About this file

This document is a sole source justification for a federal contract action. The Regional Health Contracting Office-Central is procuring Temporomandibular Joint Total Joint Prostheses from TMJ Concepts on a sole source basis. The prostheses are individually fabricated for each patient's unique anatomy at an estimated value of $20,000. They are required by the Department of Surgery at Carl R. Darnall Army Medical Center to treat patients' temporomandibular joint diseases from July 15, 2021 through September 30, 2021. TMJ Concepts is currently the only source capable of providing the customized prostheses to the required quality level, as the supplies are specialized and patient-specific. Market research found no other potential sources. The contracting officer determined the anticipated $20,000 cost to be fair and reasonable based on price analysis.

5. Reason for Authority Cited: The Government has a current need in the Department of Surgery, Oral Maxillofacial Department in order to provide for Temporomandibular Joint (TMJ) Total Joint Prosthesis for the health and welfare of the patient. The surgeon has determined that the TMJ Prostheses are required for the positive outcome and the health and welfare of the patient. The essential functions for life of mastication, speech, swallowing and deglutination rely on proper functioning of the temporomandibular joint, and these functions put the TMJ under more cyclic loading than any other joint in the body. End stage temporomandibular joint disease that leads to architectural destruction and physiologic dysfunction dictates the need for total joint replacement. TMJ Total Joint Prostheses have been successfully used in degenerative TMJ disease for over two decades; success rates are higher than 90% which is documented in current literature. The prosthesis is individually fabricated for the unique anatomy of each individual patient and the patient specific precise implant components allow for excellent adaptation, fixation and optimum function for the patient. A TMJ Total Joint Prosthesis helps to preserve the patient’s maxillofacial functions, improve their quality of life, and enhance the patient’s ability to perform day to day functions.

6. Efforts to Obtain Competition: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the dollar threshold.
