52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

See Addendum to FAR 52.12-2

Award will be made using the tradeoff source selection process.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

52.212-2 ADDENDUM

Award will be made using the Tradeoff source selection process. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. Award will be made to the responsible offeror whose proposal conforms to the solicitation and is deemed best value to the Government. Award maybe made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.

(a) The Government will award a purchase order resulting from this solicitation to the responsible quoter whose quote conforms to the solicitation and is the most advantageous to the Government, price and other factors considered. The following evaluation factors shall be used to evaluate quotes:

1. Technical Factor-Compensation Plans: Compensation plans are a technical factor with three (3) subfactors and shall be submitted for each line item reflected in this solicitation. Each plan shall reflect compensation for the base period and each option period. A sample compensation plan worksheet is included at Attachment 2, 3 and 4.

Subfactors- There are three subfactors( listed below) that will be evaluated to ensure that the proposed compensation is sufficient to attract and retain quality HCPs. These subfactors will be rated as either "acceptable" or "not acceptable."

Subfactor A- Direct Compensation for Employees Subfactor B- Beeper/On-Call Hours Subfactor C- Call back Hours

Each sub factor MUST BE RATED AS “ACCEPTABLE” IN ORDER FOR THE TECHNICAL FACTOR

TO BE RATED AS "ACCEPTABLE."

Acceptable Rating - Based on Regional Health Contracting Office - Central’s market research, the proposed compensation is sufficient to attract and retain quality HCPs.

Unacceptable Rating – Based on Regional Health Contracting Office - Central’s market research, the proposed compensation to the HCP is not sufficient to attract and retain quality HCPs.

2. Past Performance: Provide two references (i.e., name, title, telephone phone number, and project title/description) who can verify that YOUR company provided recent and relevant services either as the Prime Contractor or Sub- Contractor. "Relevant" is defined as "for the same or similar services". "Recent" is defined as "within the past three years". If your Company does not have relevant past performance as a Prime Contractor or a Sub-Contractor, the Contracting Officer intends to rate your past performance as "Unknown", even if you submit a sub-contractor with relevant past performance. Past Performance must be with MEDCOM, other US Government departments or agencies, state and local governments and/or private sector clients. You may also submit Past Performance for work performed by YOUR company as a subcontractor. Past Performance references may be contacted. Narratives are required on questionnaires for ratings other than satisfactory. If the narratives do not support the rating or if there is no narrative for a rating other than satisfactory, the questionnaire rating will be changed to satisfactory. Offerors are reminded the government may elect to consider any additional past performance information that is available and obtained from other sources, to include the Past Performance Information Retrieval System (“PPIRS”).

The Government may also consider any additional past performance information that is available. Quoters are reminded that, while the Government may elect to consider data obtained from other sources, the burden of providing thorough and complete performance information rests with the quoter. In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available, the quoter will not be evaluated either favorably or unfavorably on past performance and will be assessed an Unknown rating.

Performance Confidence Assessments Rating Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

Unknown Confidence (Neutral) No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

Sources: AFARS – Appendix AA – Army Source Selection Manual dated 21 Dec 2012.

Compensation Plans (Employees, Beeper/On-Call Hours, and Call-Back Hours) and Past Performance are of equal importance and are more important than price when combined. However, price could become the determining factor, if the quotes are determined to be essentially equal. The trade-off between compensation plan and past performance could result in awarding to other than low quoter.

3. Price: Price will be evaluated using various price analysis techniques and procedures IAW FAR 15.404-1(b) including, but not limited to, comparison of proposed price received in response to the solicitation with a comparison to the Independent Government Estimate (IGE). Pricing must be found to be fair and reasonable.

(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Given that FAR 52.217-8 provides that the Government may exercise the Option to Extend Services at the rates specified in the contract (i.e., the rates in effect when the Extension of Services option is exercised), for purposes of evaluating the Option to Extend Services, the Contracting Officer will consider the prices submitted for the base year and each option year, since those are the binding prices should the Option to Extend be exercised.

(d) The award decision will be based on the best value offered to the Government and not solely on price and price related factors. In making the award decision, the Contracting Officer will consider the evaluated rating of all factors. Ratings of “less than adequate” or “not acceptable” will not be eligible for award.
