CMO Control Number: 2018-074

For Official Use Only new procurement versus a sole source change to the current contract. The estimate also provides for an additional 30 days for a site visit after award for a new procurement. The contract would need to be awarded before funding was given for a site visit in a competitive environment. The sole source effort could leverage existing Field Service Representatives (FSRs) working in Korea who have knowledge of the site so they would not need a site visit. Obtaining access to the necessary software for a new contractor is estimated at 60 days after award. The contract would need to be awarded before the process to obtain CAC cards and obtaining system access. The sole source effort could leverage existing CAC card employees working current TAP efforts. Also, the sole source effort could leverage contract employees who have software and system access under current TAP efforts. Establishing supplier agreements is estimated at 60 days after award. The contractor will need to have supplier agreements for repair/procurement from a variety of sub-vendors and Original Equipment Manufacturers. The sole source contractor already has existing sub-vendor agreements in place for the TAP CONUS effort with support in Korea. This rolls up to an estimated 150 days post award for a new contractor to be fully operational and begin receiving and testing on DSESTS. The overall total number of days to include acquisition timeframe and full operational status to get a new contractor up and running is estimated at 390 days, equating to a 550 day delta (14 months) from the sole source procurement. This delay is unacceptable to both the OCONUS and CONUS efforts, as the associated lead time causes a disruption to the required deployment start date, and would create a break in service for the CONUS effort.

Note. The CONUS TAP Fort Hood effort expires on 31 December 2018. The effort is being extended to align the period of performances for both the CONUS and new OCONUS effort, in order to potentially compete the requirement in the future (see paragraph 8 below).

6. Efforts to Obtain Competition:

a. Effective competition: There is no plan to obtain competition for this contractual action because of the urgency of this requirement. Only GDLS, with its unique experience and capabilities can provide performance of TAP Forward requirements in the timeframe required by the Government.

b. Subcontracting competition: GDLS is a large business. Even though, in accordance with FAR 19.702(b), subcontracting plans are not required for contracts or contract modifications that will be performed entirely outside the United States and its outlying areas, the current contract already includes FAR clauses 52.219-8, Utilization of Small Business Concerns; 52.219-9, Small Business Subcontracting Plan; 52.219-16, Liquidated Damages- Subcontracting Plan; 52.219-28, Post-Award Small Business Program Representation; and DFARS clause 252.219-7003, Small Business

Subcontracting Plan (DoD Contracts), to maximize small business opportunities and utilization.

7. Actions to Increase Competition: Based on the most recent market surveys, it appears as though additional sources are capable and interested in competition for the future TAP program. Competing the subsequent procurement is being assessed at this time. The Government plans to publish additional sources sought notices in order to determine whether-or-not competition is available for this work.

8. Market Research: ACC-WRN posted a market survey for the TAP Forward Korea requirements on 18 April 2018 to obtain information on industry capability and interest in performing the TAP program efforts in Korea. The Market Survey closed on 20 April 2018 with two responses received; one from GDLS and one from DRS Network & Imaging Systems, LLC. The Government reviewed the responses and concluded that although DRS is a viable source for the future, it is unable to meet the required schedule for this immediate need nor could a competitive effort be put in place prior to the expiration of the current CONUS TAP Fort Hood effort, as detailed above in section 5.

ACC-WRN posted an additional market survey for the TAP CONUS requirements on 02 May 2018 to obtain more information on industry capability and interest in performing the TAP program efforts. The Market Survey closed on 09 May 2018 with two responses received; one from GDLS and one from DRS Network & Imaging Systems, LLC. The Government reviewed the responses and concluded that although DRS is a viable source for the future, it is unable to meet the required schedule for this immediate need as detailed above in section 5.

Additionally, market research was conducted by ILSC in April 2018 with personnel knowledgeable in the logistical aspects and requirements of this effort. It was determined that no other contractor is capable of providing the current level of support without a serious disruption at this time. This disruption would be due to several factors that would prohibit the ability of a new contractor to be fully operational, to include establishing supplier agreements, and transitioning of equipment and personnel not on site to Korea, which is necessary to maintain the required support level. Contractors, such as BAE, DRS and others that have conducted field support efforts were considered for this contract, however, after much deliberation, it was concluded that GDLS was the only source as detailed in section 5. Other factors considered in this determination include the percentage of support required for the Abrams system (which is greater than for Bradley and Wolverine vehicles), the amount of repair/upgrade by each subcontractor for each subsystem, and new contractor ability to purchase/modify equipment and systems to be compatible for the necessary support. Any other contractor would have to seek GDLS' assistance to familiarize itself with the existing configuration changes, tracking, obsolescence issues, field problems/trends, and contacts with original equipment manufacturers. Another

OPSEC

contractor would likely need GDLS assistance throughout the life of the contract because GDLS is the Abrams System Integrator. Based on the information above, GDLS is the only contractor who can achieve the desired timeline for this effort.

9. Interested Sources: Except for the respondents mentioned above in section 8, to date, no other sources have written to express an interest in this procurement. In accordance with FAR 5.201, this effort will be synopsized on the FBO website. Any bids or proposals received will be considered.

10. Other Facts:

a. Procurement History:

(1) Listed below is a history of TAP contracts awarded to GDLS since the program’s inception.

Contract Award date Dollar Value

DAAE20-99-C-0096 09 SEP 1999 $ 42,998,849

W52H09-05-C-0089 27 APR 2005 $ 55,632,330

W56HZV-11-C-0109 30 DEC 2010 $ 41,630,271

W56HZV-11-C-0109 P00020 23 DEC 2015 $ 11,520,705

W56HZV-17-C-0052 21 DEC 2016 $ 25,059,853

(2) No contracts for TAP were made through full and open competition

(3) The Justifications and Approvals (J&As) for all previous contracts were approved under the authority of 10 U.S.C. 2304(c) (1) and FAR 6.302-1(a)(2)(iii), “Only One Responsible Source.”

(4) The previous J&A was approved by Ms. Kristan A. Mendoza, Principal Assistant Responsible for Contracting, ACC-WRN, on 20 October 2016. Paragraph 7 of that J&A stated ACC-WRN would continue to publish sources sought market surveys on FBO in an effort to identify additional capable sources interested in competition of the TAP program for the future.

ACC-WRN posted a market survey to FBO in March and April 2016. ACC-WRN also directly contacted the previously respondent contractors to make them aware of the survey posting and encourage a detailed response. Despite the efforts made to contact each company, both neglected to submit a response to the survey and have not expressed further interest in the program. No other contractors expressed interest or responded to the survey.

(5) None of the prior awards for TAP were accomplished by full and open competition.

(6) No unusual patterns have been revealed by the procurement history.

(7) The justifications for all previous requirements listed above were based on only one source pursuant to FAR 6.302-1. The significant change for this procurement is the addition of an OCONUS location in South Korea with even tighter repair schedules, potentially making this effort even more restrictive than previous efforts.
