About this file
This document contains a justification and approval for a sole-source award and information on a related award notice. The justification outlines the Army's need to non-competitively award a contract to DRS for the repair and upgrade of Digital Vehicle Distribution Boxes. DRS is the original equipment manufacturer and owns the technical data rights. Previous market research in the form of a sources sought notice and internet search found no other capable sources. The sole-source authority cited is to follow the statutory exception for proprietary data. The related award notice is for contract W56HZV-23-D-0012 with the Army TACOM Life Cycle Management Command to DRS for continued Digital Vehicle Distribution Box repair and upgrade work.

Text version
CMO Control Number: 2021-062 competition is contemplated at this time, the Government will continue to survey the marketplace and review our acquisition strategy to identify additional contractors that may be able to repair and upgrade the DVDBs.
8. Market Research:
A Sources Sought Market Survey/Request for Information (RFI) was issued by ACC- DTA seeking companies capable of repairing and upgrading DVDBs. The Source Sought Market Survey was published on 9/14/2020 with responses due on 9/29/2020. The Market Survey asked industry to explain how they would repair and upgrade the DVDBs, asked if they have the capability to repair a quantity of 35 units every 30 days for a five year period, and asked if they have experience with the repair and upgrade of DVDBs. The Market Survey resulted in DRS being the only company that responded.
Internet Search: An internet search was conducted on 17 March 2021 by GVSC Engineering. The Engineer searched Google using the term “Digital Vehicle Distribution Box”. Besides DRS, the companies Infineon and TE Connectivity were found to have a similar product but not one that would meet our needs. The products used different interfaces than required and had larger space claim inside the vehicle.
9. Interested Sources: To date no additional sources have expressed interest in this acquisition.
10. Other Facts:
a. Procurement History:
Contract: W56HZV-16-D0028 Contract Type: FFP Contractor: DRS Contract Value: $20M Award Date: 5 Jan 2016 Requirement: Repair and Upgrade of the DVDB Competitive Status: Sole Source Authority: The statutory authority permitting other than full and open competition was: Title 10 United States Code (U.S.C) 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii)(A) and (B).
Summary of the historical J&A’s paragraph 7 (Actions to Increase Competition) contents and explanation of the results: DRS owns all technical data rights for the DVDB and competing subsequent procurements would be assessed on an individual basis. The result is that for the current buy, a Sources Sought Market Survey and Internet Search resulted in DRS being the only source capable of meeting the Government’s requirement.
CMO Control Number: 2021-062
Brief description of historical J&A’s circumstances justifying the procurement and any significant changes: The historical J&A based the non-competitive procurement on the Government not having rights to a detailed drawing package that would allow for the repair and or upgrade of the items, DRS refusing to sell a complete TDP, and that the cost to reverse engineer the DVDB would not be recouped through subsequent acquisitions. There have been no significant changes since the last J&A was approved and the Government still does not possess a complete TDP, DRS still refuses to sell the TDP that is suitable for competition and the cost to reverse engineer the DVDBs would not be recouped through subsequent acquisitions
