Foreign Military Sales (FMS) quantities are included in support of the Memorandum of Understanding (MOU) among Security Assistance Management Directorate (SAMD), ALC, and ACC-R (approved 6 December 2004 by the Director, Maintenance and Special Projects Directorate for ACC-R). In accordance with the MOU, all M&O packages will include an FMS quantity equal to 20% over the Army’s maximum quantity for utilization by FMS customers if required. FMS funding will be used, but this is not a source directed action. Potential FMS customers include Egypt, Bahrain, Korea, Netherlands, Kuwait and Greece. At this time, FMS case numbers are unknown. The FMS quantity for this effort is 10 each.

The previous contract for input NSN 5855-01-614-8082, W58RGZ-16-D-0018, was awarded on 22 April 2016 and will expire on 30 March 2021. The previous contract was for the teardown, testing, and evaluation of the Turret Assembly, and will not cover the demands of the current requirement.

3. Description of Supplies and Services: The ALC has a requirement for contractor support to provide inspection and M&O on the following part to return the items as specified by the Statement of Work, to condition code A as defined by Army Regulation 725-50 Appendix C (Table C-38). The following information is provided for the Turret, Assembly:

Authority Cited: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by paragraph 6.302-1(a)(2) of the Federal Acquisition Regulation (FAR) entitled, “Only one responsible source, and no other supplies or services will satisfy agency requirements.”

Reason for Authority Cited: The proposed acquisition requires the use of the cited statutory authority because there is no technical data, to include a Depot Maintenance Work Requirement (DMWR), available for the Turret, Assembly requirement. The failure of the Turret Assembly to perform properly can impact the functionality of the helicopter and its ability to perform life-saving missions. Failure to award this requirement in a timely manner will impede the Government’s ability to provide serviceable assets to meet field requirements on a continuous and uninterrupted basis. Continued operation of the Black Hawk aircraft is essential to successful mission completion. There are no other sources approved, pending approval, or that have indicated interest in overhaul of the Turret Assembly for the UH-60. Awaiting another source will create an unacceptable delay in fulfilling Army requirements for production, maintenance, and spares for the UH-60 estimated at 18 months if there was an interested source, which there currently is not. The estimate is based on the time necessary for qualification of an additional source. Typically, requires 90 days to review a Source Approval Request (SAR) submittal, and vendors typically require 60 days to make the required revisions to their SAR submittal. Accordingly, each iteration of submittal and review typically takes 150 days; each SAR submittal, in turn, typically requires at least three iterations. There are variances based upon the responsiveness of the vendor and the number of offices that must review their submittal, which varies depending upon the nature of the item, but based upon past experience, believes that 18 months is an accurate estimate for the entire process. The only source approved by to overhaul the Turret Assembly is FLIR Systems, Inc., (CAGE Code 3UVR3), large business). FLIR Systems, Inc.’s SAR was approved on 27 February 2017. As of 25 October 2019, there are no pending/open SARs. There is no DMWR or technical data available at this time to make this a competitive requirement.

Any delays of the acquisition for the Turret Assembly will negatively impact the Government’s production line by potentially creating a shortage of Turret Assemblies, potentially causing the UH-60 fleet to fall below the Army readiness standards and be unable to perform required missions. FLIR Systems, Inc., is qualified to perform the required work, as they have passed the SAR process, and in doing so have gained the required approval from the head of the design control activity. FLIR Systems, Inc., possesses the technical expertise, required machinery, and personnel to perform the actions required by this acquisition.

At this time, no others have gained this approval; therefore, no other sources can be considered for award. Should a new source become qualified via the SAR process during the contract period of performance, the requirement for future orders will be
