9 GOVERNMENT RESPONSE: If you do not hear back from the POC listed in the combined synopsis/solicitation within an hour of submitting your quote/offer, please follow up or call as the firewall sometimes does not allow large files to be submitted (files greater than 8MB). You should receive a confirmation email from the POC listed letting you know your quote/offer has been received.

Question 10. For providing our past performance reference information (page 22), I’d like to get more clarity on handling this response.

a. Do we need to provide a NAICS code of the organization, we mostly do not know this Response 10a GOVERNMENT RESPONSE: No, you do not provide the NAICS of the organization. You can provide a past performance reference for a contract that you supported for the government that had the same NAICS code.

b. For some of the references we are planning to provide, they license our product and this is done via an order form, we do not put together a contract although we do have an invoice, can we use the invoice number as the reference?

Response 10b GOVERNMENT RESPONSE: The Invoice No can be used in place of a Contract for the reference.

c. As with regard to period of performance, there is a start date by not an end date, they use our eFFQs as needed until they have used the purchased number of eFFQs up Response 10c GOVERNMENT RESPONSE: Correct – there is a maximum number of eFFQ’s per each year of the contract. See page 11 for the period of performance per CLIN (there is an end date to each). For the base period, once the total funded eFFQ’s are completed, then work stops until additional funding is provided for additional eFFQ’s.

d. For (b) PAST PERFORMANCE QUESTIONNAIRE attachment 4, just to confirm, we enter our information in the section provided and send copies to both you and to each of the 3 references that we identify? And they have to respond by June 22nd (given it is June 12th today). We don’t control our references and given the circumstances of COVID-19 shutdown we can’t ensure a quick turn around. What happens if they don’t get it to you in time?

Response 10d GOVERNMENT RESPONSE: If your past performance references do not submit the past performance questionnaire as requested, it will not be held against you during the evaluation.

COMBINED SYNOPSIS/SOLICITATION

1. Issue Date: 4 June 2020 Close Date: Monday, 22 June 2020 at 1000 hours EDT

2. Requiring Activity: United States Army Research Institute of Environmental Medicine (USARIEM)

3. Description of Requirement:

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The Government intends to purchase on a firm fixed-price basis and to solicit and negotiate the proposed purchase order under the authority of FAR Part 12 and FAR Part 13.5. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

The associated North American Industrial Classification System (NAICS) code for this procurement is 541690 with a small business size standard of $16,500,000.00. This acquisition is being procured as a 100% small business set aside procurement. Only offers submitted by small business concerns will be considered.

4. Request for Quotes (RFQ) NO: W81XWH20Q0077 This combined synopsis/solicitation is issued as a Request for Quote (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-06, 05/06/2020.

The objective of this RFQ is to issue a Purchase Order to provide electronic food frequency questionnaire analysis. USARIEM’s mission is to optimize Warfighter health and performance through medical research. The mission of Military Nutrition Division (MND) is to conduct research that provides the biomedical science basis for developing new rations, menus, policies, and programs that enable Warfighter health-readiness and optimal performance. Research conducted by the MND requires measuring a history of intake of nutrients by the warfighter in various environments in order to evaluate and understand nutritional intake as part of the research objective, and ultimately how to improve policies, education, rations, and food options provided to the warfighter. In order to capture a history of nutritional intake, a validated questionnaire is needed for accurate data collection and analysis. An electronic food frequency questionnaire (eFFQ) is required to be able to perform important eating behavior research by the MND. Paper food frequency questionnaires require in person delivery and are not feasible for large scale survey work that the MND has been asked to accomplish by Installation Management Command. An eFFQ will allow the MND to survey a large number of Soldiers from multiple posts using web links to accomplish research for IMCOM. To support these efforts, MND has the requirement for the following contracted services. Review the attached Performance Work Statement (Attachment 1) for further details regarding objectives and tasks.

SOLICITATION CLOSING DATE: All quotes/offers must be received by Monday, 22 June 2020 at 1000 hours EDT. Note: that you must be registered in the System for Award Management (SAM) system to be considered for an award. Registration is free and can be completed online. Above registrations can be completed through SAM @ www.sam.gov. The System for Award Management is a free web site that consolidates the capabilities you used to find in CCR/Fed Reg, ORCA, and EPLS.

Offers shall be prepared in accordance with FAR 52.212-1, Instructions to Offerors as outlined on pages 16-22 of this solicitation.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (JUL 2016)

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
