Contractor Manpower Reporting
The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the US Army Public Health Center (Provisional) via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2015. Contractors may direct questions to the help desk at help desk at: http://www.ecmra.mil.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
**INCLUDES ADDENDUM. STARTING AT SECTION “A” BELOW**
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
A.1 BASIS FOR AWARD
A.1.1. The Offeror’s quote will be evaluated to ensure the Government receives a technically acceptable award at a fair and reasonable price. The selection for award will be based on the following equally important non- price factors:

Factor 2 – Price
A.1.2. The Government evaluators will not assume that the Offeror’s proposal possesses any capability or knowledge unless it is specified in the proposal.
A.1.3. The Government intends to evaluate and award contract without discussions. However, the Government reserves the right to conduct discussions.
A.1.4. If the above non-price factors receives an individual rating of “Unacceptable,” the Offeror’s proposal will be deemed “Unacceptable”. Only a proposal receiving an overall rating of “Acceptable” will be considered for award.
A.2. EVALUATION CRITERIA
Factor 1 – Technical Approach: The Offeror’s quote will be evaluated for acceptability based on demonstrating an understanding of the PWS and of the functional and technical tasks to be performed. The Offeror’s quoteshall state how the proposed Technical Approach will yield the required results as stated in the request for quotation’s required time frame. The Offeror should discuss the methodology and flexibility that will be used in performing the requirements.
Factor 2 – Price: Price will be evaluated separately from other non-price factors and will be evaluated for fairness and reasonableness. The total evaluated price will be evaluated for reasonableness in terms of:
a. Consistency with the requirement’s acceptable technical capabilities in the Offeror’s non-price proposal;
b. Priceevaluation is to determine whether vendor’s price quote is fair and reasonable, the Government will evaluate the completeness and reasonableness of the Offeror’s price proposal.
A.3. ACCEPTABILITY RATING STANDARDS:
An evaluation for technical acceptability will be made to ensure satisfactory responsiveness to the requirements as set forth in this solicitation. Each non- price factor will be rated “Acceptable” or “Unacceptable” using the following rating standards:
A.3.1. For Factor 1 – Technical Approach standards will be:
Acceptable: Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable: Proposal does not clearly meet the minimum requirements of the solicitation.
A.3.2. For Factor 2 – Price
Price will be evaluated separately from non-price factors and past performance and will be evaluated for fairness and reasonableness. The Government will evaluate Offeror's price quote in terms of:
a. Consistency with Offeror's non-price quote;
b. Completeness, fair and reasonableness.
The Procuring Contracting Officer may conduct a cost analysis to support the price determination using Contract Pricing Reference Guide (https://acc.dau.mil/cprg).

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

PERFORMANCE WORK STATEMENT
1. The purpose of this contract is to provide APHC (Prov) with a Department of Defense Environmental Laboratory Accreditation Program (DoD ELAP) Accredited Laboratory to perform the analytical services for the analysis of ground/surface water, soil/sediment, and air samples for the Dioxin/Furan compounds.
1.2 Procedures specified in this Performance Work Statement (PWS) shall be used in the analyses of ground/surface water, soil/sediment, and air samples for Dioxin/Furan compounds as identified. If the referenced standard procedures have been modified in any way (extraction, analysis, types and number of QC samples employed, QC acceptance criteria, etc), these modifications must be clearly explained in the laboratory SOPs and provided to APHC (Prov) prior to contract award for approval. Contractor shall employ safe handling techniques and quality assurance/quality control protocol as described in this performance work statement in Attachment 3 entitled "Quality Control Requirements".
2 GENERAL REQUIREMENTS
2.1 The contractor shall use state of the art instrumentation, technologies, and methodologies to analyze samples for the parameters.
2.2 Contractor shall meet 21 Calendar Day turnaround time for standard priority sample analyses. For samples designated High Priority, the contractor shall meet 10 Calendar Day turnaround time. An estimate of 10% of the total samples submitted for this contract will be High Priority. Holidays and Weekends are considered ‘calendar’ days.
Turnaround time is defined as the intervening time period between the date of sample receipt in the contractor laboratory to the date of receipt of a complete and technically acceptable data package (Final package (pdf file) + electronic data deliverable) in the APHC (Prov) laboratory. Data packages are considered “late” if they are over the 21 calendar day turnaround for standard and over the 10 calendar day turnaround for high priority.
2.3 Contractor shall adhere to requirements for sample containers, sample preservation and holding times as dictated by the analytical methods and/or other specific regulatory guidance. The contractor shall analyze samples within the method holding time specified, even if these times are less than the calendar days allowed by contract.
2.4 The contractor shall follow strict quality assurance and quality control protocol per the Department of Defense Quality Systems Manual (QSM), current version; applicable analytical methods found in this PWS. All method-specific quality assurance/quality control requirements (laboratory blanks, laboratory control samples, laboratory/method dups, method-required matrix spikes) shall be included in the contractor per field sample unit price (no separate additional charges for laboratory/method-required QA/QC will be incurred/paid). Field QC samples (field blanks, rinse blanks, matrix spike requirements above method requirements) shall be charged the field sample rate.
2.5 The contractor lab must follow chain of custody procedures for all samples from the APHC (Prov).
2.6 The contractor shall submit reports and electronic data. Each data package consists of a pdf package/file and an electronic data deliverable. If the contractor does not submit data packages on time and/or submits incomplete/technically deficient data packages, the contractor may be required to pay liquidated damages to the Government as follows:
3 SPECIFIC REQUIREMENTS
The contractor shall provide the required analytical expertise and instrumentation to achieve required detection/quantitation limits as specifically identified. Further, any EPA criteria approved during the life of this contract must also be implemented/achievable (EPA RSLs, etc.). If specific limits are not provided (air), any limits specified in the analytical methods for a particular matrix must be achievable.

3.4 Sample Pickup Protocol at APHC (Prov) lab - The contractor’s courier shall be responsible for pickup [from APHC (Prov)], packaging and delivery of samples. Samples shall be picked up by the contractor’s courier within 24 hours of notification by the COR or a designated representative. The courier is responsible for packaging and transporting the samples under conditions dictated in the EPA methodology. At the time of sample pickup by the contractor, the samples and required tests will be identified by the APHC (Prov) COR on a Pickup Order/ Delivery Order (External Chain of Custody) Form. This document shall be signed and dated by the APHC (Prov) COR or designee to document the date and time of sample transfer to the contract lab. The contractor courier shall date and sign the Pickup Order form to document the transfer of possession of the sample(s). A contractor representative/ project manager shall document the transfer of possession from the courier to the contract lab facility. The contractor shall immediately report in writing to the COR, all samples lost or broken in transit.
3.5 Sample Shipment Protocol From a APHC (Prov) lab - If applicable, APHC (Prov) personnel will be responsible to package samples and ship them to the contractor. Please note that APHC (Prov) shall pay the shipping costs for transportation of the samples. Contractor and APHC (Prov) shall store and/or ship samples in accordance with the preservation guidelines as noted in the analytical method until samples are analyzed, and thereafter until results are approved by the COR. The contractor shall immediately report all samples lost or broken in shipment, with as much detail as possible, to the COR.
3.6 Direct shipment of samples from the field to the contractor – If holding times are of concern, there may be a necessity to ship the samples to the contract lab directly from the field following collection. The APHC (Prov) project officer will ship the samples and a corresponding field Chain-of-Custody (COC) document to the contract lab. When the contract lab receives the samples and corresponding field COC forms, a contractor’s project manager or designee shall sign the COC forms verifying receipt of samples and immediately (within the same business day of receipt) forward the field COC to the COR for review, accountability, and LIMS login at the APHC (Prov). The contractor’s project manager will also report to the COR the condition of the samples upon receipt (to include receipt temperature) in the contractor lab. The APHC (Prov) COR shall use project planning information and the information on the COC form to generate a Pickup Order Form containing all applicable information (i.e. APHC (Prov) lab ID, APHC (Prov) field ID, analyses requested, matrix, points-of-contact, etc). The generated pickup order form will be forwarded electronically to the contract laboratory. The contractor shall then begin sample analysis. The contract laboratory project manager shall assure that the contract laboratory analyzes the sample within holding times specified in applicable methodology. If paperwork from the COR is pending, the contract lab should obtain guidance from the COR to proceed with analysis to meet holding times.
3.7 Contractor Manpower Reporting
"The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the US Army Institute of Surgical Research via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2015. Contractors may direct questions to the help desk at help desk at: http://www.ecmra.mil.
4 Contractor Qualifications – In order to perform the required analyses, the contract laboratory shall have the following instrumentation/technologies:
4.1 Instrumentation/Technologies
· High Resolution (HR) Gas Chromatograph (GC)/High Resolution Mass Spectrometer (MS) (at least 2)
· Other glassware/instruments for cleanup/extraction
4.2 Minimum requirements for contract laboratory facilities:
· Sufficient laboratory space to operate the equipment and perform the analysis as defined in this SOW
· Adequate electrical service
· Reagent water to meet ASTM Type II classification
· Class A volumetric glassware for all analyses
· Adequate fume hood system to provide safe storage of hazardous materials
4.3 Minimum requirements for contract laboratory personnel:
- Contract laboratory personnel shall meet the qualification requirements as defined in their third body accreditation requirements (i.e. NELAC, ISO 17025, DoD ELAP)
4.4 Standard Operating Procedures- At a minimum, the contractor’s laboratory shall have the following SOP’s in place:
4.4.1 Sample receipt, handling, storage and control.
4.4.2 Security, chain-of-custody and document control.
4.4.3 Sample analysis for all methods listed in this PWS (to include sample preparation, modifications to established methods, peculiarities of instrumentation, etc.)
4.4.4 Instrument calibration and standards traceability (show traceability of standards to National Measurement Systems (e.g. National Institute of Standards and Technology)
4.4.5 Manual Integration
4.4.6 Ongoing or routine laboratory operations (including instrument maintenance, procurement of supplies, and scheduling and frequency of validation of equipment (balances, thermometers, etc.)
4.4.7 Laboratory Safety and Chemical Hygiene (should address among other things wearing of lab coats, gloves, goggles, handling of hazardous materials, eye lavaging, storage of hazardous materials, safety showers, fire safety, etc.).
4.4.8 Hazardous waste/sample disposal.
4.4.9 Lab QA- to include procedures for conducting in-house audits; procedures for corrective action (failed QC, failed PT, customer comments, etc), analysis of proficiency testing samples, resolution of complaints, training, purchasing reference materials and standards.
4.4.10 Data production, reduction, transcription, verification, review, reporting, and in-house archival.
4.4.11 Determination and verification of detection and quantitation limits. (Contractor must show statistical procedure for determination and periodic verification of detection and quantitation limits assigned to analytical methods relative to this contract. Must meet current EPA detection limit determination criteria, to include future revisions.)
4.5 CONTRACTOR CERTIFICATION.
4.5.1 The Contractor shall be Department of Defense Environmental Laboratory Accreditation Program Accredited (DoD ELAP) for soil and water methods covered by this contract. Contractor shall submit proof of DoD ELAP accreditation and a DoD ELAP scope of accreditation that includes the water and soil analysis listed in this PWS.
4.5.2 The contractor shall be accredited by the National Environmental Laboratory Accreditation Program or to ISO 17025 by an approved third party accreditation body for the Method TO-9A Analysis identified in this contract. These accreditations shall meet all the requirements of the ISO 17025:2005 standard and the methods and matrices covered by this contract must be listed on the laboratory’s scope of accreditation.
The COR must be notified, in writing, within 30 days of any loss of certification for any methods noted in this PWS.
5.0 DELIVERABLE
REPORTING REQUIREMENTS AND DELIVERABLES
The contractor shall provide reports and other deliverables as part of its sample data package. Contractor data packages shall include the following documentation:
1. Final Complete Data Package (Submitted via PDF) – Data package shall comprise the following items:
0. Invoice for Services Rendered – Contractor shall submit original invoice as a separate attachment from rest of package.
0. Case Narrative – A summary description of the analytical operations that occurred during sample receipt and analyses. Case narrative should include quality control activities and corrective actions taken by lab personnel to address QC failures identified during sample analysis
0. Data qualifiers definition page.
0. Analysis report forms – These forms contain the results from measurement of those chemical parameters that are requested and specified in the Pickup Order. Data are to be identified by the APHC (Prov) Lab ID number and the corresponding field ID. The analysis report forms shall also contain sample extraction date, sample analysis date, the method employed, and any data qualifiers by analyte.
0. Sample Receipt Documentation – sample receipt logs, temperature logs, pickup order forms, COC forms.
0. Quality Control Data Summary – This section shall include a summary of the QC data and evaluation of the data (recoveries, RPDs, etc) from laboratory control samples, spikes, duplicates, blanks, etc.
0. Raw data for all analysis measurements to include the following:
(a) Calibration data. This includes standard concentrations (initial and final), information regarding the preparation of working standards, calibration standard raw data (chromatograms, etc), the correlation coefficient, and tuning data.
(b) Instrument raw data (chromatograms, summary reports, etc) for all field and QC samples, clearly showing the parameter analyzed, method description, date of analysis, sample ID, dilution factor, identification of any manual integration, and runs selected for reporting.
(c) Sample preparation bench sheets showing sample masses, initial volumes, final volumes, etc. (as applicable).
(d) Calculation Sheets (showing example calculations) clearly describing information pertinent to particular analysis (i.e. data calculations, units, final values, etc.)
(e) Copies of the appropriate logbook pages (sample preparation, moisture determination (if applicable), etc).
(f) Reported data shall be rounded off to two significant figures.
(g) The laboratory must have the capability to report (pdf and EDD) estimated (J-qualified) results. The qualifiers will be applied according to the reference method or other regulatory guidance for EPA 1613B and EPA TO-9A, and according to the DoD QSM (current version) for EPA 8290A.
PDF Scanning Instructions for the Final Complete Data Package – This scanned document will include the entire hard copy package as described above, minus the invoice. Please provide the invoice via PDF as a separate file from hard copy. Final package PDF and invoice PDF are emailed to the following address: usarmy.apg.medcom-phc.mbx.dls-contract-hardcopies@mail.mil . These will be due no later than 2:00 PM Eastern Standard Time on the due date specified on the Pickup Order. Naming convention of Final PDF file and invoice should at least include your lab queue and the APHC (Prov) Pickup Order number.
1. Preliminary Sample Analysis Results if required (PDF scan) – Due one day before Final Complete Data Package PDF (see section 2 General Requirements). These data results PDF will contain quantitated results in appropriate units, or detection limits, for the requested chemical parameters. Sample data shall be identified by APHC (Prov) lab numbers. Please note that the contractor shall transfer the data electronically from their lab to APHC (Prov) lab via INTERNET using the file format describe below:
1. ELECTRONIC DATA DELIVERABLE (EDD) - The electronic data deliverable (EDD) and hardcopy report (pdf) are REQUIRED to be derived from the same data source. Information (sample IDs, field IDs, etc) and data (analytical results, units) must match. The process that generates the hard copy and EDD is REQUIRED to be validated to demonstrate that the process provides identical information and data.
6 GOVERNMENT FURNISHED SUPPLIES AND MATERIALS
6.1 The following items will be furnished to the contractor by the Government for use in performance of the contract requirements:
6.1.1 Samples for analyses – a sample consists of one or more collection containers/ receptacles containing water, soil, or ambient air. Individual containers may contain preservatives (where required).
C.6.1.2 Pickup order/delivery order forms as well as accompanying chain-of-custody forms (where applicable) containing information pertinent to the accompanying batch of samples.
6.2 Unless otherwise instructed by the COR, the contractor shall be required to dispose of unused sample volume and used sample bottles/containers no earlier than 60 calendar days following submission of analytical data. Sample disposal and disposal of unused sample bottles/containers is the responsibility of the contractor and should be done in accordance with all applicable laws and regulations governing disposal of such material.
6.3 The contractor must return all shipping receptacles (boxes or coolers) to the APHC (Prov) within 3 business days of receipt. The cost of return will be paid for by the contractor lab.
7 COMPLIANCE WITH APPLICABLE FEDERAL ENVIRONMENTAL STATUTE LAW – Nothing in this contract shall in any way abrogate, supersede or in any way modify the contractor’s responsibility to comply with applicable Federal Environmental Statute/Law.
8. ON-SITE INSPECTIONS
The Government reserves the right to conduct an on-site inspection prior to contract award to evaluate the technical and administrative capability of laboratory to perform acceptable analytical operations and generate quality data and periodically during the contract.
9. ANTI-TERRORISM AND OPERATIONAL SECURITY (AT/OPSEC)
There will be no work performed on the APG site by the contractor. The analysis will be solely performed at the contract lab facility. Since there is no more than 30 days of onsite service; there is no OPSEC Standing Operating Procedure/Plan required. There is no requirement for the contractor to complete iWATCH awareness training. There is no access to classified information. The contractor will have no access to the APHC (Prov) IT systems.
For Contractor’s who ARE picking up samples at the APG Installation location:
0. Access and general protection/security policy and procedures. Contractor and all associated sub-contractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
0. For contractors that do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
