(End of provision)

HCAA Local Clause 5005 (LPTA)

ADDENDUM TO 52.212-2

Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.

(a). The Government will award a Purchase Order resulting from this solicitation, to the responsible Request For

Quote (RFQ) conforming to the solicitation, that is lowest price technically acceptable (LPTA). Award will be on an all or none basis. The following evaluation factors shall be used to evaluate offers: Technical Acceptability, Past

Performance, and Price.

EVALUATION PROCESS:

Award will be made using the lowest-price, technically-acceptable source selection process. The Government will initially list proposals from lowest to highest price. The Government will evaluate the lowest priced proposal first.

If that proposal is determined technically unacceptable, the Government will evaluate the next lowest priced proposal and continue in that manner until a proposal is rated Technically Acceptable. If a proposal is rated

Technically Unacceptable, the Government will not evaluate any other factor. USING THIS PROCEDURE, THE

GOVERNMENT MIGHT NOT EVALUATE ALL PROPOSALS.

The following evaluation factors shall be used to evaluate offers:

1. Technical Acceptability: Offer will be found technically acceptable if the offer meets the salient characteristics and all of the factors listed below.

In order to meet and maintain the high quality standards of Carl R. Darnall, a list of the necessary elements of compliance have been compiled. The requirements for patient specific prescriptions such as those compounded by local pharmacies do not meet specifications required for bulk compounds. Below are the various qualities that will meet the rigorous compounding requirements for those bulk sterile products unavailable by commercial means.

If an item furnished does not meet the requirement the item will be returned at the vendor's expense for a full refund.

a. The Contractor shall deliver orders to CRDAMC within four (4) business days (Monday through

Friday not including Federal Holidays) from receiving the order.

b. The Contractor shall have at a minimum one (1) year experience in Compound Pharmaceutical manufacturing.

f. The Contractor shall be in compliant with Compounding Quality Act Title I of the Drug Quality and

Security Act of 2013.

g. The Contractor shall be in compliant with Current Good Manufacturing Practices (CGMP) (section

501(a)(2)(B).

h. The Contractor shall Label with adequate directions for use (CGMP) requirements under (section

502(f)(1) and make any modification to the packing and labeling of product if CRDAMC requests due to patient safety concerns.

i. The contractor shall comply with all the requirements for facilities that compound drugs (cGMPs requirement under section 503B).

i. The Contractor shall have Food and Drug Administration (FDA) approval prior to marketing

(CGMP) (section 505).

j. The Contractor shall provide QI/QA certification on every batch regardless of size.

k. The contractor must comply with all DEA Licensing requirements for the manufacturing and distribution of controlled substance to the facility.

l. Documented proof for item #1 listed below must accompany the RFQ, in order to be considered for award; additionally the vendor must be in compliance with items #2 and #3 below:

1. Certification/Accreditations: FDA or Pharmacy Compounding Accreditation Board

(PCAB) certification. The company will have an active certification which will be maintained annually to ensure the products are conducted with strict adherence to quality standards and principles of professional compounding.

2. USP Chapter <797>: The pharmacy must be compliant with ongoing changes and keeping up to date with requirements imposed by USP Chapter <797>. Products made are performed under the guidance set forth by this organization.

3. Quality Control: A system of quality checks which include environmental monitoring, raw material testing, in-process testing, endotoxin testing, product sterility and fungal testing as well as potency and stability testing of finished preparations. Technical Acceptability: Each factor must be found technically acceptable in order to be eligible for award.

Acceptable: Documentation provided clearly meets the minimum requirements of the solicitation.

Unacceptable: Documentation provided does not meet the minimum requirements of the solicitation

Any technical factor rated technically unacceptable makes the offeror ineligible for award.

2. Past Performance: The Government may consider any past performance information that is available to the Government, FDA, from its own files, databases such as the Past Performance Information Retrieval System

(PPIRS), or from any other source it deems appropriate.

This information will be used to determine the degree of confidence the Government has in the ability of the offeror to perform the requirement of this procurement.

This factor will be rated as either “acceptable” or “unacceptable”.

Table A-2. Past Performance Evaluation Ratings

Rating Description

Acceptable Based on the offeror’s performance record, the

Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable Based on the offeror’s performance record, the

Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

3. Price: Price will be evaluated using various price analysis techniques and procedures IAW FAR

15.404-1(b) including, but not limited to, comparison of proposed price received in response to the solicitation with a comparison to the Independent Government Estimate (IGE). Evaluation of price will include a determination that the price is fair and reasonable.

(b). Options. The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a proposal is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c). Given that FAR 52.217-8 provides that the Government may exercise the Option to Extend Services at the rates specified in the contract (i.e., the rates in effect when the Extension of Services option is exercised), for purposes of evaluating the Option to Extend Services, the Contracting Officer will consider the prices submitted for the base year and each option year, since those are the binding prices should the Option to Extend be exercised.

(d). Quotes must be submitted NLT the offer due date/local time CST by e-mailing or faxing to:

timothy.t.hoerz.civ@mail.mil, or faxing to (254) 553-3906 Attn: Tim Hoerz. No telephonic questions will be accepted, only through email. A signed SF form 1449 with completed pricing data must be submitted. E-mail is the preferred method.

(e). Evaluation Process: All offers will be evaluated IAW FAR 15.305 first: Award will be made using the lowest-price, technically-acceptable source selection process. The Government will initially list proposals from lowest to highest price. If a proposal is rated Technically Unacceptable, the Government will not evaluate any other factor.

USING THIS PROCEDURE, THE GOVERNMENT MIGHT NOT EVALUATE ALL PROPOSALS. Proposals receiving a rating of “less than adequate” or “not acceptable” will not be eligible for award.

(f). A written notice of award or acceptance of an offer, will be furnished via e-mail to the successful offeror within the time for acceptance specified in the offer and shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(end of provision)

(d) In the event the Contractor becomes either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation during contract performance, the Contractor shall give written notice to the Contracting

Officer within five business days from the date of the inversion event.

(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days; before the contract expires provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the

Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 39 months.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)

In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.

(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(3) For long-term contracts--

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.

(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The

Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.

(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the

Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in

SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
