52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
See Addendum 52.212-2
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision) mailto:anthony.d.browner.civ@mail.mil
HCAA Local Clause 5005 (LPTA)
ADDENDUM TO 52.212-2
Award will be made using the lowest price technically acceptable (LPTA) offer. Award will be made to the responsible offeror on the basis of the lowest evaluated priced quote that is found to be technically acceptable.
Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarifications). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the
Contracting Officer to be necessary.
(a). The Government will award a Purchase Order resulting from this solicitation, to the responsible quote recieved in response to the Request For Quote (RFQ) that is the “Lowest Price Technically Acceptable” (LPTA) offer. Award will be on an all or none basis, the Awardee has to provide pricing for all tests identified on attachment "A" in order to be deemed Technically Acceptable. Note: Please provide a total of all priced items from attachment "A" and insert that total on the informational CLIN of the solicitation.
The following evaluation factors shall be used to evaluate offers:
Technically Acceptability:
Technical acceptability: Explain your firm’s capability, to provide all tests indentified on attachment "A" and include any processes currently in place, that will ensure the specifications identified in the attached Performance
Work Statement (PWS) are met. The elements of the plan will be evaluated to ensure that the proposed plan is sufficient to meet the time line to pick up with in one (1) hour of notification and return results back to the laboratory within two (2) hours. This factor will be rated as either “acceptable” or “unacceptable.
Acceptable Rating - Based on Regional Health Contracting Office – Central will evaluate each quote and found to be sufficient by providing pricing for all tests indentified on attachment "A" and provide a sufficient plan to meet all requirements of the PWS.
Unacceptable Rating – Based on Regional Health Contracting Office – Central evaluation of the quote and it did not provide pricing for all tests identified on attachment "A" and the plan is not sufficient to meet all requirements of the PWS.
Price:
Price will be evaluated using various price analysis techniques and procedures IAW FAR 15.404-1(b) including, but not limited to, comparison of proposed price received in response to the RFQ. Evaluation of price will include a determination that the price is fair and reasonable. Note: Please provide a total of all priced items from attachment
"A" and insert that total on the informational CLIN of the solicitation.
(b) Options. The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) Given that FAR 52.217-8 provides that the Government may exercise the Option to Extend Services at the rates specified in the contract (i.e., the rates in effect when the Extension of Services option is exercised), for purposes of evaluating the Option to Extend Services, the Contracting Officer will consider the prices submitted for the base year and each option year, since those are the binding prices should the Option to Extend be exercised.
(d) The award decision will be based on the Lowest Price Technically Acceptable offered to the Government. In making the award decision, the Contracting Officer will consider the evaluated rating of all factors. Quoters receiving a rating of “unacceptable” in Technically Acceptability will not be eligible for award.
Pricing for Requirements. The offeror shall submit proposed pricing for all Contract Line Item Numbers (CLINs) identified in the Request for Quote, unless otherwise noted. Include the unit price and the total extended price for each CLIN. Quotes must be submitted NLT 11 May 2016 @ 1000am (CST) by e-mailing to:
anthony.d.browner.civ@mail.mil or faxing to (254) 553-3906 Attn: Anthony. No telephonic questions or quotes will be accepted.
Past Performance:
The Government reserves the right to review all previous & current contracting actions (if applicable) between the
Contractor & the Government to measure their ability to perform requirements of this nature. Various means of retrieving past performance to determine a Contractor’s ability to perform requirements of this nature include, but are not limited to the Past Performance Information Retrieval System (PPIRS) and the Federal Awardee
Performance and Integrity Information System (FAPIIS).
