Justification and Approval For Other than Full and Open Competition
1. Contracting Activity: The Contracting Activity responsible for this action is the U.S. Army Medical Research Acquisition Activity (USAMRAA), Fort Detrick, MD on behalf of the US Army Public Health Center (APHC), Aberdeen Proving Ground, MD.
2. Description of Action: This approval is being requested for a new firm fixed- price service contract with Florida State and National Environmental Laboratory Accreditation Program (NELAP) Certification using FY18 O&M funds.
3. Description of Supplies/Services: The purpose of this contract is to provide the US Army Public Health Center (APHC) with Florida State Certification and NELAP accreditation to perform sample analysis within the State of Florida. Participation in the Florida State Certification Program and NELAP is necessary to meet the standards of the APHC laboratory quality system. The State of Florida requires that laboratories be certified under their Reciprocal Safe Drinking Water Program and NELAP to ensure that analyses are performed in accordance with the Safe Drinking Water Act. The APHC intends to perform the analysis of environmental samples from the State of Florida and will require this Certification. The estimated value of this 1-year Base plus 4 (Four) Option Year period contract is $14,920.00.
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1). The FAR citation is 6.302-1 and the FAR citation title is only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: The APHC requires the ability to perform the analysis of environmental samples from the State of Florida and will require this Certification. The State of Florida requires laboratories performing analysis for samples from the State of Florida hold both Florida state certification and NELAP accreditation.
6. Efforts to Obtain Competition: A Sources Sought notices was published in the Federal Business Opportunities (FBO) on 17 April 2018. Potential sources were given the opportunity to provide capability information by 30 April 2018. Three (3) responses were received from the industry; from American Association for Laboratory Accreditation (A2LA), ANAB/ANSI-ASQ National Accreditation Board, and KATMAI Government Services. COR evaluated the Capability Statements and were found unacceptable because the 3 Contractor's thought the work included the actual physical on site accreditation service. This requirement does not include accreditation services but instead only the act of reviewing the results of another vendors on-site assessment and award of accreditation certificate based on that audit. APHC requires the ability to perform the analysis of environmental samples from the State of Florida and will require this Certification from Florida directly. The State of Florida requires laboratories performing sample analysis from the State of Florida to obtain required accreditation. As a result, this requirement is being procured as a Sole Source to
State of Florida, which is the only one who can truly do the work.
a. Effective competition. No effective competition is anticipated for this acquisition.
b. Subcontracting competition. There is no potential for subcontracting Opportunities under this requirement.
7. Actions to Increase Competition: APHC will continue to monitor the open market for sources to determine any other accrediting institutions.
8. Market Research: Market research and commerciality determination was performed by the quality office at APHC. Confirmation from the State of Florida Department of Health was obtained that they require this Accreditation to perform the analysis of environmental samples from the State of Florida and do not recognize any other accrediting bodies for this purpose.
9. Interested Sources: In accordance with FAR 5.207 (c)(14), a notice was published in FBO on 31 May 2018 announcing the Government’s intent to procure via sole source the services to perform the analysis of environmental samples from the State of Florida and will require this Certification. The Contractor must be able to accredit drinking water matrices for various parameters and the State of Florida to accept the accreditation for that purpose. The Contractor must be able to certify published EPA methods that meet validation and strict quality control requirements.
As of 12 June 2018, No other vendors have written to express an interest in this requirement.
