Control No: JA 16316
Justification and Approval for Other than Full and Open Competition
Six Month Extension for Animal Care Support Services
1. Contracting Activity: The contracting activity for this action is the U.S. Army Medical Research Acquisition Activity (USAMRAA) located at 820 Chandler Street, Fort Detrick, MD 21702.
2. Description of Action: The U.S. Army Medical Research Institute of Chemical Defense (USAMRICD) and U.S. Army Public Health Center (Prov) (USAPHC (Prov)) located at Aberdeen Proving Ground (Edgewood) South, Maryland 21010 have a requirement for Animal Care Support Services. The support services are currently being provided under contract W81XWH-11-C-0101 by Sobran Incorporated of 4401 Dayton- Xenia Rd, Dayton, OH 45432-1805. The period of performance on the contract ends August 31, 2016 thus, a six month extension is required for continuous support without a break in service. The modification will cite Federal Acquisition Regulation (FAR) 52.217- 8; Option to Extend Services which, was included in the solicitation and award but was not evaluated. The Firm-Fixed-Price (FFP) modification will be funded using certified Research, Development, Testing and Evaluation (RDT&E) 21*2040; Fiscal Year (FY) 2016 funds. This modification will permit a six month extension to allow for a new competitive acquisition without a break in service support.
3. Description of Services: The required Animal Care Support Services are an on-going need for USAMRICD/USAPHC(Prov). The support services include animal care, husbandry and all aspects of the animal husbandry program, veterinary medical support, and comparative pathology support. The types of animals include rats, guinea pigs, old work non-human primates, rabbits, mice, swine, ferrets, and zebrafsh.
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 United States Code 2304(d)(1)(B) as implemented in FAR 6.302- 1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements. Sobran Inc. is the only vendor positioned to provide these continued services in the USAMRICD/USAPHC(Prov) vivarium. The USAMRICD is in the process of moving into a new facility and Sobran is the only vendor with the knowledge of the new facility to assist with the move of the animals and equipment. The move into the new building is within scope of the current contract however, the location will change over the 6-month period. The animal care support directly impacts USAMRICD’s research mission and a break in service would negatively impact USAMRICD/USAPHC’s overall mission. Sobran, Inc. is able to continue performing the services without incurring performance disruption or unacceptable degradation of services. An award to any other source than Sobran, Inc. would result in unacceptable

5. Reason for Authority Cited: It is essential that these support services be sustained without disruption and no other source can render the required services in the time frame required by this extension of services without a significant break in service. All of the directorates identified are providing direct support to the strategic imperatives of the Medical Command (MEDCOM) and USAMRICD in protection of the war fighter, synergy of effort and supporting a center of excellence in research.
6. Efforts to Obtain Competition: Notice of intent W81XWH10524040 to extend the performance of the award was posted on FedBizOpps.gov in July 2016 with a closing in August 2016. No responses were received to indicate that another source could perform the work.
7. Actions to Increase Competition: A procurement package has been provided to USAMRAA to replace the expiring award. Sources sought W81XWH16ACRS0001was posted on FedBizOpps.gov to identify available business types that can perform the work. The responses will be used to determine competitive set-aside arrangements that may be appropriate for the replacement procurement vehicle.
8. Market Research: Market research has determined no other sources can perform this work without a break in service. A re-procurement of animal care services will be competitive based on the responses from sources sough notice W81xwh16ACRS0001.
9. Interested Sources: Notice of intent W81XWH10524040 to extend the performance of the award was posted on FedBizOpps.gov with no responses received. The notice of intent described the Government’s intent to extend the period of performance on W81XWH-11-C-0101 by six (6) months to allow for new competitive procurement in accordance with FAR 52.217-8.

The current contract, W81XWH-11-C-0101 with Sobran Incorporated, was competed and awarded as a twelve-month base year with four (4) twelve-month option years. The solicitation was competed as unrestricted with competition received.
(1) Alternatives have been discussed and have been deemed unaccepted:
(a) Break in Service: The support services are mission critical to USAMRICD/USAPHC(Prov) and this support cannot cease without serious repercussions for not carrying out the mission effectively and efficiently. Suspending the support would have negative consequences research at USAMRICD and studies at USAPHC (Prov). The USAMRICD could lose their AAALAC certificate and research would stop if the animal care support is suspended.
(b) Use of In-House Resources: Using Government personnel (military or civilian) to replace the support services in the execution of the tasks under this contract is not realistic. The resources at USAMRICD/USAPHC (Prov) are not able to provide neither the expertise nor the additional time to complete these tasks.
11. Technical and Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
