Department of the Army Sole Source Justification for Purchases under the SAT

(Using FAR Part 13)

Purchase Request # 11288283

1. Contracting Activity: The Army Contracting Command-Warren, MI is the procuring activity for this action.

2. Description of the Supply or Service Purchased: Humanetics will provide numerical models and license for Hybrid III Anthropomorphic Test Device (ATD) for LS- Dyna to perform occupant safety assessment and studies. Humanetics will provide an ATD, aka crash test dummy, model and license for:

1. one (1) Hybrid III 50th Male FE Model, for a term of 12 months, to expire on 26 APR 2020

2. one (1) Hybrid III 5th Female FE Model, for a term of 12 months, to expire on 26 APR 2020

3. one (1) Hybrid III 95th Male FE Model, for a term of 12 months, to expire on 26 APR 2020

This acquisition will include two option years to renew the same licenses starting 27Apr 2020 until 26 Apr 2021 and 27Apr 2021 until 26 Apr 2022.

Supplier: Humanetics Innovative Solutions

23300 Haggerty Road, Farmington Hills, MI 48335 Phone 248 778 2000 Fax 248 778 2001

DUNS: 962598467

CAGE: 0TUR1

3. Dollar Amount: The type of funds is FY19 FY20 2040 (RDT&E).

4. Authority Cited: The statutory authority permitting other than full and open competition is:

-- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and 41 U.S.C. 253(c), as implemented by FAR 13.106-1(b)(1), “Soliciting from a Single Source.”

5. Reason for Authority Cited: Humanetics Innovative Solutions is the manufacturer of the ATDs themselves; as such Humanetics Innovative Solutions is the only reasonable source for the ATD Finite Element models and software license renewals being acquired under this contract. The software products and configurations covered under this contract are proprietary to Humanetics Innovative Solutions. Robert A.

Denton Inc (RA Denton) and First Technology Safety Systems (FTSS) were the only two companies in the world, to supply ATD hardware, related models and licenses.

However, in April 2010, these two companies merged to become Humanetics Innovative Solutions.

Now, Humanetics is the only provider of the ATD models of their physical dummies used by the Army including Live Fire Testing at Aberdeen Proving Grounds, which limits our approach for this software and hardware requirement. Competing and awarding this action to a vendor other than the Humanetics Innovative Solutions would cause substantial delays to TARDEC in that new software licenses and hardware would need to be developed. These delays are unacceptable due to the need to get life-saving occupant protection technologies out into the field as soon as possible. Additionally, if the FE models were to be acquired from another source that had reverse engineered the ATD, there is no guarantee that recent design changes made to the ATD will be represented in that FE model. Furthermore, TARDEC has many legacy models of Ground Vehicle Systems that utilize these Humanetics dummy models and would be uneconomical and schedule prohibitive to modify all those systems.

6. Market Research: Recent (Jun 2018 - Nov 2018) market research performed by Jian Kang, Research Mechanical Engineer, included performing internet searches of websites related to vehicle crash testing, attending conferences/meetings with industry attendance, communicating with SMEs and analysts, and holding discussions with teammates and other Government Agencies that employ the use of ATDs. This market research continue to reinforce the findings from earlier market research that Humanetics is the most suitable supplier of ATDs and Validated ATD models of interest to support our mission. In communications with Army Research Lab SME it was learned that ARL is also using Humanetics ATD models in their mission. In addition, ARL has also worked on projects with Humanetics to further enhance these Humanetics ATD models for usage in Army vehicle simulation models subjected to blast loadings.

Other than Humanetics, there are some dummy models that are available from LSTC (Livermore Software Technology Corporation). However, their models are claimed still under development, not subjected to rigorous validations as Humanetics models are.

Other options to obtain the technologies, such as reverse engineering or acquiring the Technical Data Package (TDP) of the ATD are not feasible and/or too expensive to acquire:

The necessary expertise, equipment and machinery do not exist within the Government to reverse engineer the ATD.

Humanetics will not provide a TDP of their proprietary ATD designs.

Currently Army is working on a multi-year multi-million dollar project to develop a completely different and more bio-fidelic ATD, known as WIAMAN ATD. The objective of this project is to have a new line of ATD hardware and associated Finite element models that the Army can use in Ground Vehicle occupant protection. However, it is not expected to be fully operational in Army Live Fire Tests for the next three years.

Therefore, this market research concludes that at present, Humanetics is the only supplier of ATDs and Validated ATD models of interest to support our mission and hence the only responsible source for this contract.
