☒ FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

a. The Government currently owns the DXH 600 Hematology Analyzer, located at IACH. Beckman Coulter is the original equipment manufacturer (OEM) of the DXH 600 Hematology Analyzer. Purchasing maintenance from Beckman Coulter, shall provide service and replacement of parts that are compatible with the equipment.

b. Purchasing similar maintenance that is non-compatible, would risk the possibility of equipment damage and possible disruption of patient care.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 ☐ do not apply due to the $ threshold, ☒ apply and will be followed, or ☐ do not apply due to an exception at 5.202.

7. Market Research: The Contract Specialist conducted a dynamic small business search with the NAICS code 811219 and the capabilities narrative “hematology analyzer maintenance”, that revealed no small businesses that fit within these guidelines. A sources sought was posted to FedBizOpps from 7 Aug 2019 – 13 Aug 2019, with no responses.

8. Other Facts: Beckman Coulter equipment is serviced, repaired, and maintained only by Beckman Coulter technicians; they do not allow third party entities to service, repair, or maintain their products. It is recommended for this to be a sole source award to Beckman Coulter.

9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
