Normally Key Personnel is used to describe personnel that the Government defines as vital to the performance of the contract. For the purposes of this RFP, Key and Essential are definitions related to the vital nature of the positions with regards to fulfillment of the PWS requirements. Key Personnel are determined as "critical" whereas Essential Personnel are "necessary". RFP has been amended.Page 9

13Can the Government confirm the requirement to submit labor hours expended, by labor category, for each task in the Monthly Progress report as this would seem to be unnecessary administrative burden for a Firm Fixed Price contract?Section 2.2.1 Monthly Progress Report - "The MPR shall include the labor hours expended, by labor category, for each task."This requirement has been removed. See Section 2.1.1 as amended.Page 6
14Can the government clarify if the onsite PM is 100% billable per page 43, or if the PM is 50% PM and 50% HSPS III per the Labor Category Table on page 168?Page 43 – Item No 0001 notes that the onsite Program Manager support services is 1 FTE (DHPe). However, the Estimated Level of Effort on page 168 shows a 50/50 split of the Onsite Program Manager between PM task and HSPS III tasks. The Line Item's 0001, 1001, 2001, 3001, 4001, and 5001 are for both the Onsite PM and HSPS III (50/50 split) support services. 21On Pg. 167 the Government states “[o]fferors are not bound to propose these labor categories or quantities, rather offerors are expected to provide their best solution citing the labor mix and quantity required to accomplish the tasks.” However, PWS Section 1.0.1 Background clearly defines a contractor staffing structure for HRPO and IRBO, including specific labor categories and number of personnel. Can the Government confirm that they are willing to accept an alternate staffing approach (e.g. labor categories and number of personnel) for this contract?Pg. 167 – (11) ESTIMATED LEVEL OF EFFORT: The Government estimates that this order will require an approximate level of effort, as outlined below, to accomplish the tasks identified in the PWS. The labor categories utilized in the below table are reflective of labor categories utilized in the Government’s estimate and may not be reflective of your proposed labor categories (see Government’s request to cross map labor categories in (10)(c) above. Please note that the Government estimate is only put in place for Offerors to ascertain the approximate or estimated level of effort for this task. However, this is not to be construed as either mandatory or necessarily the best technical approach. It is only in place as a reference to allow Offerors to better understand the general scope of this effort from the Government’s perspective. The Government is seeking the best level of effort and labor mix your company has determined is right to accomplish the mission contained in this task statement. Offerors are not bound to propose these labor categories or quantities, rather offerors are expected to provide their best solution citing the labor mix and quantity required to accomplish the tasks. Offerors are strongly encouraged and expected to submit a level of effort consistent with all of the cost/price and non-cost/price aspects of their approach.Yes, per the RFP, "the Government estimate is only put in place for Offerors to ascertain the approximate or estimated level of effort for this task. 24We respectfully request that DFAR 252.219-7004 Small Business Subcontracting Plan (Test Program) be added. As a Large Business participating in the Test program, this plan, approved by DCMA, is to be used for all DoD contracts. Question: Our Comprehensive Subcontracting Test Program Plan is agreed to at the beginning of the Government Fiscal year with DCMA and cannot be edited. Is the Small Business plan subject to the 30 page non-cost/price page limitations? Question: If the Small Business Plan is subject to page limitations, will submitting the cover page of the plan signed by DCMA and our business officials suffice? Question: If we must submit the complete plan, can it be submitted as a separate attachment, due to document size?RFP - Section L, Additional Instructions to Offerors, 4.a.(1) Page Limits, page 163, 4.b.(6) Small Business Subcontracting Plan, page 166DFARS 252.219-7004 has been added (see RFP as amended). 27Solicitation states that contractors must initiate a T1 security investigation for employees. However, contractors cannot initiate the T1 investigation process in JPAS or the eQIP, they can only initiate T3 investigations or higher in JPAS.
Question: Will the government please clarify the expectations for this requirement?RFP PWS, 6.2.3 For Contractors Requiring Common Access Card (CAC), page 29The PWS statement, 'and initiated Electronic Questionnaires for Investigations Processing (eQIP) questionnaire' has been removed. See RFP as amended.Page 29
28PWS states, “The government may require changes in contractor labor mix to accommodate changes in federal, Department of Defense, and Army human subjects protection regulatory requirements.”
Question: Will offerors be permitted to submit revised pricing when changes to the labor mix are made?RFP PWS, Section 2.2.2, page 12 and Section 2.2.3, page 13The Government does not see this as a solicitation question, however, the Government would anticipate revised pricing would be requested.
29Section 2.1.1 (Monthly Progress Report) states “The MPR shall include the labor hours expended, by labor category, for each task.” In addition, Section 3.2 Contractor Payment Processing states “Direct labor backup information shall reflect the employee’s name, job title, and quantity of hours worked for each pay period at a minimum.” Additionally on page 23 and other places throughout, the RFP states that “labor hours expended by labor category for each task “must be provided. Finally, the CLIN structure listed on pages 43 – 118 indicates this is a FFP contract. These are contradictory statements.

Question: Is the contract true Firm Fixed Price (FFP), for which such detail is not required, or is the contract actually Firm Fixed Price/Level of Effort (FFP/LOE), where an offeror would then be expected to provide the number of hours worked when invoicing?

RFP PWS, Section 2.1.1, page 6;

Section 3.2, 20, Section 4.6, page 23, and CLIN Structure, pages 43-118

See PWS Sections 2.1.1, and 3.2, as well as Deliverable 2 in Section 4.6, the Performance Matrix in Section 6.4.2, and the QASP as amended.Pages 6, 20, 23, 35 and 181
30The contractor must initiate a security investigation for employees prior to contractor employee start at on-site facilities. Investigation includes FBI fingerprint check (as required) and initiated Electronic Questionnaires for Investigations Processing (eQIP) questionnaire. Contractor personnel must submit all required security information for the investigation prior to reporting for on-site performance.

Since contractors are not able to initiate T1 clearances in JPAS or initiate the eQIP, the above requirement will impact the start date for new hires.

Question: Will the government reconsider the 8% turnover rate since staff start dates are reliant on the Fort Detrick security office for clearances and CAC cards?RFP PWS, 6.2.3 Access and General Protection Policy and Procedures, page 29In considering the turnover rate, the Government will consider for delays in issuing CAC cards if the delay is a factor for an employee departure.Page 29
31Page 162 states: The estimated period of performance shows “12 months of performance” for Option Period 4; however, right after that statement, the solicitation states “Transition Out Period (OP5) - 31 days of performance from expiration of last exercised option period”.

Question: Can the government confirm that the period of performance for Option Period 4 is actually 11 months and that there is then an OP5, which is a transition out option of 31 days (or one month)?

RFP Section L, Additional Instructions to Offerors, 2. Period of Performance, page 162Confirmed and Page 162 has been amended.Page 162
32“The Supplemental Pricing Worksheet shall include all other direct and indirect costs including materials, equipment, travel, shipping and any other costs associated with the performance of the resulting task order. Contractor shall ensure mathematical computations are correct.”

Question: Does the government intend for offerors to show a step-by-step labor rate build, with application of indirect rates like fringe, overhead and G&A, for each FFP labor CLIN? (This type of labor rate build is not a common requirement for FFP contract types.)

RFP Section L, Additional Instructions to Offerors, 4.a.(10) Price Proposal Content, (c) Supplemental Pricing Worksheet, page 167See amended RFP (Supplemental Pricing Sheet Instructions)Page 167
33“Offerors price proposal shall include other than certified cost and pricing data, which may include, but is not limited to rate agreements, forward pricing rate agreements, or other evidence of DCAA or other Federal Agency approval of indirect rates or labor rates that can be used to substantiate the rates used in the proposal.”

Question: Does the government intend for offerors to show a step-by-step labor rate build, with application of indirect rates like fringe, overhead and G&A, for each FFP labor CLIN? (This type of labor rate build is not a common requirement for FFP contract types.)

RFP Section L, Additional Instructions to Offerors, 4.a.(10) Price Proposal Content, page 167See amended RFP (Price Proposal Content Instructions)Page 167
34“Prices that are unreasonable, not fully supported/substantiated, or both, may cause the overall technical evaluation to be adjusted in one or more of the non-price evaluation factors”
Question: For FFP contracts, cost breakdown is not provided. Can the government please confirm that the wording above implies that offerors are to provide staff salaries as support for the hourly labor rates?RFP Section M, Evaluation Criteria, c. Price, page 192Per the RFP, Price Proposal Content (Amended), Offerors’ price proposal shall include proposal price and a price breakdown by labor categories, hours, and rates. Per the RFP (Evaluation of Price), Price(s) that are unreasonable, not fully supported/substantiated, or both, may cause the overall technical evaluation to be adjusted in one or more of the non-price evaluation factors.Page 192
35Question: Please confirm whether or not FAR 52.222-41, Service Contract Labor Standards the Service Contract Act (SCA) applies to this solicitation.

Question: If SCA applies, please include the applicable Wage Determination schedule.

RFP, Clauses, page 135No, FAR Clause 52.222-41 does not apply to this requirement.
36Section 5.4.1 ODC’s-Travel states “The Government will be providing a “Plugged” Not to Exceed (NTE) amount of $5,000.00 during base and for each option period to cover anticipated travel costs for employees assigned to ORP.”; however, (page 167) in the additional instructions to offerors, it states “(a) OTHER DIRECT COSTS: The Government is providing a “Plugged” Not to Exceed (NTE) amount of $5,000.00 for the base period of performance for Travel/Other Direct Costs (ODCs).”

Question: Shall ODCs in the Not to Exceed (NTE) amount of $5,000.00 be applied to only the base or the base and all option years?

RFP - PWS and Additional Instructions to Offerors, Section 5.4.1, page 26 and Other Direct Costs, page 167See RFP Amendment page 167 to include base and all options for "Plugged" NTE ODCs.Page 167
37Section 2.4 Management of On-Site Personnel and Reporting: There seems to be a discrepancy as “During incoming transition, the contractor shall be afforded 120 days to complete adequate orientation of new employees to duties and ORP procedures;” however, page 34 states that the standard is “80% of staff successfully completed orientation within 90 days of start”.

Question: Is 120 days the measure or is 90 days the measure?

RFP PWS, Section 2.4, page 18 and page 34120 is the measure during incoming transition, whereas 90 days is the measure after that time.Pages 18 and 34
38Section 3.2 states “All ODCs exceeding $3,000 require that the Contractor conduct appropriate competition;” however, in Section L on page 161 Class Deviation 2018-O0018 is included in the solicitation, which raises the Micro-Purchase Threshold to $10,000.

Question: Which threshold will offerors be expected to comply with - $3,000.00 or $10,000.00?

RFP - PWS and Section L Page 20 and Page 161, Section 3.2, page 20 and Section L, page 161$3,000.00 per the PWS Section 3.2.Page 20
39Section 6.4.2 Task 12 states: Indicator -“Minimum number of staff in orientation (average of 3 months)”; Standard – “80% of staff successfully completed orientation within 90 days of start” and Acceptable Quality Level - “Less than 80% for 45 days is unacceptable performance”

Question: What is meant by Less than 80% for 45 days? (It is confusing when 90 days is mentioned as the standard.)

PWS Performance Requirements Summary Matrix, Section 6.4.2, page 34PWS has been amended to state, "Less than 80% of staff completed orientation within 90 days for more than one quarter is unacceptable performance"Page 34
40Under the supplemental Pricing Worksheet instructions it states: “The offeror shall provide a detailed breakdown of the proposed labor rate for all proposed subcontractor labor.”

Question: This is a FFP proposal, is this level of detail required for Subcontractors?

Question: Would the government accept subcontractors providing sealed packages directly to the government if this level of detail is required?

Section L Additional Instructions to Offerors, 4.a.(10) Price Proposal Content, (c) Supplemental Pricing Worksheet, page 167Q#1: See Supplement Pricing Sheet Instructions as amended. Q#2 Not Required - see amended RFP (Q#1)Page 167
41Section 6, Methods of QA Surveillance states: “Surveillance results may be used as the basis for actions (to include payment deductions) against the Contractor.”

Question: How would payment deductions be calculated?

PWS Methods of OA Surveillance, Section 6, page 186Per FAR 52.246-4, in the event of this occurrence, the Government would charge to the Contractor any cost incurred by the Government that is directly related to the performance of such servicePage 130
42Section 8, Documenting Performance states” Any CDRs may become a part of the supporting documentation for contract payment deductions, fixed fee deductions, incentive fee nonpayment, or other actions deemed necessary by the KO.”

Question: This solicitation does not appear to be an incentive fee contract. How would an incentive fee nonpayment be calculated?

Question: How would fixed fee deductions be calculated?
