About this file

This document is a Memorandum for Record - Limiting Competition justifying a sole-source acquisition for bone marrow donor services. The Medical Readiness Contracting Office-West is procuring urgent bone marrow, stem cells, or cord blood unit transplants for a patient diagnosed with B-cell Acute Lymphocytic Leukemia at Brooke Army Medical Center. The National Marrow Donor Program (NMDP) is the sole source selected due to its exclusive access to a global network of over 20.5 million potential donors, with a 95% success rate in matching patients to cord blood donors and an 86% likelihood of finding a suitable stem cell donor.

The contract will be a firm-fixed-price procurement for the period of 1 May 2025 to 31 April 2026, funded through Operations & Maintenance, Army (OMA) funds. Market research conducted using search engines and a Dynamic Small Business Search confirmed NMDP as the only viable source. The government will continue monitoring the market for additional sources but determined this sole-source acquisition is in the best interest of the government due to the urgent medical need and NMDP's unique donor registry capabilities.

4. Authority:

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

a. The National Marrow Donor Program (NMDP) is the only source reasonably available, given its exclusive access to a global network of donor and cord blood registries and banks. The NMDP registry contains over 50,000 cord blood units and 10 million potential donors. Through established partnerships with other international registries, the NMDP has access to more than 20.5 million potential donors worldwide.

As the largest registry of cord blood in the United States, the NMDP reports a 95% success rate in matching patients to suitable cord blood donors. Additionally, they report an 86% average likelihood of locating a suitable stem cell donor.

b. N/A

c. Any delay in initiating the donor search would risk disease progression and could significantly compromise the patient’s health outcomes.

7. Market Research: Research was done by using public search engines such as Google and Bing. The search was done by using key words “Bone Marrow” and the majority of the results found were for the National Marrow Donor Program. A Dynamic Small Business Search was also conducted using key words “bone and Marrow” and transplant” with NAICS code 621991, Blood and Organ Banks; the results found do not indicate the capability to fulfill the Government’s requirements. Upon final approvals, this J&A will be posted to https//sam.gov, the Government Point of Entry.

8. Other Facts: The government will continue to monitor the market for additional sources, but at this time there is only one source that can provide these services due to having access to over 20 million donors with the possibility of success in finding a match. Past requirements of this nature have been solicited and posted on Government point of entry without obtaining responses from industry. The government will continue to seek new resources that will satisfy this requirement through continued market research to determine if there are new technologies and companies that can provide these services. This acquisition will be procured and evaluated using only one responsible source for a firm-fixed price contract to NMDP.
