ADDENDUM TO 52.212-2

Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. Award maybe made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.

NOTE: The Government may award up to three (3) purchase orders from this solicitation, if doing so is in the best interests of the Government. The quantities listed in the solicitation are the expected maximum number of porcine models and deliveries over the course of the performance period. If more than one (1) purchase order is issued, the quantities on the individual purchase orders will equal the quantities on the solicitation. However, the quantities may not be divided equally amongst the purchase orders, if doing so is also in the best interests of the Government.

Paragraph (a) is hereby replaced with the following:

(a) The following factors shall be used to evaluate offers:

Factor 1. Technical Capability.

Factor 2. Price.

Factor 1, Technical Capability. The following ratings utilized in evaluating Factor 1:

a. Acceptable - Proposal clearly meets the minimum requirements of the solicitation.

b. Unacceptable - Proposal does not clearly meet the minimum requirements of the solicitation, for at least one of the following reasons:

i. Fails to clearly and comprehensively address how it will meet the requirements of the Statement of

Objectives, paragraphs 4 (Porcine Specifications) and 5 (Vendor Specifications).

ii. Fails to provide sufficient detail for the Government to determine whether the proposal meets the minimum requirements of the Performance Work Statement and this solicitation in addressing the factors and sub factors.

iii. Fails to clearly demonstrate that the offeror fully understands and is technically capable of performing the requirements at its total proposed price.

Factor 2, Price. The Government will evaluate price quotes to determine that it is fair and reasonable, once the quote has received an Acceptable rating on Factor 1. Failure to establish a fair and reasonable price will render the quote

UNAWARDABLE.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
