5. Reason for Authority Cited: J.W. Manny, Inc. is the exclusive distributor of the military hearing sound booth for Eckel Industries, Inc. The Eckel booths use a “CAM-LOCK” which is proprietary to Eckel and made specifically for military use. The current hearing booths were purchased from J. W. Manny, Inc. with an accompanying 15 year warranty. If anyone other than Eckel or the authorized distributor provides for the de-install, relocation and re-install of the hearing booths this would void the 15 year acoustic warranty. No other distributor of the hearing booths can supply the military hearing sound booths and associated services per agreement between J. W. Manny, Inc. and Eckel Industries, Inc. dated 5 January 2017. The booths are proprietary to Eckel and are the only approved hearing booths that are approved by the American National Standard Specification, (ANSI) standard S1.11, mandated by the United States Department of Labor, Occupational Safety and Health Administration (OSHA) for military use and VA Hospital use. Hearing booths that are used by the US military are regulated in DODI 6055.12 and must meet ANSI Standard S1.11. After being reassembled at the new site the J.W. Manny company shall recertify the equipment per ANSI standards S3.1-1999 for Maximum Permissible Ambient Noise Levels.

6. Actions to Increase Competition: On future requirements the Government will try to procure these items through full and open competition on the Government Point of Entry. When the current equipment reaches the end of its life cycle, becomes obsolete or when equivalent equipment becomes available every effort shall be made to increase competition. CRDAMC will continue to evaluate the capabilities of other vendor's products and re-procure the products that provide the best value to the Government. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries. Telephonic and world-wide-web inquiries resulted in no other vendors that could provide the de-install, relocation and re-install for the Eckel Hearing Booth Equipment.

7. Market Survey: Initial market research revealed that the suggested vendor, a small business, was the only company that could provide the de-install, relocation and re-install that are being requested for the particular government owned equipment. Therefore, due to the proprietary nature of the product and the guidelines set forth in the original equipment warranty no other business can currently provide the requested services. J.W. Manny, Inc. is the sole authorized provider of the services that are needed for this procurement.
