b. Subcontracting Competition: Pursuant to FAR 19.702(b), the Small business Subcontracting Program, a subcontracting plan will not be required for this action, as Talbert Manufacturing is a small business.

7. Actions to Increase Competition: The Government does not own or possess the technical data requisite for a competitive M872A4 semitrailer procurement.

Accordingly, the Government is taking no further action to increase competition at the prime contractor level for this procurement.

In April 2017, the Department of the Army (DA) released an executive order (EXORD) regarding the M872 semitrailer safety and readiness that tasked U.S. Army Training and Doctrine Command (TRADOC) to conduct a comprehensive M872 semitrailer modernization study. In June 2017, the U.S. Army Combined Arms Support Command (CASCOM) published guidance for the conduct of a trailer modernization study. In response to the DA EXORD, and following the CASCOM guidance, TCM-Trans, Army Capabilities Integration Center (ARCIC), and PdM HTV co-sponsored the Heavy Trailer Modernization Study (HTMS). The study was conducted to address the Army’s Trailer Fleet characterized by lack of commonality, lack of visibility, an aging portfolio, obsolescence, and significant corrosion issues.

The current M872A4 Contract W56HZV-19-D-0036 J&A was approved on 15 June 2018, by Dr. Bruce Jette, Senior Procurement Executive. The J&A stated that the Government was in the process of staffing a Capability Production Document for a new procurement Line Haul Trailer with the new start program estimated to begin in the 4th quarter of FY19. The new start program was anticipated to promote full and open competition. The rationale for stating the future competitive strategy was based on anticipated findings of the HTMS that was in process during the May 2019 timeframe and concluded in August 2019.

Although the previous J&A dated 15 June 2018, stated the next M872A4 semitrailer procurement will be competitive, this procurement will not be competitive because the HTMS was inconclusive on the ability to combine trailer requirements. It recommended maintaining specific trailers for specific purposes. The M872A4 is the only trailer described on the conclusion page for line haul missions. Consequently, the Line Haul Trailer new start program never came to fruition and Talbert remains the sole manufacturer.

8. Market Research: Research was conducted to ascertain marketplace trailer manufacturing capabilities for the manufacture of an M872A4 semitrailer to meet Government requirements detailed in ATPD 2332, Revision F, dated 07 May 2009. A Sources Sought Notice/Market Survey was conducted using the System for Award Management (SAM.gov) website from 1 August 2022 to 30 August 2022 to determine

(7) A J&A for M872A4 semitrailers was signed by Senior Procurement Executive, Dr. Bruce D. Jette on 14 June 2018 for Contract W56HZV-19-D-0036.

(8) Contract DAAE07-03-D-S067 was awarded under FAR Subpart 6.1, “Full and

Open Competition.” Talbert is the sole developer of the M872A4 semitrailer and owns the TDP. This proposed effort is a procurement of M872A4 semitrailers.

(9) No unusual patterns have been revealed by a review of the procurement history.

(10) All previous sole-source justifications for the M872A4 requirement cite FAR

6.302-1 “Only one Response Source and No Other Supplies or Services will satisfy Agency Requirement.” There are no significant changes to these circumstances.
