Q&A Questions and Answers - W81K00-17-T-M044 – Orthopedic Implants and Supplies
1. The revised solicitation indicates in the SF1449 that there are 66 pages. However there are only 48 pages in the document. Are there 48 pages or 66 in the document? Please clarify.
Government Response: There are a total of 48 pages for the solicitation document.
2. On page 19 Volume III item 3 indicates ‐Brochures and/or product information containing illustrations of proposed products (no more than 100 pages) are to be supplied. Smith & Nephew manufactures thousands of implants. May we instead provide on‐line website addresses which contains in‐depth product information and allows you select the applicable product category, select the product type, and select the product brand name?
Government Response: The government will not accept or review an on‐line website pertaining to any quotation submitted for this requirement. Offerors must provide their quotation in accordance with the instructions provided in this solicitation.
3. On pages 4‐12 of the solicitation is the Non‐Defense Health Agency (Non‐DHA) Health Insurance Portability and Accountability Act (HIPAA) Business Associate Agreement (BAA) (7 July 2014). This clause has been removed many DOD contracting officers purchase orders as OR staff and contracting officers realize we are a device maker and under HHS guidance are not subject to the requirements. I have attached a letter from our legal department as well as supporting documentation from HHS. Please advise that this clause will be removed?
Government Response: The Contractor shall submit their proposal in accordance with 52.212‐1 and 52.212‐2. The government will review and either accept or reject any requested revision to be executed before an award.
4. I wanted to confirm the number of pages listed in the solicitation is 48 and not 66.
Government Response: See answer to question number 1.
5. Please explain the purpose of offering a BPA for the region for Orthopedic Implants and Supplies when those products are readily available from vendors on DAPA, an approved purchasing vehicle for DoD?
Government Response: The requirement for orthopedic implants and supplies as stated in the solicitation is the government’s requirement. The purpose of the offering is to meet a government need for orthopedic implants and supplies within the categories listed. This requirement is to support supplies needed and not available on
DAPA.
6. There are no specific salients for Orthopedic Implants and Supplies Technical evaluation other than, “the medical implant is generally fabricated using stainless steel and titanium alloys for strength and the plastic coating that is done on it acts as an artificial cartilage”, yet there is a technical evaluation by the facility’s orthopedic surgeon prior to being accepted for use by the government. In the general application of the above statement what is the orthopedic surgeon using to make the determination?
W81K00-17-T-M044
Government Response: The addendum to FAR Clause 52.212‐1 provides the instructions for submission of quotations, while the addendum to FAR Clause 52‐212‐2 provides the methodology for evaluating offers submitted in response to this solicitation.
7. Since this BPA solicitation is covering the region, will there be an evaluation at each facility by an orthopedic surgeon using the same salient as above?
Government Response: See response to question #6.
8. Will there be more than one vendor awarded a BPA in each category?
Government Response: The Government anticipates awarding up to 5 blanket purchasing agreements to responsible vendor(s) whose offer meets or exceeds the minimum technical requirements of the solicitation and provides fair and reasonable pricing. This may include more than one award per category.
