7. Actions to Increase Competition: The Government will further refine performance specifications for the TBU to meet the requirement with commercial or Non- Developmental Items while still meeting stringent military requirements for security, durability and commonality across platforms. The use of commercial or Non- Developmental Items will increase the available future options for competition for the next generation of Turret Battery Unit solutions. The Government will continue market research with industry in order to increase competition. A formal request for information will be published in BetaSAM for any future requirements.

8. Market Research: In accordance with FAR Part 10, Defense Federal Acquisition

Regulation Supplement (DFARS) 205.205-71, and DFARS 206.302, Market Survey W56HZV-21-R-0090 was posted to Beta.SAM on 8 February 2021, and closed 16 February 2021. No official responses of interest except from DRS were received during this time. Additional research was conducted on 18 February 2021 utilizing the Google search engine, along with BetaSAM.gov. All market research indicate that no sources exist aside from DRS that could meet the Government’s requirements without substantial unacceptable delays. The Government maintains consistent communication with companies concerning similar projects and has knowledge of each company’s capabilities through meetings, visits, trade shows and continuing discussions on several projects. Additionally, literature research of potential vendors from different competitions confirms the capabilities that are offered by the other vendors will not suffice under the current schedule constraints.

9. Interested Sources: To date, no other sources has expressed interest in this procurement.

10. Other Facts:

a. Procurement history: The following are STS/SSTS for the PdM BFVS FoV

Power, Diagnostics, and Optics hardware and software systems. The STS contracts listed below were awarded on a sole source basis to DRS under the authority 10 U.S.C 2304(c) (1) and FAR 6.302-1 due to previous efforts being cost prohibitive at that time to pursue the development of a TDP, which would result in unacceptable delays in fulfilling the agency’s requirements.

(1) Contract Numbers and Dates

a) Contract: W56HZV-19-C-0055

DRS Network & Imaging Systems, LLC Awarded: 18 April 2019 Value: $1.175M Competitive Status:Sole Source J&A Authority Cited: 10 U.S.C 2304(c) (1) and FAR 6.302-1

b) Contract: W56HZV-12-C-0199

Awarded: 13 April 2012 Value: $60.5M

Competitive Status: Sole Source

c) Contract: W56HZV-12-C-0405

Awarded: 26 September 2012 Value: $7.3M Competitive Status: Sole Source

(2) No prior contract for the STS/SSTS requirement was accomplished using full and open competition. As noted in section 10.a.1, above, all previous contracts were awarded on a sole source basis using the authority 10 U.S.C 2304(c) (1) and FAR 6.302-1.

(3) No unusual patterns were revealed by the procurement history.

(4) The previous justification was issued under the authority of FAR 6.302-1.

That justification stated it was cost prohibitive at that time to pursue the development of a TDP and it would result in “unacceptable delays in fulfilling the agency’s requirements.” “At this time, the delay alone is more significant than the cost.” Had the previous contract not been awarded by 31 October 2018, the Government would have lost the knowledgeable technical expertise and support for the STS/SSTS effort.
