Department of the Army Sole Source Justification for Purchases under the SAT

(Using FAR Part 13)

Solicitation #: W56HZV22Q0068

1. Contracting Activity: The Army Contracting Command-Detroit Arsenal, MI (ACC-DTA) is the procuring activity for this action.

2. Description of the Supply or Service Purchased: ACC-DTA proposes to award a sole-source Firm-Fixed-Price contract to procure a maximum of 195 each Pump/Oil, National Stock Number (NSN): 1040-01-612-3498, P/N: A01-114-3441. Pump/Oil are being purchased from Fluid Process Equipment, Inc, Kalamazoo, Mi, Cage Code 1C8M3.

3. Dollar Amount: The estimated total purchase price for this requirements contract is Base Year $87,059.70, Option Year 1 $87,059.70 for a total of $174,119.40. The type of funds is Army Working Capital (AWCF).

4. Authority Cited: FAR 13.106-1(b)(1), “Soliciting from a Single Source.”

5. Reason for Authority Cited: Fluid Process Equipment Owns the Techinical Data Package (TDP) and is the only source to provide the Pump/Oil. The Government does not have the competitive TDP or Government data rights to permit acquisition from other sources.

6. Market Research: The Pump oil is used in the M26 water pump. The pump was designed and tested with this specific formulation to increase the life and reduce foaming of the water pump. This is the only oil that is tested and approved oil to be used with this pump that cost over $10,000. This oil has a shelf life of 24 months and was previously procured from Fluid Process Equipment, Inc. Engineering conducted an oil analysis to potentially identify other oils with a similar formulation that did not return any results. The pump oil is a critical component to the M26 engine without it, the engine will not properly work and could result in mass injury or casualty during mission.

A sources sought was posted to sam.gov on 09 Nov 2022, and was open for 30 days, no repsones was received.

Website nsnnow.gov was reviewed and identitifed this item being previously procured by Fluid Process Equipment, Inc. Engineering performed market research for pump oil and found that this vendor still carries this oil. Fluid Process Equipment owns the TDP and would cause issues to procure for it to be competitive buy.

7. The POC for this action is Eboni Albert, Eboni.q.albert.civ@army.mil , 571-588-9006.

8. Contracting Officer Certification: I certify this justification is accurate and complete to the best of my knowledge and belief.
