Sole Source Justification and Approval
1. Contracting Activity: U.S. Army Contracting Command Aberdeen Proving Ground
6001 Combat Drive, Building 6001 Aberdeen Proving Ground, Maryland 21005
2. Description of Action: The Army’s Communications Electronics Command (CECOM)
Software Engineering Center (SEC) requests a new Firm-Fixed-Price (FFP) contract on a sole-source basis to Trimble Navigation Limited (Trimble) for Trimble Terramodel Construction Package Maintenance and GPS Analyst Maintenance in support of the Instrument Set, Reconnaissance and Surveying (ENFIRE) Program. The applicable North American Industry Classification System (NAICS) code is 511210, Software Publisher. This purchase order will consist of a one (1) year base period and three (3) one (1) year options. The Government projects an award date of June 2016 using Fiscal Year 2016 Operation and Maintenance, Army (OMA) funds for the base period.
Funds are currently available for this procurement.
An acquisition plan is not required because this procurement does not meet the threshold requirement of Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(d)(i)(B).
This action is a follow-on to contract number W56JSR-14-C-0010. That contract was conducted as a sole source negotiated acquisition under the authority 10
U.S.C. § 2304(c)(1) and FAR 13.501, Only One Responsible Source and No Other
Supplies or Services will Satisfy Agency Requirements.
3. Description of Supplies/Services: Trimble Terramodel Construction Package and
GPS Analyst provide a technical engineering toolset designed to generate, manage, analyze, and digitally distribute a wide variety of engineering data. The Terramodel and GPS analyst functionality is key to ENFIRE it allows the user to place edit objects on the map and allowing Global Positioning System (GPS) functionality to be used for more accurate measurements. Maintenance support is needed to get original equipment manufacturer updates and bug fixes for the system as well as obtain the licenses necessary to be allowed to operate the system. This product is being used by the SEC in support of the ENFIRE. ENFIRE is a digital toolset used by units at the Battalion, Company, Platoon, and Squad levels as a means to facilitate rapid collection, absorption, and dissemination of reconnaissance information by the units and up the chain of command. ENFIRE incorporates the ability to automatically populate field data on forms used for road and bridge reconnaissance, as well as minefield and Improvised Explosive Device (IED) reporting, with relevant information from peripheral devices included in the ENFIRE Set. In addition, the users and soldiers can use the tool to create an interactive 3D model with the help of Computer-Aided Drawing (CAD) functions. These capabilities allow soldiers to rapidly collect and disseminate accurate, current information, survey, engineering and CAD tasks that can be used almost immediately by the Commander in his decision-making process, as well. ENFIRE enables the “Every Soldier as a Sensor” (ES2) concept and interoperates with Distributed Common Ground System – Army (DCGS-A).

4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C.
1901(a)(2) as implemented by FAR 13.501(a)(1) and FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.
5. Reason for the Authority Cited: Trimble Navigation Limited, 5475 Kellenburger Road, Dayton, OH 45424-1013, (Cage Code3 MJN0) developed and owns the software code for the Trimble product line. The use and maintenance of this proprietary software in this acquisition is essential to the Government’s requirements, thereby precluding consideration of a product(s) developed by another company.
The Trimble software products are Commercial Off-the-Shelf (COTS) items, and the technical data for all the Trimble products is proprietary to Trimble. Trimble has no reseller/distributor able to meet the scope of the current requirement given the multiple locations of the software licenses receiving maintenance (refers to the systems in field which are with various different units). It is critical that the maintenance and support for the Trimble licenses be renewed. If the maintenance and support is not renewed, then
The functional requirements were determined by the systems’ stakeholders (e.g., soldiers) based on their defined mission requirements. The ENFIRE baseline standards were used in evaluation of all available products to ensure that the selected product meet all the requirements and or performed best against in meeting or exceeding the established Army requirements. These requirements and ENFIRE baseline standards review resulted in the selection of the Trimble products. Additionally, as referenced in the previous paragraph, the cost and time to re-engineer and file new ENFIRE baselines to replace the Trimble products with other potential products would be cost prohibitive and impact meeting the mission requirements in a timely manner.
6. Efforts to Obtain Competition: Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered.
a. Effective Competition: Members of the Software Engineering Center Centralized Acquisition and License Management (CALM) Team conducted market research – the details of which are outlined in paragraph 8.
b. Subcontracting Competition: The Government will seek to maximize subcontracting competition with a focus on subcontracting to small and small disadvantaged businesses. Trimble stated in their sole source letter that there are no reseller/distributor able to meet the scope of the current requirement given the multiple locations of the software licenses receiving maintenance.
7. Actions to Increase Competition: Commercial software manufacturers are encouraged to increase the number of authorized resellers. Additionally, upon receipt of the requirement an authorized list of authorized distributors for this software is immediately requested from the original manufacturer. The manufacturer is also encouraged to pursue distribution of their products/services through Small businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses.
Market research will be conducted annually on the current ENFIRE baseline to determine if changes occur in the market place that would enable greater competition.
8. Market Research: Market research was performed by the CALM Team during the months of November and December 2015. Searches were performed on the Army Computer Hardware Enterprise Software Solutions, the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), and General Services Administration (GSA) websites. A request was made to Trimble for a list of resellers as well as a general web search. Trimble provided a statement indicating that there are no authorized resellers capable of fulfilling this requirement. Trimble disclosed that its reseller/distributors are authorized only to make sales and provide service within their immediate geographic location. Trimble has no reseller/distributor able to meet the scope of the current requirement given the multiple locations of the software licenses receiving maintenance. Below are the responses received from the market research:
Company Name Contract Business Category
Trimble Navigation Limited Sole Source Other than Small Business
No contractor responses were received from Army CHESS, Enterprise Software Initiatives (ESI), GSA, or NASA SEWP. SEC CALM obtained a CHESS Statement of Non-Availability Number 216704157, dated 18 December 2015 and Goal Waiver 20151026865641, dated 11 December 2015 for this requirement.
9. Interested Sources: The Government Point of Entry (GPE) notice required by FAR
5.201 will be published on the federal business opportunities (FedBizOpps) webpage.
To date, no other sources have written to express interest in the acquisition beyond the vendor listed in paragraph 8.

There has not been any significant change in circumstances from the previous justification to this current justification. The Trimble support was renewed under the previous procurement due to the software already being integrated in the ENFIRE fielded baselines; thereby precluding the removal of the software without significant cost and time to re-engineer field replacement ENFIRE baselines.
