Control No.: 14-004

Approval is being requested for follow-on, three month short-term BPA Call.

· Teleradiology Services

Nature:Follow-on contract for (W81K04-09-A-0008-0003)
Pricing:Firm-Fixed PriceBPA Call Estimated at $50,000.00
Funds:DHP funds
Period of Performance1 JAN 14 – 31 MAR 14
Name of Proposed Contractor:
Valor Network, Inc., W81K04-09-A-0008 (CAGE: 4TDX1)

2. NATURE OF ACTION BEING APPROVED. This document sets forth the justification and approval as required by Federal Acquisition Regulation (FAR) part 13.106-1(b). This effort is to procure Teleradiology services at Irwin Army Community Hospital (IACH), Fort Riley, Kansas and will be awarded as a Firm-Fixed Price BPA Call.

3. DESCRIPTION OF SUPPLIES OR SERVICES. This requirement is for Teleradiology services. The Contractor will provide professional diagnostic radiological initial interpretations and communication s with the ordering physician, presentation of final reports and the uploading of final reports into the Composite Health Care System (CHCS).

4. ESTIMATED DOLLAR VALUE. The total estimated value of the proposed action is $50,000.00.

5. STATUTORY AUTHORITY. The proposed action may be awarded on a sole source basis under the authority of FAR 13.501(a) (2) (i) the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996). The propose award of this short term contract is authorized under 10 U.S.C. 2304(c)(3) and FAR Part 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

6. RATIONALE SUPPORTING USE OF CITATION IN NO. 5. Teleradiology services have been determined by IACH, Fort Riley, KS to be critical to the continuity of patient care. A break in these services would negatively affect patient care; hence, this would ensure there isn’t a lapse in these critical services while the long term contract action is being established. The new contract action is expected to start on 1 January 2014.

The original BPA Call (W81K04-09-A-0008-0001) was awarded to Valor Network Inc., on 9 August 2012. It was originally competed amongst the five MEDCOM Blanket Purchases Agreement (BPA) holders US Radiology, Heritage Radiology Solutions, Online Radiology Medical Group Inc., and Southeast XRAYS, Inc.; however, Valor Networks, Inc. wasn’t able to begin performing services under the above referenced BPA Call until 8 May 2013. Due to the Government’s on-going connectivity issues; neither the incumbent Contractor nor the Government were able to reap the full benefits of the original 12 month period of performance. Nine month’s worth of fiscal year 12 (FY) funds have been lost. A subsequent short-term sole-source BPA Call (W81K04-09-A-0008-0002) was awarded to bridge the gap until a long-term contract could be established; however, it has been determined that an additional three months would be needed in order to allow enough time for adequate completion of the long-term Teleradiology contract. Due to system malfunctions and the Government shutdown, additional time is now needed to finish soliciting and awarding a new contract. Use of a bridge contract will also allow time to the awardee to coordinate with IACH to have a working interface and to have radiologists credentialed and in place by the time the bridge contract ends. IACH currently has only one Radiologist available to complete the workload of four Radiologists. Valor Network, Inc, currently has B2B connectivity and their interpreting Radiologists are currently credentialed at IACH. Awarding another short-term BPA Call back to Valor will allow time for the new Teleradiology Contract to be put into place.

7. THE EFFORTS TO IDENTIFY ADDITIONAL SOURCES INCLUDING THE MARKET RESEARCH CONDUCTED. Market Research is not applicable. Pricing will be based on the current BPA Call prices.

8. FUTURE PLANS TO PERMIT COMPETITION: WRCO’s intends to establish a long term contract via full and open competition after the exclusions sources, the necessary documents (GFEBS0010375339) has been received. Awarding the follow-on BPA Call to Valor Network, Inc, allows time for the Government to compete and award a long term contract.

9. TECHNICAL/REQUIREMENTS CERTIFICATION: Based on the above, I recommend this acquisition be conducted on a sole source basis. I certify that technical data which form a basis for this justification that are the responsibility of technical or requirements personnel are complete and accurate to the best of my knowledge and belief:

Name: Brandon BushSignature: //Signed hardcopy and is attached in contract file//
Title: Supervisor,Date: 12/17/13

Radiology Department

10. CONTRACTING OFFICER DETERMINATIONS

a. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. A fair and reasonable determination is made based on the current pricing listed in the previous firm-fixed-price purchase order. No certified cost or pricing data is required.

b. I hereby certify that this justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this urgent and compelling justification provided that the services herein described have otherwise been authorized for acquisition.

c. This Justification and Approval (J&A) cites FAR 6.302-1, which provides the procedures for sole source acquisitions justification in lieu of full and open competition. FAR part 13.106-1(b) requires only that the Contracting Officer “determines that the circumstances of the contract action deem only one source reasonably available, e.g., urgency.” The J&A sufficiently satisfies this requirement.
