Department of the Army Sole Source Justification for Purchases under the SAT (Using FAR Part 13)

1. Contracting Activity: The Army Contracting Command-Detroit Arsenal (ACC-DTA), MI is the procuring activity for this action.

2. Description of the Supply or Service Purchased: ACC-DTA proposes to solicit and award, on a sole source basis, a Firm Fixed Price (FFP) contract to to procure three (3) custom cast life size fiberglass standing figures, in support of the U.S. Army Training and Doctrine Command (TRADOC) Headquarters. This action will fulfill the Commanding General’s requirement to honor and highlight the contributions of TRADOC Soldiers and Civilians by erecting a diorama inside TRADOC Headquarters.

The diorama will consist of a pedestal holding 3 custom cast life size fiberglass standing figures.

5. Reason for Authority Cited: The vendor, Atta Inc. is an artist ( Atta Inc.

created four custom figures for the US Army Quartermaster Museum in 2016. These exact figure designs were explicitly chosen by the Commanding General for the TRADOC HQ Lobby Exhibit. The specific figurines required are proprietary to Atta Inc.

and not available from any other company. One of the figurines will be duplicated, saving on overall costs. The figures are unique works of art, designed and created specifically for the US Army Quartermaster Museum. Only Atta Inc. has the highly specialized expertise to create figures of her own design and artistic expression to complete the figures requested. Since Atta Inc. has created these exact figures in the past, setup fees, time to complete, and symmetry between figures will be most beneficial and cost effective. An award to any other vendor would result in substantial increase of set-up and initial molding costs, as well as providing an inconsistent visual product. Creation and set up costs of three (3) new molds from another vendor would cost significantly more. Atta Inc. will be re-using a mold previously designed, so only two
