Control Number: 19-RHCO-C-232 Limited Sources Justification or Sole Source Determination for Actions under the Simplified Acquisition Threshold (Currently $250K)
1. Contracting Activity: Regional Health Contracting Office-Central, US Army Health Care Acquisition Activity, San Antonio Military Medical Center, Fort Sam Houston, Texas 78234
2. Description of Action: William Beaumont Army Medical Center, Fort Bliss, TX is requesting a Bridge Contract for a cost-per-kit arrangement using the BioMerieux Vitek 2 XL microbial identification and antibiotic susceptibility testing analyzer and one Vitek Mass Spectrometer. ECN #'s 031901 and 031902 are already in place per existing contract W81K00-18-P-0671 which expires 31 March 2019.
In this arrangement, the costs to utilize the equipment is rolled up into the costs of the tests. No options are being requested.
Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: Total Dollar Value: $ 248,363.85
Required delivery date or period of performance: 1 Apr 2019 - 30 Sep 2019
Name of Intended Contractor: BioMerieux Street Address: 100 Rodolph St City, State, Zip: Durham, North Carolina 27712-9402
Phone: (919) 479-3636
3. Description of Supplies/Services: Usage under a cost-per-kit arrangement. The costs of equipment usage are rolled up into the costs of the tests. In addition, the contractor provides all equipment maintenance, consumables, reagents, calibrators, controls and any other materials necessary to troubleshoot instrument failure in accordance with the Statement of Objectives.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
Control Number: 19-RHCO-C-232
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
Reason for Authority Cited: This contract will allow for the continuation of mission critical medical testing without a break in service while source selection process for the long term contract is being conducted (W81K0019Q0002). The bridge contract will also provide three months for correlation and validation of the analyzers which is required before the testing may go live with patient specimens. The existing bridge contract (W81K00-18- P-0671) ends 31 March 2019. BioMerieux's equipment has been correlated and validated for patient testing, thereby eliminating time other vendors require to correlate and validate their equipment. There’s no other contractor that would the correlation and validation of the analyzers . Any lapse in coverage would have an immediate negative impact and jeopardize the healthcare mission.
Actions to Increase Competition: None. The solicitation was competed 100% full and open due to a vendor challenge of the original Sole Source Justification. The technical evaluations have rendered both contractor proposals technically unacceptable thereby necessitating additional time for discussions and the correlation/validation process. Competing for this bridge contract would not be as the time needed to transition, bring in new equipment, correlate and validate would exceed the time available to finalize the source selection process.
Market Survey: There are multiple vendors capable of providing these products/services to William Beaumont because of the reasons stated above in paragraph 5, The proposed interim contract would provide time necessary to complete the pending full and open competed acquisition and to provide time necessary for a proper transition to new equipment if a new contractor were to win the pending competition.
