USTRANSCOM JUSTIFICATION FOR

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED. The requirement is for the contractor to provide all resources and equipment necessary to perform trucking services for the movement of containers and/or breakbulk cargo to/from the port of San

Justification and Approval authorizes the execution of modifications to extend service to
31 March 2013 under authority of FAR clause 52.217-8, Option to Extend Services.
3. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS.
a. The Military Surface Deployment and Distribution Command’s (SDDC) mission is to provide surface transportation to meet national security objectives in peacetime and wartime.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

Acquisition Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION IS AVAILABLE
FROM ONLY ONE SOURCE.
a. This modification and contract extension is required to continue inland motor carrier trucking services within Puerto Rico provided by Garcia Trucking and Hector Transporte
Services.
b. If a modification is not executed to extend the current contract a break in service would occur resulting in unacceptable delays and an increased risk of sustaining loss of perishable goods.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERORS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE.
None
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.
A determination of fair and reasonableness will be conducted prior to the execution of the modification.
8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASONS A MARKET RESEARCH WAS
NOT CONDUCTED. It is the Government’s intention to incorporate these requirements into the Regional Domestic Contract (RDC). Therefore, market research was not conducted as the
Government does not anticipate issuing follow-on PRMC contracts.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION. None.
10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION. The following RDC carriers providing intermodal ocean liner services to/from Puerto Rico have responded favorably to incorporating the PRMC requirements into their contracts via modification:
Crimson Shipping Company, Inc (HTC711-11-D-R010)
Crowley Puerto Rico Services, Inc (HTC711-11-D-R011)

11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE
OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.
USTRANSCOM is currently accomplishing the procurement action to incorporate the PRMC requirements into the RDC program. The six month extension will allow continuation of services until the procurement action can be accomplished.
