TECHNICAL REQUIREMENTS:
Technical Proposal, Past Performance, and Pricing: Evaluation Factors are located in FAR 52.212-2 and will be used to evaluate offers based on the written information submitted and shall address the following:
Factor 1. Technical acceptability: Technical package shall include a signed written statement stating all, not partial, items required can be supplied by them in accordance with FAR clause 52.212-2(a). If providing “or equal” items, comply with FAR clause 52.211-6, Brand Name or Equal. Explain how your company will meet the salient characteristics of the items, including kit components, as specified in Attachment 2. Prospective offerors shall provide specification sheets demonstrating product capabilities. The provided information will be evaluated and determined as either “acceptable” or “unacceptable”.
Factor 2. Past Performance: Past performance will be evaluated using PPIRS, FAPIIS or other means, available to the government. Offerors with no relevant past or present performance history shall be treated neither favorably nor unfavorably. Relevant past performance is within the last 3 years.
c. Paragraph 52.212-1(c), Period for Acceptance of Offers. Replace with the following:
Government Minimum Acceptance Period. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless the Government specifies another time period in an addendum to the solicitation. The Government will not consider offers providing less than 90 calendar days for Government acceptance.
d. Paragraph 52.212-1(m), Filing of Agency Protest. Add the following: Protests received at a level higher than the contracting officer will be referred to the contracting officer. Protestor may request a review by the contracting officer or an independent review at a level higher than the contracting officer. Requests for appeals or independent review will be addressed to the contracting officer for referral to the review authority. Questions on this process will be referred to the cognizant contracting officer identified in the solicitation.
e. Paragraph 52.212-1(n), The non-FAR Part 12 discretionary FAR, DFARS, AFARS, and MEDCOM provisions included herein are incorporated into this solicitation either by reference or in full text. The full text of FAR provisions or clauses may be accessed electronically at http://farsite.hill.af.mil.
(End of Addendum to 52.212-1)
2. The provision at FAR 52.212-2, Evaluation -- Commercial Items (Oct 2014), applies to this acquisition and the following addenda is provided. Addendum to 52.212-2.
Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest price of quotes meeting or exceeding the acceptability standards for non-cost factors. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.
Paragraph (a) is hereby replaced with the following:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Only those offerors who can supply all, not partial, items required will be eligible for award. If providing an “or equal” item, offeror shall comply with FAR provision 52.211-6 and provide specific product information demonstrating that the products quoted will meet the salient characteristics provided. Past performance will be evaluated using PPIRS, FAPIIS or other means. Offerors with no relevant past or present performance history shall be treated neither favorable nor unfavorable. Award will then be made on the basis of the lowest evaluated price of quotes meeting or exceeding the technical acceptability standards (acceptable rating for products meeting salient characteristics).
(b) Not applicable.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Addendum to 52.212-2)
3. The clause at FAR 52.212-4, Contract Terms and Conditions–Commercial Items (May 2015), applies to this acquisition and addenda to the clause is as follows: Addendum to paragraph 52.212-4(c): UNILATERAL MODIFICATIONS. The Government may make unilateral modifications considered administrative in nature. These include, but are not limited to, changes in the accounting and appropriation data, payment and issuing office addresses, and other corrections that have no effect on the terms and conditions of the agreement.
