52.212-2 ADDENDUM
Addendum to 52.212-2
Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. Award maybe made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
Paragraph (a) is hereby replaced with the following:
(a) The Government will make a single award resulting from this Request For Quote (RFQ) to the responsible contractor whose Quote, conforming to the solicitation, is determined to be the Lowest Price Technically
Acceptable. The proposal will be rated using a Technically Acceptable/Unacceptable Rating method as defined in Table A-1 below. The evaluation will be on an "All" or "Nothing" basis. This means the proposal must be rated Technically Acceptable on each of the Technical Subfactors in order to be rated as Technically Acceptable overall for Factor 1. The following factors shall be used to evaluate the Quote:
Table A-1. Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable : Quote clearly meets the minimum requirements of the solicitation.
Unacceptable: Quote does not clearly meet the minimum requirements of the solicitation
Volume II: Technical (with Subfactors)
Factor 1. Technical Capability.
Subfactors 1-3 will be rated using the Technically Acceptable/Unacceptable evaluation method using the definition of each rating in the Technical Rating Table below:
Table: Technically Acceptable/Unacceptable Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Subfactor 1: Registration with the National Blood Exchange Program (NBEP)
All offerors shall provide current proof of registration with the National Blood Exchange Program.
Not providing current proof of registration will render the offeror "Technically Unacceptable" and the offeror will be removed from furthur consideration for award.
Subfactor 2: Accreditation
All offerors shall provide current proof of accreditation with the 1) College of American Pathologists
(CAP), 2) the American Association of Blood Banks (AABB) Standards, 3) the Blood Bank Regulatory requirements, the FDA and the National Blood Exchange (NBE) standards. Offerors must have current accreditation for all agencies in order to be rated Techncially Acceptable.
Not providing current proof of accreditation with each of the above listed agencies will render the offeror
"Technically Unacceptable" and the offeror will be removed from furthur consideration for award.
Subfactor 3: Statement of Objectives
All offerors shall explain, in detail, how they intend to meet the Statement of Objectives, specifically, how they intend to furnish blood and blood products within an hour (1) of request, how they intend to provide blood and blood derivatives 24 hour a day/7 days a week, how they intend to provide courier services, and how they intend to provide antibody identification and special typing for blood products.
The Govenment will evaluate this subfactor using their independent judgement as to whether the offeror fully understands the requirement and whether the or not the offeror can reasonably meet the minimum requirements of the solicitation.
Subfactor 3 shall be addressed in sufficient written detail for the Government to determine if the offeror understands this aspect of the Government’s requirement. Statements that the offeror understands, can or will comply with all specifications, or statements paraphrasing the specifications of parts thereof, or phrases such as “standard procedures will be used” or “well known techniques will be used” will be considered unacceptable. Insufficient explanations may result in your offer receiving an UNACCEPTABLE rating.
Volume III: Price
Factor 2. Price
A unit price and extended amount (i.e., quantity multiplied by unit price) shall be submitted for each contract line item number (CLIN). As a minimum, the SF 1449 Schedule of Supplies shall be submitted with proposed unit prices and extended dollar amounts. A Total line should be inserted at the end of each performance period with a grand total at the end for the full contract value of all periods or performance. Prices must be determined fair & reasonable.
(a) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(b). Protests received at a level higher than the Contracting Officer will be referred to the Contracting Officer.
Protestor may request a review by the contracting officer or an independent review at a level higher than the
Contracting Officer. Requests for appeals or independent review will be addressed to the Contracting Officer for referral to the review authority. Questions on this process will be referred to the cognizant Contracting Officer identified in the solicitation.
(c). The non-FAR Part 12 discretionary FAR, DFARS, AFARS, and LOCAL provisions included herein are incorporated into this solicitation either by reference or in full text. If incorporated by reference, see provision
52.252-1 herein for locations where full text can be found.
