6. Authority Cited: 41 U.S.C. 1901 OR 41 U.S.C. 1903
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 13.501(a)(1)(i): Only one source reasonably available (including brand name);
OR
(d) FAR 13.501(a)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item.
7. Reason for Authority Cited: The suggested source is Qiagen, Inc. Located at 19300 Germantown Road, Germantown, MD 20874 is the sole manufacture and distributor of the CLC Genomics Workbench software and maintenance. To maintain continuity and leverage AFMES existing investment with Qiagen CLC Genomics Workbench platform, the software and maintenance must be provide by Qiagen, Inc. Over $200 thousand dollars has been spent to date due to an increase in mission of historical past accounting missions. If the licenses were not purchased there would be an enormous amount of data on the servers which would take hours to process vs the minutes it currently takes with the aid of CLC Genomics workbench.
In addition, the Qiagen CLC Genomics Workbench is the only software of this type the Government has found with an approved Certificate of Networthiness (CoN).
8. Efforts to obtain Competition: Not applicable. No effort will be made to solicit offers from any other source as there is currently only one source capable of providing the required license and maintenance support that is consistent with what has previously been validated for use by AFMES-AFDIL. Qiagen Inc., is the only source available in the marketplace to satisfy this requirement. Qiagen Inc does not partner with third-party resellers for the CLC Genomic Workbench and Genomic Servers products included in the enterprise Genomics Factory solution used for molecular biology research and next generation sequencing analysis. In accordance with FAR subpart 5.2, a Notice of intent to Sole Source will be posed to Federal Business Opportunities (FEDBIZOPPS). The Notice of Intent will allow for the submission of Capability Statements from other manufactures that propose to have a product that can meet the Minimum Essential Characteristics (MECs) to accomplish this requirement. Responses received will be reviewed for the purpose of determining whether a competitive procurement is in the best interest of the Government.
a. Effective competition. As previously stated, market research has revealed Qiagen, Inc.
is the sole manufacturer and there are no third-party authorized resellers. Therefore, as a sole source acquisition, the Government only expects to receive one quote from the suggested source, Qiagen, Inc.
b. Subcontracting competition. Not applicable; as this is a supply-type requirement, the
Government does not anticipate subcontracting opportunities.
9. Actions to remove or overcome barriers Competition: The Government will continue to survey the marketplace to determine if there are other authorized resellers of the Qiagen CLC Genomic Workbench software and maintenance. If the Qiagen CLC Genomic Workbench software and maintenance become available under the Computer Enterprise Software and Solutions (CHESS) which is the Army’s mandatory source for commercial Information Technology (IT) products, an Request for Quote will be released. In addition, the Government will post another Request for Information (RFI) in the future to determine if there are new sources in the open marketplace capable of providing the CLC Genomic Workbench software and maintenance support.
10. Market Survey: Based on Market Research, Qiagen, Inc. Is the only source available in the market place to satisfy AFMES requirement for the CLC Genomics Workbench software and maintenance.
11. Interested Sources: As previously stated, a Notice of Intent to Sole Source will be posted to FedBizopps to afford interested sources an opportunity to respond with a Capability Statement. Responses received will be reviewed for the purpose of determining whether a competitive procurement is in the best interest of the Government. At this time, the Government has not received any notices from interested sources outside of the current suggested source, Qiagen, Inc.
