ACE Vendor Q's

RFP Reference (File; Paragraph #; Page #)Vendor Questions/CommentsUSG Response
We (VENDOR NAME) did have one more question that may be too premature to address today, but due to alot of descriptions, “new language” and some R&D that’s shown in the TDP, could we formally request an extension past the current 01 December 2023?This contract is build to print, there is no research and development required if the vendor has the necessary manufacturing capability to build to the technical data package furnished by the Government.
Will the Government include the Proposal submission date on the SF 33 of the Solicitation and to Section L under submission instructions? The proposal submission date has been added to SF33.
Will the Government provide the Q&A period for the solicitation?12/1/2023 is last day for Q&A. If Government shutdown occurs, date may be extended if questions arise between shutdown date and bid completion cycle.
Will the Government provide the following referenced documents: GL-PD-18-20 and GL-PD-07-12?GL-PD-18-20 is for the holster. GL-PD-07-12 is the purchase description for Type I - 65/25/10 FR Rayon/Para-Aramid/Nylon Ripstop, Type II - 43/30/27 Meta-Aramid/Nylon/Cotton Twill, Type III - FR Cloth, Ripstop, or Type IV - FR Cloth, Twill. If the vendor wishes to bid an alternate material to Brookwood, the Government will not fund the qualification of the alternate material since that is not under the scope of the SOW. Any bid using an alternate material to the Brookwood laminated fabric on drawing 1081521 will be considered high risk given the amount of qualification testing performed to the vest as a system which would have to be repeated.
Please confirm the current revision for GL-PD-10-07.Latest revision I can find is 26 October 2009.

Is there a document available for the products required by the contract that includes images? This would greatly assist in gaining a clearer understanding of the precise specifications and requirements.11/14/23 - The assembly drawings depict images (not photographs) of all products being built in their final configurations. We have provided a presentation of the ACE along with a separate photo of the 72 Hours Survival items.
Looking into the ACE Product Description PD1006011, there are two training power point presentations noted (see below). Are you able to provide these for us?See response above
See response above
Page 26, Footnote 3See response above
When conducting the integration of items onto the vest utilize the procedures as defined in the ACE Training-Main.pptx and ACE 72 HSE-Complete.pptxSee response above
Can the Government please provide a drawing for PN 1050956-1?Drawing was added to technical drawing files for download.
1.Section L-2, Paragraph D states “The offeror shall provide at least one example of recent and relevant experience for each aspect of the production requirement. Recent experience is within the last five years.”
a.Will the Government elaborate on what “each aspect of production” refers to? As currently drafted it seems ambiguous and could be construed in various ways and result in different interpretations among offerors?
b.Are there key areas of the production process the Government wants the past performance to focus on? If so, what are those areas?
c.Are there key items the Government wants the past performance to focus on? If so, what are those specific products?
d.Does it refer to each subparagraph listed in Section C, Paragraph 3.0 or Paragraph 4.0 or Paragraph 5.0 or Paragraph 6.0 or Paragraph 7.0 or Paragraph 8.0 or all of these areas?
i.If all of these areas, it seems like the past performance examples may be overly burdensome on offerors since there would be over 30 different areas that need to be covered by examples.
e.What information is required to be provided for each example?a. Aspects of production in paragraph L-2D refer to specifics listed in paragraph L2A.

b. Key areas of past performance should focus on successful delivery of a textile product of equivalent complexity described above to a customer, preferably a combat vest, police tactical vest, or equivalent. Describe what was built and whether the product was delivered on time. Emphasis should focus on in-house manufacturing capability, not the ability to contract the manufacturing out to other vendors.

c. Key items of past performance should emphasize manufacturing of comparable textile product in-house and meeting quality/cost/schedule objectives for past performance contract.

d. For past experience in the last five years, one contract example of a comparable textile product is sufficient. Rating criteria are specific to section L with evaluation factors listed in section M.

e. For past performance, a reference to or copy of the contract used as proof, and a receiving report demonstrating delivery of product under that contract was accepted by the customer would be acceptable demonstration of past performance. If the item delivered is not a vest, an explanation of why the product should be considered of equivalent complexity as a substitute example should accompany the past performance example.

As we are working on a bid for the above solicitation and noticed a possible error in the Materials List.

AR/PD 13-02, TY I, Tan 499 Ballistic Material System

It may be that the above should be GL/PD 13-02.Find number -73 of drawing 1050955 lists this material, but there is no reference to where it is actually used on any of the drawings shown in the reference tables on sheets 4 or 5 of that same drawing. Where do you see the material actually used on a drawing used to build the ACE?

We were recently notified by <VENDOR> of patents/IP that they claim to hold in the Government drawings of and/or items included in the Air Combat Equipment (ACE) Kit. We respectfully request an extension of 2 weeks to investigate those claims. It is the responsbility of the vendor to verify patent infingrement and pay a license fee if required as part of pricing.
As we are working on a bid for the above solicitation and noticed a possible error in the Materials List.

Note 3) Solucote 1013 is no longer available. The company was bought out and now it is #1103.

Also, 1050955-16

Note 9) Our Major Webbing Manufacturers do not Offer the PTFE Finish. With respect to Solucote 1013, if the new manufacturer does not make it any longer, a substitute may be proposed after contract award via an engineering change proposal (ECP) to any suitable alternative material. If DSM NeoSol (what shows up as the manufacturer at https://pitchbook.com/profiles/company/11751-40#investors) is representing that as a viable substitute, just include the data sheet for it demonstrated it is the same by comparison to the original material and we will accept. Your bid should reflect the material selected for proposal as alternative. With respect to PTFE finish on the polyester cord, built to PIA-C-2754, TY I, an alternative finish is acceptable so long as it repels moisture. Your bid may reflect the alternative and assume a request for deviation will be required to approve the alternative cord if a manufacturer with the called out finish cannot be found.
1081570 Manufactured by Armacell

They do not make the Part in the 1/8" Thickness as on the Specification Sheet.

They only make it as small as 1/4" Thickness.1081570 drawing will be updated to call out XPUMA08550 as the correct vendor part number
Looking over the solicitation I could not find where it specified how to submit.

Please verify electronic submitted proposals are expectable by the 1700 Local time on Friday 01 Dec, 2023.

I’d also like to reiterate the request for extension as we are still awaiting pricing data from vendors who tell me they are still working through issues with the program office.Vendors can submit proposals directly via email to CS and KO or if file is large, send the proposal through the DOD safesite link: https://safe.apps.mil/ See above regarding extension.
What is the correct quantity of buckles that need to be quoted from Austrialpin? From looking at the build drawings, I see the part being quoted is covered by drawing 1005833. These are used on the leg strap assembly, drawing 1081479. Each leg strap assembly (one per vest) uses the following parts:

2 1005833-41 MALE BUCKLE HALF, (BLACK)

2 1005833-37 MALE BUCKLE HALF, (COYOTE)

4 1005833-35 FEMALE BUCKLE HALF, (COYOTE)

There are two more harnesses on the vest with buckles covered by drawings 1081562 and 1081563, both used by installation drawing 1081482 for the front harness strap assembly.

Drawing 1081562 uses two buckles:

2 1005833-37 MALE BUCKLE HALF, (COYOTE)

Drawing 1081563 uses one buckle for each side, left and right, so even though the drawing shows one per side, there are two per vest, so I’ll depict two below:

2 1005833-35 FEMALE BUCKLE HALF, (COYOTE)

And last, there is a back harness strap assembly drawing 1081486:

1 1005833-39 FEMALE BUCKLE HALF, (BLACK)

1 1005833-37 MALE BUCKLE HALF, (COYOTE)

When you look at the ACE price input workbook, we are asking for pricing in quantity ranges of 1-1000, 1001-2000, 2001-3000, 3001-4000, 4001-5000, and 5001-6000 per year.

Each vest would use one set of the above parts, essentially, seven buckle pairs not all matching in color. Your quotes to all vendors should reflect the above quantity pricing sets per year for five years out for those specific parts.

**documents for review are attached in email to PMI saw your solicitation on SAM.gov for the W58RGZ-24-R-0050, and wanted to see if you might have a few minutes to review and discuss a potential “easy button” option from a contracting perspective using the AbilityOne program for future opportunities? I have attached a description of one contract vehicle that may be an option in the future, but have a couple of others if you or your other contracting officers have time to review? The Government will not pursue or investigate alternate contract methods amid an active bidding cycle. Any such investigation will delay existing contract award cycle and endangers procurement of material for Army needs with no guarantee of any alternate process delivering product sooner or at a lower cost. We will not pursue alternative means to obtain what is required until the current planned contracting cycle is complete. At the end of this contract award in 5 years, we may entertain new contract options.
Please confirm that Solicitation CLINs 1001 - 1006 ("ACE VEST/HARNESS ASSEMBLY", part numbers 1081467-1-<SIZE>) include the following items:

ACE VEST/HARNESS Assembly (1081468-N-<SIZE>);

POUCH KIT (1081469-N-1);

EXTRACTION CARABINER (1081535-1);

EXTRACTION STRAP (1006032-N-1).

The Purchase Decription PD1006011 describes an ACE Assembly as including these components, but the PD does not list the part number 1081467.The ACE purchase description is strictly for the vest. The drawing we are buying to (1081467) includes components covered by a separate purchase description (the pouches). Looking at drawing 1081467, first column N-1 to cite your example, would include quantity one of ACE VEST/HARNESS Assembly (1081468-N-1); quantity one of POUCH KIT (1081469-N-1); quantity one of EXTRACTION CARABINER (1081535-1); and quantity one of EXTRACTION STRAP (1006032-N-1). There is no reason that the top level part number needs to be covered by a single Purchase Description.
There are several references to the term "Hardware" in the solicitation document. These include:

1) a reference to "Adjusted range pricing shall be retroactively applied to all hardware quantities ordered within any 30 day period." (page 3, section A-5)

2) Hardware Updates / ECPs (p95 s3.9)

3) "The contractor shall include a schedule that demonstrates how the contractor shall meet the requirements of the contract and complete deliverables to include hardware and data." (p95 s4.1.1 and s4.1.2)

4) "Equipment, including special inspection equipment (SIE) and special test equipment (STE), shall be validated prior to use for delivery of hardware." (p96 s5.3)

5) "b. Hardware evaluation." (p96 s5.5 "Pilot Line Validation Report")

6) "The contractor shall successfully complete FAI/FAT prior to submitting hardware for Government acceptance." (p97 s5.6)

7) "The contractor shall maintain historical records for the technical data for hardware items, reflecting all change and non-conformance actions." (p98 s6.2)

8) "The contractor shall package for preservation, handling and shipping all hardware items IAW ASTM D3951, Standard Practice for Commercial Packaging." (p98 s7.1)

9) "The Government will provide the serial number start point during start of work or at delivery order award. The serial number for each designated piece of hardware shall be assigned in increasing numerical sequence." (p98 s7.3.2)

10) "All hardware that has been accepted by the government shall be shipped from the contractor's facility…" (p98 s 7.5)

11) "In the CLIN narrative the offeror shall fill in the blanks under Unit Price column with Firm Fixed Pricing for all price ranges for all hardware CLINS." (p119, sL-3 D)

Will the Governement provide clarification as to whether the term Hardware is intended to cover all supplied finished goods, including nylon vests, pouches, and the like? The term "hardware" applies to any CLIN delivering a physcial product to the Government as opposed to data. These are specifically identified in paragraphs and sub-paragraphs 3.1 through 3.8 of the statement of work.
Considering that this solicitation is intended to result in the award of a Firm Fixed Price Supply Contract, can the Government please advise which CLIN(s), if any, are “for services” in regards to FAR 52.211-11 cited in section A-8?
Further, can the Government please advise what the liquidated damages amount per calendar day of delay would be for any resulting contract?Services would only apply for the Transportation (CLIN 1056) and engineering change proposal (CLIN 1055). The ECP change would be negotiated as a contract modification. All other services under this contract (pilot line validation, first article testing, quality assurance, etc.) should not be separately priced. FAR 52.211-11 will be removed from RFP.
Will Conformance Inspection and Test be required for each Production Lot?First Article Test (FAT) will be required for the first production lot of every unique hardware CLIN ordered. For subsequent orders, so long as the production line has not been shut down for a year or more, FAT will not be required. First Article Inspection (FAI) will be required for all orders through the life of the contract. FAT should be built into the pricing of the first orders for each CLIN in the first year of the contract. If the Government does not make an order of a CLIN in a calendar year and chooses to order that CLIN which was not in production in a following calendar year, the Goverment may waive FAT or negotiate a one time cost of repeating FAT for that CLIN.
**Clarification**Additional Clarification to the questions above in Cell B26Yes. In accordance with Product Description (PD) 1006011 paragraph 4.1.2. Conformance Inspection (CI), the USG requires CI for each production lot prior to acceptance. Paragraph 4.1.2.3 of the PD defines a “production Lot” as all the units within a single shipment for a contract delivery. A Production Lot equals the number of units shipped/delivered each month for the purposes of this RFP. Offerors should determine the sample size for testing by using the requirements specified in paragraph 4.1.2.2 of the PD. Offerors should account for test asset costs needed to fulfill CI requirements when submitting their proposal.
Follow On to B27a.“Whether the Government will require Conformance Inspection and Test (as referenced in PD1006011, section 3.1.2, and elsewhere) for each production lot, as part of the formal inspection and acceptance process for supplied items under a contract awarded through this solicitation.” b.“Should the offeror interpret the Government’s answer to indicate that the FAT and Spares CLIN will NOT be part of the price evaluation? If the FAT and Spares CLIN are to be part of the evaluation, which estimated quantities will be used in the evaluation?”a. Yes. In accordance with PD1006011, section 4.1.2 the Government will require conformance inspection and test for every production lot. b. No. The offeror should include FAT and spares as part of their pricing in accordance with Section A3 of the solicitation.
Section 4.1.2.3 of all four Purchase Descriptions defines a Production Lot as “all the units within a single shipment for a contract delivery order plus the units required for performance testing that are made under the same conditions and made from the same materials and components.”

Can the Government please clarify whether “units required for performance testing” would be considered as part of the delivery order quantity (and therefore the quantity that would be shipped would be less than the quantity ordered”)?

Or does the contractor need to produce extra units for performance testing? For all orders that require FAT, the delivery quantity should be separate from articles that cannot be repaired after a test. As example, the pouch verification matrix in PD 1006012, Table IV, there are no destructive tests at all. However, for the ACE Vest harness built per PD 1006011, Table III calls out static and dynamic load testing which can both be destructive. Load and tensile strength testing called out in Table V of PD1006008 should likewise be considered destructive. In short, the answer is you should build separate extra units for all destructive tests.
Are Performance tests (as specified in the various applicable Purchase Descriptions) required to be conducted by certified laboratory?
If yes, is the contractor responsible for the cost of such testing?Yes for any tests requiring laboratory equipment not available in house that have calibration requirements. The contractor may request a waiver for in-house testing deemed to be exempt from external certification requirements. The contractor is responsible for all costs of FAT.
Section 4.1.2 of all four Purchase Descriptions includes the following statement: “The Government's acceptance of the contractor's end item product will be determined by the requirements validation. Responsibility for requirements validation shall be as specified in the contract.”

Can the Government please clarify whether “requirements validation” is synonymous with “validate conformance to the requirements” as used in paragraph 5.3 of Section C of the solicitation?

If those phrases are not synonymous, can the government please clarify what is meant by “requirements validation” and who would have responsibility for such? Those paragraphs are synonomous. The purchase descriptions define the quality requirements, the contract paragraph 5.3 of Section C enables the validation and enforcement of the purchase description quality requirements.
PD1006011 includes multiple references to “Table III” but there is no table in the document labeled as “Table III.”
Is “Table II – Verification Cross Reference Matrix” on page 26 intended to be “Table III”?On page 26, Table II should be titled Table III, this is a typographical error.
Will the Government provide a FAI/T schedule that aligns with the entire ACE System to include the LPU-42 ?
The current structure has individual FAI/T due at 90 days, 180 days, 270 days, 365 days and 535 days.Lead times for individual CLINs may differ. There is no reason to align FAT schedules between CLINs that may have different lead times. All instances of FAT/I in the RFP delineate the FAT/I time requirement associated for that CLIN only.
Based on the posted FAI/T Schedule, will the first Ordering Period be in FY 2025?Intent is to award the contract with the first delivery order in FY 2024.
Can the Government provide clarity on the which quantities may be purchased on the forecasted Ordering Period? As there is a discrepancy between Section A-3 BEQ & M-2 Section (i): Section M-2 Production Rates per Ordering Period (Ordering Period is equivalent to 12 months)

ACE Vest / Harness Assembly PN 1081467-1-X: Qty 4,000 over all sizes (BEQ total is 3,200) ACE LPU Assembly (LPU-42/P) PN 1081668-1-1: Qty 3,200 (BEQ is 2,400) Aviation Holster Assembly PN 2-4-1027-X, Type III, Class 4: Qty 4,000 over all sizes (BEQ is 3,100) Mouthpiece Cover PN 1081549-1-1: Qty 3,200 (BEQ is 2,400) Bottle Pouch PN 1081761-1-1: Qty 3,200 (BEQ is 2,400) EAWIS Basic Pouch PN 1081760-1-1: Qty 2,000 (BEQ is 1,600) Extension Tether PN 1081572-1-X: Qty 1,900 over all sizes (BEQ is 1,400)

Personal Restraint Tether W/ Swivel PN 1050903-1-X: Qty 1,750 over all sizes (BEQ is 1,400)The BEQ does not have to match the total allowed quantities targeted for bidding under the contract. Orders for FMS and other DOD customers have been put into our BEQ, but cannot be forecast with precision. This is why the ordering period maximums exceed the BEQ quantities.
The solictitation (Section M) refers to part of the the evaluation process as "U.S. Government will determine each proposals total evaluated price as calculated using estimated quantities."
Can the Government confirm "estimated quantities" in this case is the same as the "BEQ" described in section A-3? or the Production Rates in Section M-2?The USG will evaluate pricing based on the quantities listed in section A-3 of the solicitation under Best Estimated Quantity (BEQ). The USG will evaluate the offeror’s Production Capability based on the quantities identified under section M-2 of the solicitation.

I have a question about Part 1050955-114 on the above Solicitation. (Style is unknown)

The Materials and Components Sheet 1050955 shows:

1050955-114 MIL-L-11075, TY III, Oval Loop, Welded, 1-3/4 x ½, Coyote Tan

The Cummerbund Assembly 1081471 shows:

1050955-114, Ring, Oval, Steel, Welded, 1-3/4 x ½ (Steel is Type III)

The PD1006011 shows:

MIL-L-11075, Loop, Oval, Brass, (1050955 ref. -114) (Brass is Type I)

Please advise of the correct Type, Style and Color for 1050955-114 on this Solicitation.

My Vendors and I are confused on what part to quote. 1050955-114, Ring, Oval, Steel, Welded, 1-3/4 x ½ (Steel is Type III) Answer is correct, the part is steel, PD is incorrect. 4-4-24 - PD has been updated to correct the part number.

To complete Volume 3 (Responsibility Matters) I need to sign the first page of the RFP and all amendments. Can you please forward those to me?

The only version of the RFP available on sam.gov is dated 11/8 (and shows the close date of 12/1/23) and the other amendments are not currently posted on sam.gov.All amendments to the RFP are in SAM.gov.
In reviewing the Price Model and Section B we have some additional questions that materially affect our response.
1.Does the government have an estimate of how much of the contract sales will be USG v. FMS? This will help industry better estimate costs associated with freight that differ between the two.
2.It is our understanding that acceptance for USG sales will be FOB Destination, meaning offerors are responsible for the cost of shipping to the final destination and that cost should be included in their price to the government. Please confirm.
3.It is our understanding that acceptance for FMS sales will be FOB Origin, meaning the government would cover the cost of shipping to the final destination. Please confirm.
4.Considering the responses to the above, why was CLIN 1056 “FOB Destination Transportation Costs (Total Estimated Cost $171,151)” is included as a fixed cost for all offerors?
a.Should offerors not be including transportation costs as part of their price to the government?
b.Is this fixed transportation CLIN included to help offerors since the USG v FMS sales is unknown?1. This RFP is for USG sales only in determining your freight costs. Paragraph A-10 of the Request for Proposal states, "A-10. The Ship-to addresses and delivery schedules will be provided in the individual delivery orders. Transportation Accounting Code (TAC) will be provided upon placement of order. The TAC will pay for all FMS freight costs, if applicable.

2. That is correct.

3. That is correct.

4. Amount was entered as an "estimated cost" based on current market values.

4A) The transportation cost estimates were provided with the intent for all vendors to use the same shipping costs so transportation is not a factor in evaluating price. Offerors should use the pricing estimates so these costs are not factored into the bid pricing comparison.

4B) The estimated costs are provided for bidding purposes only. The vendor will identify shipping costs when destination addresses are provided by the Government at the time an order is made.

We have another item to discuss.

The Magnetic Closure (1081493) used on the ACE Assembly is made in China. This is not a Berry Compliant Part as I understand.

The Suggested Source is Amazing Magnets and their Part# is on the Material Specification Sheet.

Please advise if this Part can be used or if there is another Specification for this Magnet Closure.1081493 has been removed from the technical data package. The design drawing 1081489, Right and Left Pocket Assembly, has been updated to incorporate a snap for closure instead of the magnets.
*pic to the far right*I have one additional administrative question related to the proposal. We are required to fill in pricing on section B of the solicitation document; my question is regarding the UNIT PRICE and AMOUNT Columns to the far right starting on page 5.

Is the offeror required to fill this section in? We are populating the “Ordering Period (#)” prices for each quantity break on the left side of the document, but it is not clear which of these values would go into UNIT PRICE and AMOUNT. Below is a picture with the field I am asking about, highlighted.

Is this field for the Price Evaluation team’s use? If we are to fill it out, can you provide guidance as to which value needs used?Vendors are to only fill in in the range pricing listed in Section B for each CLIN. Values are not required to bein input under Unit price and amount highlighted in screenshot provided by vendor (picture to the right).
If we are only able to furnish certain items, should we proceed with submitting our proposal or will the contract be granted to a vendor capable of supplying all the required items??Vendors interested in submitting a proposal to the requirement are to meet all the needs and requirements of the propsoal in full; no partial proposals will be accepted.
The Limitations on Subcontracting (FAR 52.219-14, Deviation 2021-O0008) is included in solicitation W58RGZ-24-R-0050 (starting on page 104). Within this clause is the following language: (f) The Contractor shall comply with the limitations on subcontracting as follows:

(1) For contracts, in accordance with paragraphs (c)(1), (2), (3) and (6) of this clause-- [ ] By the end of the base term of the contract and then by the end of each subsequent option period;

or [ ] By the end of the performance period for each order issued under the contract.

(2) For orders, in accordance with paragraphs (c)(4) and (5) of this clause, by the end of the performance period for the order.

Will the Government advise whether compliance will be checked by the end of the base term, or by the end of performance for each order?Compliance will be checked by perfomance for each order.
Will the Government advise as to the process and methodology for verifying compliance with 52.219-14? What documentation, if any, will be required to certify compliance? The contracting officer can require the Contractor to demonstrate its compliance with the limitation on subcontracting ( LOS )at any time during performance and upon completion of the contract if the info regarding compliance is not already available to the KO. Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
Other small business set aside solicitations have included FAR 52.215-6, Place of Performance, which reads: a) The offeror or respondent, in the performance of any contract resulting from this solicitation, intends [ ], does not

intend [ ] [check applicable block] to use one or more plants or facilities located at a different address from the address of the offeror or respondent as indicated in this proposal or response to request for information.

(b) If the offeror or respondent checks “intends” in paragraph (a) of this provision, it shall insert in the following spaces the required information:

Place of Performance (Street Address, City, State, Zip Code:

Name and Address of Owner and Operator of the Plant or Facility if Other Than Offeror or Respondent:

Would the Government consider the addition of this clause to the solicitation to help define the offeror’s plan for compliance with 52.219-14?FAR 52.215-6 has been inserted to the solicitation.
The solicitation includes FAR 52.219-6 (Notice of Small Business Set-Aside), and 52.219-14 (Limitations on Subcontracting. The language in 52.219-14, under section (e) (2) begins with “Supplies (other than procurement from a non-manufacturer of such supplies) …”There is no further language on the requirements for non-manufacturers at that section. However, the provisions 13 CFR 121.406(a) and/or FAR 19.505(c) apply to the evaluation of offers from non-manufacturers which provisions are summarized below. Please confirm that the agency will enforce the non-manufacturer requirements with regard to any offer received from a non-manufacturer. 13 CFR 121.406(a) sets forth the standard to be eligible to compete under a small business set aside for goods. The entity must be small under the applicable NAICS code and must either (1) be the manufacturer of the end products being solicited or (2) comply with the non-manufacturer rule.
FAR 19.505(c) is explicit that a non-manufacturer is; "Any concern, including a supplier, that is awarded a contract or order subject to the non-manufacturer rule, ..., but proposes to furnish an end item that it did not itself manufacture, process or produce..." For any such entity, it will be deemed to be a non-manufacturer and it must provide an end item that a small business has manufactured, processed or produced in the United StatesThe Government will enforce the non-manufacturer requirements with regard to any offeror received from a non-manufacturer.
In Section M – Evaluation Factors for Award, under M-1 (2) (a), the following is written: a) Worksheets. The evaluation worksheets in Appendix B- Technical and Appendix C Price shall be used to record all associated evaluation results. […]
Can the Government provide these blank worksheets to industry prior to the closing date for this solicitation? No. Evaluation of contract technical factors and pricing is a Government function. The evaluation factors are clearly defined.
On page 121, under M-3 Price Factor, the instructions read:

“Evaluated Pricing: The Evaluated Pricing (EP) will be calculated by the Price Team using Government estimated quantities and the offerors proposed pricing. The Total Estimated Price will sum the ACE CLINs, FAI/T CLINs, and Component Parts CLINs pricing as calculated by the Price Team.”

Our question is on the process for evaluating prices on sized items, for example CLIN 1001 – 1005 (ACE Vest/Harness Assembly). The Best Estimated Quantities on page 2 of the solicitation show the following for CLIN 1001 – 1005:

CLINNomenclaturePart NumberBEQ
1001ACE Vest/Harness Assembly, XS1081467-1-1160
1002ACE Vest/Harness Assembly, S1081467-1-2600
1003ACE Vest/Harness Assembly, M1081467-1-31,460
1004ACE Vest/Harness Assembly, L1081467-1-4780
1005ACE Vest/Harness Assembly, XL1081467-1-5200

The solicitation also directs, on page 3, that "Offerors must propose one singular unit price for ALL sizes of the ACE Vest/Harness Assemblies. The unit price may vary by quantity but not by size."

If we take the BEQ listed above and incorporate them into the pricing worksheet, they will align with the following quantity break tiers:

CLIN 1001: 1 - 1,000 Quanty Break Tier CLIN 1002: 1 - 1,000 Tier CLIN 1003: 1,001 - 2,000 Tier CLIN 1004: 1 - 1,000 Tier CLIN 1005: 1 - 1,000 Tier

However, if the BEQs for each size are added together, it totals 3,200 units, which would correspond to the 3,001 – 4,000 “tier”.

Our question is whether the Government's evaluation will use 'tiered' pricing for each CLIN (i.e. would add the respective tier pricing for each) or will the Government sum the best estimated quantities for these sized items and evaluate the price level based on that totaled tier (i.e. for the example above evaluate based on the 3,200-unit tier).

Each item will be evaluated by the range price associated with the BEQ quantities and summed. The pricing will NOT be associated with the 3,001 - 4,000 "tier" because they are separate CLINs.
For CLINS 1017, 1018, and 1019 (Armor Side Pouch…(Spares)) should the proposed price be for 1 pouch or a set of 2 pouches? The Vest/Harness Assembly has 2 pouches in the 'kit'.
1 pouch per CLIN.
Is there an SBA waiver in place allowing the sale of any large OEM products? The SBA may waive the nonmanufacturer rule if it determines that there are no small business manufacturers that can reasonably be expected to offer a product meeting the solicitation specs (i.e. an individual waiver), or when SBA determines that no small business manufacture of the product or class of products is available to participate in the federal procurement market (i.e. a class waiver).

Under a waiver, a firm can supply the product of any size business without regard to the place of manufacture. This waiver is based on NAICS code We are having a difficult time locating the above parts.

The MIL Spec. is:

A-A-55126, CL 1, OCP Loop in 3/4" and 1-1/2" widths.

This material does not appear to be available in OCP from any Vendors. Since it appears that this is not very visible, would it not be more feasible to go with the Tan 499 that is more readily available and used many places on the ACE System? The two materials are called out on drawing 1050955. The first is 1050955-110, part number A-A-55126, CL 1 FASTENER TAPE, LOOP 1 1/2 WIDE, color OCP which is in turn used on drawing 1081510, find number 11. On this drawing, 1081491 calls out multiple find numbers for 1050955-50, which is TAN 499. The webbing on that same drawing, part number 1050955-89, is also TAN 499. Find number 32, fastener tape hook, part number 1050955-23 is also TAN 499. Find number 23, part number 1050955-22, fastener tape loop, is also TAN 499. The only fastener tape loop part number I see which is OCP is the 1050955-110.

The second is drawing 1050955-111, part number A-A-55126, CL 1 FASTENER TAPE, LOOP, 3/ 4 WIDE, color OCP, used on drawing 1081491, find number 11. On this drawing, I'm seeing no other fastener tape that is OCP either. As example, 1081491 calls out multiple find numbers for 1050955-50, which is TAN 499. The webbing on that same drawing, part number 1050955-89, is also TAN 499. The elastic cord is black.

Given the other webbing used on the same part is TAN 499, we would be willing to approve an RFV after contract award for the TAN 499 alternative color just for these two parts given the negligible impact on spectral signature this amount of material would have on the vest.

We have additional questions related to the pricing, specifically the relationship section A-4 and section L-3 C.

A-4 reads: “Suggested Range quantities are provided; however, the contractor may propose alternate quantities if more economical pricing is possible.”

L-3.C provides the requirements that the offeror include “the solicitations size, schedule pages, fully filled in at each of the range prices and at each of the line item levels. In the CLIN narrative the offeror shall fill in the blanks under Unit Price column with Firm Fixed Pricing for all price ranges for all hardware CLINS. In addition to Section B, the offeror shall complete Section J Attachment Price Input Workbook W58RGZ-23-R-0068_09 Feb 2023 Tab: ACE Prices”.

Can the Government please advise how and where an offeror might offer alternative pricing per Section A-4?

Will the Government please confirm that such alternative pricing will NOT be used for evaluation purposes, but rather -as per L-3.C- evaluated prices will be based on the BEQ and quantity ranges provided in the solicitation? The vendor may add additional break points to the pricing spreadsheet as a function of quantity such that additional ranges are established. Price will be evaluated as a function of the BEQ quantities, but may be at a break point within a smaller range if it is advantageos to the contractor to do so. If additional break points are added, pricing must be consistent for all vest sizes in any new ranges offered.
I saw a clarification on the Type of 1050955-114 Welded Loop but not clarification on the Style. (Dimensions)1)For the Dash No. -114 on DWG 1050955C the NOTES column will change FROM: 1-3/4 x ½ ; TO: 1-1/2 x ¼; We will delete the MIL-L designation as it appears to be an error.
2)Albest carries and sells this part despite not listing on website. We will add a suggested source of supply to the component drawing (Albest Metal Stamping Corp, One Kent Ave, Brooklyn, NY 11249). POC YakovF@albest.com
3)Albest Part number wv24x4-12, Coyote Tan Colored (FYI the 24 and 4 are 16ths of inch for opening LxW, 12 is the steel gage size).
The current solicitation cites FAR 52.219-6 Notice of Total Small Business Set-Aside for NAICS code 315990. Per the Small Business Administration and FAR 10.502-2 Total Small Business Set-Asides, a contract may be classified as a Small Business Total Set-Aside if at least two qualified small businesses are likely to submit offers and the contract can be awarded at fair market price. A Sources Sout/Request For Information (W58RGZ-22-RFI-PMAW-ACE) was released in early 2022. Per DARS Part 10 Market Research, this SSN/RFI addresses whether or not the acquisition can or cannot be a Small Business Set-Aside and is considered market research. Given the Draft and Final Solicitations came out citing Total Small Business Set-Aside, there is assumed confirmation that there were at least two qualified small businesses who responded.

Per FAR 19.505 Limitations on Subcontracting and Nonmanufacturer Rule, an exception may only be made “once the contracting officer determines through market research that no known small business manufacturers, processors, or producers in the United States or its outlying areas can reasonably be expected to offer an end item meeting the requirements of the solicitation”.

Can the Government please confirm this opportunity is considered a Total Small Business Set-Aside with NO exceptions for any type of waiver given the validation methods in accordance with all FAR and DARS regulations? This is a Total Small Business Set-Aside and no exceptions will be taken.
Has the Government requested an individual waiver for any bidder per FAR 19.505 for this specific opportunity? See reference below.

Reference: FAR 19.505 Limitations on Subcontracting and Nonmanufacturer Rule

(B) Individual waiver. The contracting officer may also request a waiver of the requirements at paragraph (c)(1)(i) or (c)(2)(ii) of this section for an individual acquisition once the contracting officer determines through market research that no known small business manufacturers, processors, or producers in the United States or its outlying areas can reasonably be expected to offer an end item meeting the requirements of the solicitation. This type of waiver is known as an individual waiver and would apply only to a specific acquisition. No waiver will be requested
I am helping <VENDOR NAME, REDACTED> in <LOCATION, REDACTED> submit proposals on some upcoming Army solicitations. I am new to this. If we want to submit by the deadline, how far along does our bid have to be. I would really appreciate your help so I can understand the nuances of this process.Proposal stipulations are outlined in the solicitation and attachments linked to the solicitation in SAM.gov
