Statement of Work (SOW)
Implementation of Predictor/Remediation Exams
For
Practical Nurse Course
Department of Clinical Specialty (DCS)
US Army Medical Center of Excellence (MEDCoE)
1. General. This Performance Work Statement is for the implementation of a package of predictor /remediation exams into the Practical Nurse Course (68C).
2. Background. At the conclusion of the Practical Nurse Course (68C), students are required to take and pass the National Council Licensure Examination (NCLEX-PN). In order to ensure a successful outcome on the licensure exam, civilian schools of nursing have implemented standardized predictor/remediation examinations. The 68C program maintains its accreditation through Texas Board of Nursing (TBON).
a. New format and additional content have been added to the Next Generation (NGN) NCLEX- PN exam beginning in April 2023. The new exam has an increased focus in the areas of clinical judgments to include thinking process, application, and case studies. Historically, clinical judgments, specifically thinking process and case studies, have not been a focus of LPN programs. The detailed blueprint for this exam was not available for release until spring of 2020. The first class to test under this new exam was the San Antonio Military Medical Center (BAMC) class 22-005, graduating 12 April 2023.
b. TBON requires that all nursing programs implement methods to increase success on the NGN NCLEX. TBON requires a first-time pass rate of the NCLEX-PN to be above 80% to maintain full accreditation. Our current first time NCLEX-PN pass rate for the calendar year 2025 is 99.6%.
c. Based on historical NCLEX-PN pass rates, the course content has validation with regard to content and test question structure when compared to civilian programs. Several factors provide challenges to the 68C program that impact our course content and testing procedures that are not in a civilian program. The rapid turnover of military instructors and lack of subject matter experts on the podium as well as lack of higher education requirements impact the delivery of course content and student comprehension. Unlike a civilian program, the 68C does not have admission exams.
3. Scope of Work. The description of services is for the implementation of a package for predictor /remediation exams (Fundamental / Foundation and Comprehensive / Exit Exams) into the Practical Nurse Course (68C).
4. Travel. There is no cost for Contractor personnel travel.
5. Dates. Predictor tests will be administered at specific milestones in the 52-week curriculum. The milestones will be determined by didactic content and include:
a. Completion of the junior level content - Fundamentals / Foundation exam.
b. Completion of all course content - Predictor Comprehensive Exit exam
6. Place of Performance:
a. Practical Nurse Course Phase Two Madigan Army Medical Center.
b. Practical Nurse Course Phase Two Eisenhower Army Medical Center.
c. Practical Nurse Course Phase Two William Beaumont Army Medical Center.
d. Practical Nurse Course Phase Two Brooke Army Military Medical Center.
e. Practical Nurse Course Phase Two Walter Reed National Military Medical Center (currently not used. Will be activated as needed).
7. Government Furnished Information: The government will provide a program sponsor and Information Management contact to assist with the computer access requirements.
8. Specific Tasks: The contractor shall make the 'fundamental / foundation' exam available to students upon completion of the junior phase according to the curriculum available each year and the 'comprehensive / exit' practical exams shall be available once students complete the senior phase. The fundamental / foundation exam will evaluate the student's learning thus far in the subject matter tested, predict the student's success for the NCLEX-PN, and offer remediation / study material based on the student's weak areas. The comprehensive / exit exam evaluates the student's learning based on the entire Practical Nurse Program curriculum and chances for success on the NCLEX-PN offer remediation / study material based on the student's weak areas.
The contractor shall provide all labor, materials and supplies necessary to provide the following services:
1) Provide on-line services to 500 students for the 'fundamental / foundation' exam and 500 students for the 'comprehensive / exit' practical exam. Both examinations will have Phase 2 faculty oversight.
2) Provide questions with evidence-based reliability and validity.
3) Predict NCLEX-PN success with a better than 95% reliability.
4) Provide questions based on current NCLEX-PN testing format.
5) Provide immediate online reports that are available to faculty and students independently.
6) Compare exam scores of individual Phase 2 sites to national averages and to each of the other Phase 2 sites.
7) Provide immediate remediation data for each student targeting missed individual questions with rational and references for correct answers.
8) Allow printing of remediation data to be used in the development of student specific NCLEX- PN preparation.
9) Provide comparison data based on phase 2 sites and exam performance.
10) Provide specialty examinations targeting critical thinking skills in preparation for new NCLEX focus.
11) Provide unlimited portal/ dashboard access for faculty staff members.
12) Provide structured remediation and tracking for each student, including individualized remediation assignments, documentation of completion, and faculty accessible reports showing student progress and time spent in remediation activities.
13) Provide extensive practice question banks aligned to the current NCLEX PN Test Plan, including rationales, references, and performance analytics accessible to both students and faculty.
9. Contractor Furnished Items: The Contractor shall perform the following tasks:
a. Provide on-line access to the individual exams on dates determined by the Phase Two site based on Program of Instruction milestones.
b. Coordinate with designated government program sponsor for delivery of access codes for individual students.
c. Provide an extensive library of curriculum tailored questions that reflect the current NGN NCLEX-PN blueprint and provide for immediate remediation to both student and instructor.

Tax on Certain Foreign Procurements-Notice and Representation (Feb 2026) (Deviation 2026-
(a) Definitions. As used in this provision-
Foreign person means any person other than a United States person.
Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. For purposes of the prior sentence, a foreign country does not include an outlying area of the United States.
United States person as defined in 26 U.S.C. 7701(a)(30) means
(1) A citizen or resident of the United States;
(2) A domestic partnership;
(3) A domestic corporation;
(4) Any estate (other than a foreign estate, within the meaning of 26 U.S.C. 701(a)(31)); and
(5) Any trust if-
(i) A court within the United States is able to exercise primary supervision over the administration of the trust; and
(ii) One or more United States persons have the authority to control all substantial decisions of the trust.
(b) Unless exempted, there is a 2 percent tax of the amount of a specified Federal procurement payment on any foreign person receiving such payment. See 26 U.S.C. 5000C and its implementing regulations at 26 CFR 1.5000C-1 through 1.5000C-7.
(c) Exemptions from withholding under this provision are described at 26 CFR 1.5000C-1(d)(5) through (7). The Offeror may claim an exemption from the withholding by using the Department of the Treasury Internal Revenue Service (IRS) Form W-14, Certificate of Foreign Contracting Party Receiving Federal Procurement Payments, available at www.irs.gov/w14. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the IRS.
(d) For purposes of withholding under 26 U.S.C. 5000C, the Offeror represents that
(1) It [ ] is [ ] is not a foreign person; and
(2) If the Offeror indicates "is" in paragraph (d)(1) of this provision, then the Offeror represents that-I am claiming on the IRS Form W-14 [ ] a full exemption, or [ ] partial or no exemption [Offeror must select one] from the excise tax.
(e) If the Offeror represents it is a foreign person in paragraph (d)(1) of this provision, then-
(1) The clause at FAR 52.229-12, Tax on Certain Foreign Procurements, will be included in any resulting contract; and
(2) The Offeror shall submit with its offer the IRS Form W-14. If the IRS Form W-14 is not submitted with the offer, exemptions will not be applied to any resulting contract and the Government will withhold a full 2 percent of each payment.
(f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.
(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.
