Limited Sources Justification or Sole Source Determination for Actions under the Simplified Acquisition Threshold (Currently $250K)

1. Contracting Activity: Regional Health Contracting Office-Central, US Army Health Care Acquisition Activity, San Antonio Military Medical Center, Fort Sam Houston, Texas 78234

2. Description of Action: William Beaumont Army Medical Center, Fort Bliss, TX is requesting a Bridge Contract for a cost-per-kit arrangement using the BioMerieux Vitek 2 XL microbial identification and antibiotic susceptibility testing analyzer and one Vitek Mass Spectrometer. ECN #'s 031901 and 031902 are already in place per existing contract W81K00-17-P-0322 which expires 30 Sep 2018. In this arrangement, the costs to utilize the equipment is rolled up into the costs of the tests.

Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: _________ Total Dollar Value: $248,363.85

Name of Intended Contractor: BioMerieux Street Address: 100 Rodolphe St City, State, Zip: Durham, North Carolina 27712-9402

Phone: (919) 479-3636

3. Description of Supplies/Services: Six month POP beginning 1 Oct 2018 – 31 March 2019 for a cost-per-kit arrangement. The costs of equipment usage are rolled up into the costs of the tests. In addition, the contractor provides all equipment maintenance, consumables, reagents, calibrators, controls and any other materials necessary to troubleshoot instrument failure in accordance with the Statement of Objectives.

4. Authority Cited:

(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

Control Number: 19-RHCO-C-44

5. Reason for Authority Cited: This contract will allow for the continuation of mission critical medical testing without a break in service while the Contracting office revises their Sole Source strategy to procure the long term contract competitively. The existing contract ends 30 September 2018 and this Bridge contract will allow the equipment to remain in place until the competitive action is awarded. Any lapse in coverage would have an immediate negative impact and jeopardize the healthcare mission.

6. Actions to Increase Competition: Competing this requirement is not an option for many reasons that include 1) time required to custom build the required analyzers based on the William Beaumont healthcare mission 2) time required to deliver and install the equipment and 3) the time to correlate/validate the equipment before the “Go live” date. This can take from 3-6 months to finish.

This equipment must be available for use on 1 October 2018 therefore at this late date, it would not be possible to compete. The original action was going to be Sole Sourced however the justification was challenged by industry. There isn’t enough time to properly compete the long term requirement thus a short term bridge is necessary.
