5. Reason for Authority Cited: Hawaii Administrative Rules, Title 11, Chapter 143, Testing of Newborn Infants of Metabolic and Other Diseases states that its purpose is to “assure the testing for and detection of specified metabolic and other diseases in all infants born in the State in order to permit the institution of effective treatment for affected infants.” This is a mandatory test to be conducted on all newborn infants in the state of Hawaii.
Hawaii administrative Rules 11-143 specifies that ordering/procurement of screening kits be done from the State of Hawaii, Department of Health only to ensure an effective program through a comprehensive and centralized process of collection and testing.
Therefore, the only available source for procurement is through the Department of Health, Hawaii.
6. Actions to Increase Competition: A Request For Information (RFI) was posted to FedBizOps on 8 July 2016. There were no other sources responding to the RFI that have expressed an interest.
Effective competition is not expected to be high considering that the only newborn metabolic screening kits that can meet TAMC’s current need are only provided by the Department of Health, Hawaii. The government will continue to conduct on-going research of the industry marketplace to determine if there are new entrants into this product arena.
Due to the Hawaii Administrative Rules, Title 11, Chapter 143, the Department of OB/GYN is unable to procure newborn metabolic screening through other sources. However, should these rules be updated to allow other providers, the Department of OB/GYN will explore other newborn metabolic screening kits.
7. Market Survey: Market research conducted over the internet within the past 12 months indicates that this product is commercial in nature. No other source provides these newborn metabolic screening kits to medical facilities in the state of Hawaii. Also, a sources sought/RFI was posted to FedBizOps on 8 July 2016. There were no additional vendor sources who responded to the sources sought posting.
