For All Actions At or Below the Simplified Acquisition Threshold

Control No: 19-RHCO-C-672

Version – February 2017

4. Authority:

FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

a. The authority cited above allows the Government to issue a sole source contract to Hologic, Inc. for the full service maintenance and calibration of the Digital Mammography Imaging Units at William Beaumont Army Medical Center. William Beaumont Army Medical Center has a continuing need for these services. Hologic, Inc, the original equipment manufacturer (OEM) does not authorize third-party service providers to perform maintenance and continued calibrations on the systems. Furthermore, the Hologic software utilized in the systems are proprietary and not available through other sources.

b. Without these services the Mammography Units located in the Teleradiology Department would not be serviced, maintained or calibrated. This has a vital impact on William Beaumont Army Medical Center’s patient care and accuracies with diagnosis. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for statements of capability, searches on the internet and telephonic inquiries.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed.

7. Market Research: Market research was completed in accordance with FAR 10.002(b)(2) procedures. Research of mandatory sources, including AbilityOne, s, and GSA Schedules indicate the required services are not available from these sources. Small Business Administration’s Dynamic Small Business Search (DSBS), FSS Schedule search, open market search, historical contract information, and a sources sought notice were utilized to further evaluate the market. The sources sought notice, posted to FBO, from 10 to 19 July 2019 for this requirement did not return viable sources. Historical contract files were researched and noted that a sources sought notice was posted to FBO for the exact requirement at Brooke Army Medical Center from 1 to 9 August 2018, with only one response from the OEM, Hologic Inc.

Purchase Order , was competed with only one offer. Hologic was contacted by the Contract Specialist on 6 September 2019 to inquire if third party vendors were authorized to perform maintenance and calibration services on the Hologic mammography systems. Hologic’s Breast & Skeletal Government Accounts Manager responded via email stating Hologic does NOT authorize 3rd party service providers to perform maintenance and calibrations on their systems and the proprietary software is not available through other sources.

Based on this information, the requirement will be solicited from a single source IAW FAR 13.106(b)(1)(i). This procurement has been identified as a commercial service IAW FAR 2.101.

The North American Industry Classification System Code (NAICS) is 811219, size standard $20.5 Million.
