Department of the Army Sole Source Justification for Purchases under the SAT (Using FAR Part 13)

Purchase Request #: 11335795

1. Contracting Activity: The Army Contracting Command-Warren, MI is the procuring activity for this action.

2. Description of the Supply or Service Purchased: Standard “silver” laser service on a Continuum Powerlite 9010 (modified for TEM00 operation) Nd:YAG laser (with injection seeder and two harmonic generator crystals for 532 nm and 355 nm output). Laser system Serial Number: 3527.

Amplitude Laser, CAGE code 3CCH9, DUNS number 122529063, 140 Baytech Dr., San Jose, CA. 95134, (877) 272-7783 or (888) 532-1064 / Fax (408) 586-0015.

3. Dollar Amount: The estimated total purchase price is $46,700 and consist of base year and two separately priced options as follows:

Base Year - $18,056.80 Option Year 1 - $14,124.80 Option Year 2 - $14,124.80 Grand Total: $46,306.00.

The Contracting Officer has determined that this service cost is fair and reasonable.

The type of funds are Fiscal Year 2019 RDTE.

4. Authority Cited: FAR 13.106-1(b)(1), “Soliciting from a Single Source.”

5. Reason for Authority Cited: The customized TEM00 Continuum Powerlite 9010 Nd YAG laser system has proprietary designs and the only qualified Continuum laser servicer is Amplitude Laser. Amplitude Laser, who acquired Continuum Electro-Optics, Inc., has the only laser service personnel that are qualified to perform maintenance and repairs on this customized Continuum laser system.

6. Market Research: Market research was conducted in February 2019 by Dr. Andrew Clements via google internet search and also search on the Laser Focus World Buyer’s Guide website to find alternative laser servicing companies that were certified to maintain and repair Continuum Lasers. One company was identified on the Google search (TJS Lasers, Inc.) and five companies on the Laser Focus World site (Holo-Spectra, Inc., Laser Solutions, Inc., LVD Strippit, Medical Laser Services Corp., and Modu-Laser LLC) that were after-market servicers of other companies’ lasers. However, none of these providers listed Continuum as a brand of lasers that they were qualified to maintain or repair. Amplitude Laser (formerly Continuum Lasers) is the only source with qualified personnel that can perform maintenance and repairs to Continuum lasers. Amplitude Lasers has proprietary rights and is the only authorized dealer and servicer Continuum Powerlite Nd YAG lasers. Only Amplitude has knowledge of Continuum’s proprietary designs, a record of the specific design modifications made to customize this laser, and the history of how this laser has been repaired and modified throughout its lifetime. It is in the Government’s best interest to go to Amplitude Laser for this service contract.

7. The POC for this action is Dr. Andrew Clements, Andrew.F.Clements8.Civ@mail.mil, 586-282-5389.

8. Contracting Officer Certification: I certify this justification is accurate and complete to the best of my knowledge and belief.
