About this file
Summary
This is a FAR Part 16 Justification Review Document for an Exception to Fair Opportunity authorizing a non-competitive follow-on task order. The Army Futures Command's C5ISR Center Research and Technology Integration Directorate at Aberdeen Proving Ground is awarding a $185.3 million, five-year (base plus four one-year options) Cost-Plus-Fixed-Fee task order to Data Services Analysts (DSA) Inc., a small business S-Corporation located in Fairfax, Virginia. The task order will be issued against the existing RS3 MATOC contract vehicle and will be incrementally funded using Research, Development, Test and Engineering (RDTE), Operations and Maintenance (O&M), and Procurement appropriations.
The eCAP (Enterprise Cloud Analytics and Processing) program provides research, development, assessment, testing, integration, prototyping, and sustainment of cloud modernization initiatives supporting Army Digital Transformation, the Defense Intelligence Enterprise, and Multi-Domain Operations capabilities. The sole-source award is justified under Title 10 U.S.C. §3204(a)(5) as implemented by FAR 6.302-5(a)(1) (Authorized or Required by Statute), specifically Section 874 of the FY 2022 National Defense Authorization Act authorizing awards to qualified employee-owned small businesses. DSA meets pilot program requirements including S-Corporation status with 100 percent employee stock ownership, a satisfactory CPARS rating on the predecessor task order, and certification to limit subcontracting to 50 percent of contract value. The justification cites schedule delays, quality control risks, and increased portfolio costs as consequences of competing the requirement to alternative vendors, with estimated one-year delays for vendor onboarding and transition activities. Market research was conducted via SAM.gov posting on August 14, 2025, with one offeror inquiry but no capability statement submitted. Approval was granted on February 23, 2026, by the Senior Procurement Executive.

FAR Part 16 Justification for an Exception to Fair Opportunity
1. Requiring Activity: Army Futures Command (AFC), Combat Capabilities Development Command (CCDC), Command, Control, Computers, Communications, Cyber, Intelligence Surveillance and Reconnaissance Center (C5ISR Center) Research and Technology Integration (RTI) Directorate located on the Aberdeen Proving Ground, Aberdeen Maryland.
2. Contracting Activity: Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Building 4401, Aberdeen Proving Ground, MD 21005.
3. Description of Action: The C5ISR RTI Directorate requests a follow-on $185.3 million non-competitive five-year (base and four one-year options) Cost-Plus-Fixed-Fee (CPFF) Completion and Cost-No Fee single award task order to Data Services Analysts (DSA) Inc., 10300 Eaton Place, Suite 500, Fairfax, VA 22030. The Task Order will be incrementally funded using appropriate Fiscal Year (FY) Research, Development Test and Engineering (RDTE), Operations and Maintenance (O&M) and Procurement funds.
4. Description of Supplies/Services: eCAP provides continued support for the Army’s Digital Transformation initiatives, which includes various Cloud Modernization efforts. These efforts range from upgrading of the legacy software systems, enhancement of the enduring capabilities, and the modernization efforts for future capabilities across the Army and Defense Intelligence Enterprise. Modernizing these efforts will enable rapid, data-driven application development and data-informed decisions to meet the soldiers’ speed of need.
The ACC intends to utilize a unique pilot program allowing for the non-competitive award of a follow-on effort to DSA — an S-Corporation and small business as identified in the Defense Federal Acquisition Regulation Supplement (DFARS) Part 270 and described in detail in sub-section six below. Although the language of the pilot program references contract awards only, on 18 September 2025, the ACC confirmed with Office of the Under Secretary of Defense for Acquisition and Sustainment (OUSD(A&S)) that issuing a task order against an existing MATOC contract vehicle (in this case RS3) was an acceptable use of the pilot program. It is anticipated that awarding to a different vendor would result in significant schedule delays, risks to deployed capabilities, impacts to quality control, and increased portfolio costs.
The RTI’s success criteria for the eCAP effort requires continued support to execute the following:
(a) rapidly increase key capabilities production and integration for the Headquarters, Department of the Army (HQDA) Military Intelligence (G-2) program.
(b) accelerate the Army Combat Capabilities Development Command (DEVCOM) C5ISR Centers implementation.
