About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition under FAR Part 6 to award a four-year Indefinite Delivery/Indefinite Quantity (IDIQ), Firm-Fixed-Price contract for procurement of Gateway Mission Router (GMR) variants to Raytheon Company.
The requirement is for GMR-1000 and GMR-2000 variants that provide secure wireless data capabilities to air and ground platforms. The total estimated contract value is $48,576,000, with an initial obligation of $942,518. The J&A cites 10 U.S.C. 3204(c)(1) as the authority for other than full and open competition, as Raytheon is the original designer and sole manufacturer of the qualified GMR solution. The Government conducted market research but determined Raytheon is the only source capable of providing the requirement in a timely and affordable manner. The anticipated award is at the end of Fiscal Year 2023, with a 48-month period of performance.

JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION – FAR Part 6
1. Contracting Agency: Department of the Army Contracting Command-Redstone (ACC-RSA), CCAM-CAC-B, Redstone Arsenal, Alabama 35898-5280.
2. Description of Action: The Product Manager, Air Warrior (PdM AW) requests approval to award a new four-year (48-Month) Indefinite Delivery/Indefinite Quantity (IDIQ), Firm-Fixed-Price (FFP) contract on an other than full and open competition basis, to Raytheon Company, 6125 E. 21st Street, Indianapolis, Indiana, 46219-2058, CAGE Code: 072E5. This anticipated contract is estimated at a total value of $48,576,000.00 with initial obligations minimally estimated at $942,518.00. will provide the capability to award additional tasks during the remaining Ordering Periods available on the contract. PdM AW will utilize Firm-Fixed-Price (FFP) Contract Line-Item Numbers (CLINs), for each individual task or delivery order issued under the IDIQ contract. The Government projects award for end of Fiscal Year 2023. The PdM AW will use Aircraft Procurement Army (APA) and Other Procurement Army (OPA) funding for this requirement. The anticipated period of performance for this action is date of Award 2023 for 48-Months through 2027.
3. Description of Services and Supplies: This requirement is for the procurement of Gateway Mission Router (GMR) variants consisting of the GMR-1000 and GMR-2000.
The GMR-1000 variant has potential use in air and ground platforms. The GMR-2000 variant has potential use in ground platforms only. Both variants provide a secure wireless data capability to end users. The primary role of the GMR is to enable the rapid integration of Commercial Off the Shelf (COTS) technologies to air/ground vehicles through high-speed Ethernet and/or secure Wi-Fi connections. The secondary role is to enable those COTS devices to receive real-time vehicle information, Command and Control (C2) information, a common tactical Situational Awareness (SA) picture, and commercial civil air traffic and weather that has been compiled and correlated by the GMR from its multiple datalink interfaces and ADS-B Receiver. The GMR securely integrates with tactical Line of Sight (LOS) and Beyond Line of Sight (BLOS) datalinks to allow user devices to digitally collaborate in ways that have never been possible within military aircraft and vehicles. 4. Authority Cited: The authority permitting other than full and open competition is 10 U.S.C. 3204(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(A), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Reason for Authority Cited: The proposed source for this planned contract action is Raytheon Company, 6125 E. 21st Street, Indianapolis, Indiana, 46219-2058, CAGE Code: 072E5. Raytheon is the original designer and prime manufacture of the fully qualified GMR. Due to Raytheon’s significant GMR experience, proprietary design rights, possession of necessary special tools and test equipment, and existing GMR production facilities, Raytheon is the only source capable of providing this requirement in a timely and affordable manner. No other existing solution fully satisfies this requirement, and would require additional development, testing, and qualification.
Raytheon Company owns the proprietary technical data for the GMR, and no other contractor has access to their proprietary data.
6. Efforts to Obtain Competition:
a. Effective Competition. The legacy GMR-500 was initially awarded through full and open competition to Raytheon under contract W58RGZ-08-C-0066 on 14 January 2008. A Sources Sought/Request for Information for this GMR-1000/2000 requirement was issued on 15 April 2022. Only the incumbent, Raytheon Company, responded to the RFI with a fully qualified solution that meets all requirements and is ready for immediate production. The GMR is a single Line Replaceable Unit (LRU) thus there is no opportunity to breakout components at this level. Component breakout has been accomplished at the higher systems level, to include the recent migration from the sole source Electronic Data Manager (EDM) to COTS tablets that were made possible as result of the Wi-Fi upgrades that are part of the current GMR-1000 and GMR-2000 configurations.
b. Subcontracting Competition. The contract will include applicable FAR provisions ensuring competition in subcontracting, including FAR 52.244-5, “Competition in Subcontracting,” FAR 52.219-8, “Utilization of Small Business Concerns,” and DFARS 252.219-7004, “Small Business Sub-Contracting Plan Test Program”.
7. Actions to Increase Competition: The Government continuously reviews engineering, software, and hardware requirements to identify potential candidates for breakout for any follow-on requirements. However, due to the critical interfaces and functional requirements associated with maintaining interoperability and compatibility with the systems that form the broader tactical network, as well as the military unique platform data environments, the Raytheon GMR and associated software is being adopted by the broader PEO Soldier organization as the common soldier interface for

all ground and aviation platform applications. The US Government does not own the data rights to the GMR hardware. The US Government requested Raytheon provide a rough order of magnitude for the sale of its intellectual property rights in the GMR.
Raytheon informed the US Government that Raytheon will not sell the GMR data rights, and that position has not changed. Unique knowledge of the interfaces between fielded systems and the lack of technical documentation owned by the government for currently fielded systems makes Raytheon the only source capable of satisfying the government’s immediate requirements under this contract.
8. Market Research: Air Warrior conducted market research in accordance with FAR
10.002. The Market Research Report/Commerciality Determination (MRR/CD) will be approved on 20 November 2022. In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance, and Information (PGI) 206.302-1(d), a request for information was posted to beta.sam.gov on 15 April 2022. Only the incumbent, Raytheon Company, responded to the RFI with a fully qualified solution that meets all requirements and is ready for immediate production. The Air Soldier System Lead Systems Engineer conducted market research during the past 12 months. The GMR 1000/2000 is not a commercial product. FAR Part 12 will not be used in this acquisition. The market research techniques used consisted of discussing the proprietary nature of the hardware and processes used in the producing the GMR with knowledgeable persons in Industry; personal knowledge; review of source lists for identical or similar items obtained from Government, professional, and/or industry sources; internet searches to review catalogs and/or generally available product literature; discussions with knowledgeable persons in Government who are familiar with the proprietary nature of Raytheon’s software and hardware. PdM AW’s currently fielded systems and software hosted on the GMR, are tailored specifically to meet the PdM AW requirement and are reliant on the integration and use of proprietary Raytheon source code. Raytheon has made significant investment in the GMR to provide a product suitable for the AW application, and without the detailed hardware and software technical documentation necessary to perform the required upgrade/maintenance activities, no one other than Raytheon can satisfy this requirement.
9. Interested Sources: The proposed source for this planned contract action is Raytheon Company. Raytheon is the original designer and prime manufacture of the fully qualified GMR. Due to Raytheon’s significant GMR experience, proprietary design rights, possession of necessary special tools and test equipment, and existing GMR production facilities, Raytheon is the only source capable of providing this requirement in a timely and affordable manner.
a. On 15 April 2022, ACC Redstone, at the request of the AW PM, issued a Sources
Sought/Request for Information (SS/RFI) for market research.

(a) AVI Pty Ltd, 6 Blaikie Street, Myaree, Western Australia, Australia 6154, dated 16 May 2022.
(b) ElbitAmerica, Inc., an Elbit Systems of America company, 4700 Marine Creek Parkway, Fort Worth, TX 76179
(c) Raytheon Company, 6125 East 21st Street, Indianapolis, IN 46219
(2) Two of the above respondents, AVI and ElbitAmerica, responded with solutions in the Technology Readiness Level (TRL) 4 or earlier stage. PM Air Warrior requires a vendor that can immediately deliver this capability with no additional time or R&D efforts. Raytheon Company responded with a fully qualified TRL 9 solution that meets all requirements and is ready for production.
b. The primary barrier to pursuing the qualification of an alternate source is the significant Army investment that has already been made in the current Raytheon GMR and the cost and schedule required to approve an alternate source. The total Army investment on the current and preceding Raytheon contracts alone totals approximately $107M and does not include the additional investments made in platform integration, aircraft modification kits, and platform installation cost. There are more than 1,200 air and ground vehicles currently operating with GMR units installed that would all be impacted by the qualification of an alternate solution. Another consideration with developing an alternate source is the time involved with the development and qualification of comparable software/functional capabilities, which would not support current aircraft modernization schedules. The effort to qualify a comparable capability with an alternate source would take at least 24 to 36 months at an estimated cost of approximately $7.5-10.5M. Activities would include build of hardware and software prototypes, development of aircraft modification/installation kits and completion of qualification testing. Once qualification testing is complete, the Systems Requirements Directorate (SRD) must review the test data and determine the viability of issuing an Airworthiness Release. During this timeframe the Government would be unable to support the migration from military unique hardware and software solutions previously implemented to the COTS tablets and devices operating common air/ground software solutions that are mandated under the Army’s Common Operating Environment (COE) initiative and are vital to addressing gaps in air ground operations communications that are essential to achieving the Army’s objectives pertaining to Multi-Domain Operations (MDO). Finally, there is the logistics cost of maintaining and sustaining the obsolescing GMR-500 that will be replaced by the GMR-1000 and upcoming variants. Current program funding levels and schedule needs simply do not support the development and qualification of an alternate source without being able to leverage the Army’s prior investments in the GMR program.
