This delay could result in potential loss of life due and harm to the Government as described.
6. Efforts to Obtain Competition:
a. Effective Competition: This action is for the urgent capability enhancement of Government Furnished M1070A1 HET Tractors. Efforts to obtain competition cannot be effectively pursued at this time without causing significant delays.
This action will not be synopsized, pursuant to FAR 5.202(a)(2).
b. Subcontracting Competition: In accordance with FAR 19.702(a)(1), a subcontracting plan will be required for this action. As such, FAR clauses 52.219-9, Small Business Subcontracting Plan; 52.219-16, Liquidated Damages – Subcontracting Plan; and 52.219-4004, Submission of Subcontracting Plan; will be included in the solicitation. The proposed subcontracting plan will be reviewed and if acceptable, incorporated by reference into the contract.
7. Actions to Increase Competition:
The Government does not own the TDP for the M1070A1 HET Tractor and does not own the proprietary processes used in implementing the capability enhancements. The Government is taking no further actions to increase competition at the prime contractor level because there are no known future requirements at this time.
8. Market Research:
PdM HTV conducted market research through Requests for Information (RFI) from industry, internet searches of contractor products, and direct industry engagements beginning in March 2016. The most recent engagement was an industry conference held in October 2018. Representatives from PdM HTV hosted a conference to collect information and determine industry’s current capabilities to move heavy, oversized payloads. PdM HTV obtained information about industry products and capabilities from marketing presentations, commercial literature and direct conversations with various companies. To date, no other contractor has demonstrated the proven technical capability or experience that would accomplish this requirement, without experiencing significant delays.
PdM HTV Subject Matter Experts (SMEs) periodically perform research pursuant to FAR 10.002(b)(2). The SME’s consider current market conditions on vehicles and variants, components, and the capabilities of industry to accomplish the requirement when evaluating potential vendors.
9. Interested Sources:
To date, no other sources have expressed interest in this effort.

13. Fair Reasonable Cost Determination:
The negotiated price will be determined fair and reasonable by conducting a price analysis to ensure that the price agreement is consistent with the Independent Government Cost Estimate (IGCE) for the modification of the M1070A1 HET Tractor.
ACC-WRN has a dedicated Cost and Pricing Division with trained Cost/Price Analysts and Industrial Specialists who will assist the Procuring Contracting Officer (PCO) by performing a Price Analysis. This analysis will also be supported by a PdM HTV Technical Review and Defense Contract Audit Agency (DCAA) audit. The recommendations from the Cost/Price Analyst and PdM HTV technical review will be used to develop a recommended negotiating position. This detailed Government position will be approved in a comprehensive Business Clearance Review consisting of reviews from senior contracting officials at ACC-WRN. The results of negotiations and the detailed Fair and Reasonable Determination from the PCO will be documented in a Post Negotiation Memorandum (PNM) the will be reviewed and concurred upon by senior contracting personnel within the Pricing Division.
