Army Working Capital Funds, Reparable will be utilized. Foreign Military Sales (FMS) quantities are included and will utilize FMS funding, but this is not a source directed action.
3. Description of Supplies: ACC-RSA proposes to issue a contract on an other than full and open competitive basis for the overhaul/repair of the item listed below:
ITEM: PRID: FB738-2
SYSTEM: UH-60
NOMENCLATURE: CONTROL ELECTRICAL PANEL

The estimated base year dollar value of the proposed procurement is and the out-years (two-five) estimated value is The total estimated dollar value of the proposed procurement including FMS dollars is This calculation is based on utilizing the maintenance expenditure limit of each multiplied by the maximum quantity. This total includes 37 each FMS requirement. The FMS requirement is not source directed.

4. Authority Cited: The statutory authority permitting other than full and open competition is 10 United States Code (U.S.C.) 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2) which states, “When the supplies or services required by the agency are available from only one responsible source, or, for DOD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”
5. Reasons for Authority Cited: The proposed acquisition requires the use of the cited authority because there is only one source that can perform this overhaul effort.
The UH-60 Control Electrical Panel is not a critical safety item. Technical data to include a Depot Maintenance Work Requirement (DMWR) is not available for this overhaul effort, therefore, no other contractor can satisfy the government’s need. BVR Technologies (Previously known as Korry Electronics) stated on the previous PRID FB738-1 for the UH-60 Control Electrical Panel that they could not bid on the effort due to extensive government shipping, packaging, and documentation requirements that they do not currently have the ability to meet (see ICAPP Usage Screen remarks for previous PRID FB738-1 dated September 2014). Therefore, the Aviation Engineering Directorate (AED) has identified approved source: Sikorsky Aircraft Corporation (CAGE Code 78286) 6900 Main St. Stratford, CT, 06614-1378 as the only approved source for the current effort.
6. Efforts to Obtain Competition: This item was last published in the December 2015 AMCOM Competition Advocate’s Shopping List (CASL). A Sources Sought announcement was publicized in Federal Business Opportunities (FedBizOpps) on 19 February 2015, but no responses were received. Pursuant to FAR 5.201, the proposed acquisition will be synopsized in the Federal Business Opportunities (FedBizOpps) on or about 15 March 2016. As of 19 February 2016, there are no pending Source
Source Selection Information- See FAR 3.104
Approval Requests (SAR) per the Army Aviation Sustainment Gateway (ARISE) CSI database, Source Management module. Should another contractor become an approved source before contract award, their proposal, if submitted, will be considered.
Any additional sources identified through the synopsis procedure will receive due consideration as prescribed by law.
7. Action to Increase Competition:
There is no DMWR currently available to support a full open competitive solicitation, and there are no plans to have a DMWR written for the UH-60 Control Electrical Panel, based on the lack of government owned technical data rights. There are currently no ongoing actions to increase competition for this requirement. Efforts to have this item overhauled are limited to the identified source as the government does not own nor have rights to the data required for overhaul. The AED has evaluated the cost and time associated with processing a Source Approval Request (SAR) for this item and has estimated that it will take 105 man hours or engineering labor to qualify a new source.
The calendar time frame on developing another source could be up to a year. The cost to process a SAR could be up to $200,000. The only known source with the overhaul data necessary to perform this requirement is Sikorsky Aircraft Corporation (CAGE Code 78286). Should a new source(s) become qualified via the SAR process during the contract period of performance, the requirement for future orders will be reviewed. If a new requirement can be validated, a new contract package will be processed and the new source(s) will be given an opportunity to compete for the award.
8. Market Research: Meaningful market research was conducted by Robert Gdula, Logistics Management Specialist, in the last 12 months in accordance with FAR 10.002(b). Research methods included the following: personal knowledge in procuring supplies/services of this type; contacting knowledgeable persons in government during February 2016 , Logistics Management Specialist; publication of a sources-sought announcement in FedBizOpps on 19 February 2015; review of Government and/or commercial databases for relevant information: ICAPP (Requirements J&C and Technical J&C) – February 2016, LMP-February 2016, SAM - February 2016, and Fedlog- February 2016.. It has been determined after market research that the government needs cannot be satisfied by commercial items, commercial items with customary or reasonable modifications, or non-developmental items. Based upon the above, the basic clauses and provisions prescribed in FAR Part 12 are not sufficient for use in this acquisition and will not be utilized. The market research has identified the following source as the current source authorized to perform the overhaul: Sikorsky Aircraft Corporation (CAGE Code 78286).
9. Interested Source(s): All notices required by FAR 5.201(b)(1)(i) shall be published, and any proposals received shall be considered. To date, no other sources have expressed a written interest in this acquisition. Any potential sources will be encouraged to submit SAR packages. As of 29 May 2015, there are no pending SARs per the ARISE database. There is a reasonable basis to conclude at this time, that the agency’s minimum needs can only be satisfied by Sikorsky Aircraft Corporation (CAGE Code 78286) 6900 Main St. Stratford, CT, 06614-1378. The synopsis will be publicized
