24. The contractor must be able to independently obtain all of the mandatory replacement parts necessary to Overhaul the Hydraulic

Valve, as identified in the DMWR. A contractor's failure to deliver in accordance with the schedule of any order due to an inability to obtain mandatory replacement parts will result in the Government terminating the contract for default.

25. Army Contract Writing System (ACWS) Transition Information for Bidders

The Army Contracting Enterprise (ACE) is in the process of deploying new solicitation and contract writing software to Army contracting offices worldwide. Known as the Army Contract Writing System (ACWS), this modern software suite will soon replace most existing Army contract writing systems, including the system used to create and release this Solicitation.

b. During this transition period, Bidders are hereby advised:

The Contracting Office may use any combination of contract writing systems to create and release documents related to this solicitation

(e.g. solicitation amendments and awards, if any). Due to this:

This solicitation may contain different offer submission instructions than other solicitations released by the same Contracting Office

(e.g. requiring offer submission via the PIEE Solicitation Module vs. e-mail). Bidders should review all offer submission instructions contained in the solicitation documents and direct any questions or concerns to the Contract Specialist or Contracting Officer.

ii. If the Contracting Office switches contract writing systems prior to award, documents you receive from the Contracting Officer or view on SAM.gov or other forums may appear noticeably different than the initial solicitation or previous solicitations or awards from the same Contracting Office. This is normal and expected.

iii. A change between contract writing systems may cause important information concerning solicitation response (amendments) or accepted terms (awards) to take on different formatting or appear in different parts of later documents issued. Offerors shall review all documents carefully to locate this important information and direct any questions or concerns to the Contract Specialist or Contracting

Officer.

2. The Government does not intend to use the transition between contract writing systems to effect any changes to solicitation or award terms and conditions without accompanying document narratives explicitly stating such changes are deliberate and desired. While the

Contract Specialist and Contracting Officer will take care to minimize or eliminate any inadvertent changes when adapting to the new contract writing software, you, as the Bidder, may still be the first to spot such errors. Therefore, Bidders shall:

Notify the Contracting Officer immediately if any observed changes, removals, or additions affect your award eligibility, violate or alter existing quote/proposal terms, or could affect Contract performance post-award.

ii. Take special care to ensure all fill-in Clauses are populated and remain populated across documents received from the Contracting

Office throughout the Solicitation and Award process.

iii. Contact the Contracting Officer listed on the first page of the solicitation or solicitation amendment for guidance if you notice or suspect any inadvertent change has occurred between document issuances.

3. The Contracting Officer will correct problems affecting award documents (if any) via bilateral modification, at no cost to the

Contractor. Any such modification will reconcile the award with the latest version of this solicitation reflecting deliberate action by the Contracting Officer (e.g. the first issuance if no amendments, or the latest amendment with accompanying narratives), inclusive of any documented pre-award negotiations or accepted supplemental offer terms.

4. In the unlikely event a network disruption, contract writing system error, or financial system error threatens timely award of the requirement set forth in this solicitation, the Contracting Officer:

May elect to use alternative mechanisms to obligate funds and allow work or deliveries to legally begin to the benefit of, and with legal protection for, both parties.

ii. Will incorporate the latest version of this Solicitation into such mechanisms to serve as a framework for contract execution until any such system problems are resolved.

iii. Will ensure any action taken does not conflict with the stated offer evaluation and award methodology of this requirement.

iv. Will issue a complete, properly-formatted award accurately reflecting this requirement and all applicable terms and conditions once systems return to normal.

(a) The contractor shall comply with the higher-level quality standard(s) listed below.

ISO 9001:2000 or equivalent with prior approval from the Procurement Contracting officer.

(b) The contractor shall include applicable requirements of the higher-level quality standard(s) listed in paragraph (a) of this clause and the requirement to flow down such standards, as applicable, to lower-tier subcontracts in--

(1) Any subcontract for critical and complex items (see 46.203(b) and (c)); or

(2) When the technical requirements of a subcontract require--

(i) Control of such things as design, work operations, in-process control, testing and inspection; or

(ii) Attention to such factors as organization, planning, work instructions, documentation control, and advanced metrology.

(End of clause)

6. PRODUCT VERIFICATION AUDIT (PVA) CONTRACT REQUIREMENTS

Purpose: This PVA requirement establishes/assigns responsibilities for insertion of PVA procedures into overhaul work directives, maintenance data packages, and contract documents along with procedures and instructions to be applied in performing PVAs during overhaul, maintenance, modification kit installation, rework, remanufacture, manufacturing, and new procurement contracts. The PVA candidate(s) are used to evaluate that the contractor's processes and procedures are adequate to ensure component integrity.

(A) The Contractor shall perform and present for acceptance THREE units as specified in the resultant contract. This clause does not supersede instructions contained in depot overhaul work requirements, commercial overhaul manuals, new manufacture technical requirements or other applicable documents. It does not relieve the contractor from maintaining a quality system that will assure items conform to contractual requirements. Contractors may request to delay scheduled PVAs in frequency or waive PVA requirements of selected items in cases where accumulated objective evidence indicates that a consistent quality item is being delivered. PVA actions will be based on the overall performance history, failure impact, supply impact, length of program, and nonscheduled PVAs accomplished by the

Systems Readiness Directorate (SRD). Like or similar items may be grouped for these purposes provided concurrence is obtained from SRD

Quality Management Division. The contractor may be directed by the Procuring Contracting Officer (PCO) to increase or decrease the scope of a PVA pursuant to the "Changes" clause of the contract for non-commercial items. If however, this procurement is for a commercial item, the contractor and the Contracting Officer (CO) will need to enter into a bilateral contract modification to increase or decrease the scope of a PVA.

(B) The Contractor shall,

(1) With the concurrence of SRD Quality Management Division (QMD), schedule and perform PVA as required by the terms of the contract or as otherwise required.

(2) Notify PCO with information copy to the SRD QMD, ATTN, "usarmy.redstone.devcom-avmc.mbx.qs-contracts@army.mil" of the date the

PVA candidates will be available. Notification shall be provided at least 20 working days prior to the selected date if facilities are within the Continental United States. If facilities are outside the Continental United States, notification shall be provided at least

95 working days prior to the selected date to allow sufficient time for travelers to gain theater clearance.

(3) Provide technical personnel tooling, measuring and test equipment, work area, forms, and clerical assistance, as required, to perform the PVA. If test cell or other specialized equipment is required; notification of readiness for PVA shall include the availability of these.

(C) The PVA candidate will be selected by the SRD PVA Team Chairman at random from the three (3) tendered candidates for acceptance to the Government. For reoccurring audits, if any, the audit candidate will be selected by the PVA Team Chairman from all completed items currently available.

(1) Alternate Procedure. Normally, three assets are required to be completed at time of PVA. If in the PVA Team Chairman's judgment it is in the best interest of the Government, an alternative approach may be taken due to circumstances such as shortage of overhaul assets, shortage of replacement parts, time constraints, or other considerations. At the PVA Team Chairman's discretion, only one PVA candidate may be required to be completed while the other two assets can be in various stages of overhaul as agreed upon (prior to the beginning of the PVA) between the PVA Team Chairman and the facility to be audited. For instance, one asset could be disassembled and ready for Overhaul Inspection Procedures, while the other may be prepared for a critical process such as acceptance testing. (This approach is particularly helpful if the critical process is performed by a subcontractor.) For reoccurring audits, if any, the audit candidate will be selected by the PVA Team Chairman from all completed items currently available.

19 81

Name of Offeror or Contractor:

PIIN/SIIN MOD/AMD

(D) The item selected for PVA will be inspected for adherence to preservation, packaging, and marking requirements prior to removal from the shipping container. A visual inspection and functional test will be performed prior to disassembly.

(E) The PVA Team will review the shop travelers, production processes, procedures, tooling, and equipment used to maintain, overhaul, repair, or manufacture the item being audited for adequacy and conformance to the contractual requirements.
