Department of the Army Limited Source Justification-Multiple Award IDIQ Task Order

Under OMNIBUS III Contract W56HZV-09-A-A904

1. Contracting Activity: Army Contracting Command – Warren (ACC-WRN) is the contracting activity responsible for this action.

2. Description of Action: This procurement will result in a new order under the ACC-

WRN Omnibus III Blanket Purchase Agreement (BPA) W56HZV-09-A-A904 with Jacobs Technology for senior program management analyst support at the Pentagon in Washington, D.C. The task order will be a firm-fixed-price, level-of-effort term contract type. The total estimate value of the task order is approximately $1.37 million for a 12-month base period and two 12-month option periods. Fiscal year 2015 Procurement Appropriations (PA), Weapons and Tracked Combat Vehicles (WTCV) funds will be used for this effort.

3. Description of the Supply/Service: The Army requires senior program management analyst support services for 9,840 hours, covering up to 36 months.

These services ensure that programmatic and budgetary information is communicated to the Assistant Secretary of the Army, Acquisition, Logistics, and Technology (ASA(ALT)). These services also provide program support and recommendations to the Department of Army System Coordinator (DASC), Project Director for Main Battle Tank Systems (PD MBTS), and ASA(ALT) leadership regarding cost, schedule, risk, and economic and technical issues affecting successful PD MBTS program execution. The service provide for the establishment, facilitation, and maintenance of close liaison coordination with Program Executive Offices (PEOs), Major Army Commands (MACOMs), supporting staffs, and systems contractors. The service further provides for consultation with ASA(ALT) Senior Leadership to provide recommendations to resolve conflicting issues between Headquarters, Department of The Army (HQDA) and PD MBTS for the purpose of ensuring aligned and synchronized positions on pending acquisition issues.

4. Authority Cited: 40 U.S.C. 501, Services for Executive Agencies, and FAR 8.405-

6, Limited Sources. This acquisition is conducted under the authority of the Multiple Award Schedule Program. The circumstance justifying limited sources in accordance with FAR 8.405-6(a)(1)(i)(B) is “Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.”

5. Reason for Authority Cited:

a. The services required are unique and highly specialized. Successful performance of the required services depends on a deep and thorough understanding of all PD MBTS programs gained as a result of experience handling pending acquisition actions and through the use of established relationships both within the Department of the Army

(DA) and the Department of Defense (DoD). PD MBTS encompasses several ground combat vehicle programs, many of which of are in different phases of life cycle development. The DASC support service requires a current, detailed understanding of all current-, near-, and medium-term acquisition actions that will require review and coordination by DASC, as well as what offices to staff the requirements with within the DA and the DoD. The level of understanding to the necessary level of detail of MBTS Ground Vehicle programs is extremely rare. PD MBTS reliance on this service has increased in recent years as experienced Government personnel have retired and more reliance was placed on contract-provided support. Further, as Army personnel policies result in rotation of senior personnel to new assignments more often than in the past, the available personnel with this level of understanding of PD MDTS programs has been greatly reduced *. The nature of the services requires an existing, exceptionally detailed knowledge of all of the PD MBTS platforms, as they are managed at the senior acquisition levels of the DA and DoD. Additionally, knowledge of the current-, near-, and medium-term acquisition requirements and the Program Order of Magnitude (POM) for each program is necessary in order to perform the service at the level of quality required.

b. The only contractor that can provide the service at the required level of quality is Jacobs Technologies (“Jacobs”), the incumbent contractor. Jacobs is the only contractor that possesses the level of detailed knowledge required to perform the work to conform to the requirements. The knowledge and relationships established by Jacobs are possessed by no other contractor. Jacobs has developed this unique competency through eight consecutive years of experience supporting the PD MBTS DASC’s position. Jacobs is the only source that has an overall knowledge of all PEO GCS programs, with very detailed knowledge of the Abrams Tank Program, M88 Combat Recovery Systems (CRS), and Foreign Military Sales (FMS). This level of experience and familiarity with the intricacies of PEO GCS programs makes Jacobs the only source capable of providing the services required at the level of quality, particularly for the following required tasks:

(1) Provide decision makers with impact papers and Courses of Actions (COAs) input.

Jacobs is the only contractor that has extensive experience assessing Army force structure and budget changes as they would particularly impact PD MBTS programs relating to the staffing of documents through the DASC. Additionally, the Army is developing its Long Range Investment Requirements Analysis (LIRA) for all combat vehicle platforms. Jacobs is the only source with the knowledge and expertise to independently respond to requests for information and represent PEO GSS and ASA(ALT) at the LIRA reviews. LIRA analysis will be on-going through the fiscal year. *

(2) Provides continuity within ASA(ALT) for all PEO GCS programs. Jacobs’s broad knowledge of all PEO GCS programs provides ASA(ALT) augmented support to the assigned military DASCs. Jacobs provides essential DASC support to the Abrams, Bradley, and other PEO GCS programs when there is a deployment or between military DASC rotations. Additionally, Jacobs is the only OMNIBUS contractor that currently has the knowledge to train new DASCs and PEO GCS persons serving at ASA(ALT) on

Commented [c1]: Operation Security (OPSEC)

Commented [c2]: OPSEC developmental assignments on what offices to interact within DA and DoD depending on the type of document being staffed, and how to assess the document to determine what offices to consult.

(3) Jacobs is currently assisting in the preparation of the SECARMY testimony to Congress*on the Abrams Tank and CRS programs. This testimony involves delicate issues with regard to the sustainment of Joint Systems Manufacturing Center (JSMC) in Lima, Ohio, and BAE Systems York facility. * Jacobs must provide follow-up answers to congressional questions *which will be needed on an expedited basis, which no other contractor can provide. Jacobs’s detailed knowledge of Industrial Base ramifications *and its recognized competency preparing testimony for the SECARMY *enable Jacobs to independently prepare and brief the output to the Army Acquisition Executive (AAE).

In addition, Jacobs has developed essential contacts with the Army’s Office of Congressional Liaison (OCL) and with key Professional Staff Members (PSM) on both the Authorization and Appropriation committees. *Jacobs regularly briefs the PSMs on program status. Jacobs is the only source that can continue preparing and staffing these documents to senior leaders and responding to on-going congressional inquires * at the level of quality required.

(4) Provide detailed knowledge of complex fiscal rules and processes related to the Programming, Planning, Budgeting, and Execution (PPBE) process; a vast network of associations with the Army G-8, Army G-4, Army G-3, Army Budget Office (ABO), ASA(ALT), and the Army Materiel Command (AMC) that together work to influence positive outcomes for the PEO GCS programs. Many of these budget drills are “close hold” within ASA(ALT), requiring the contractor to work without the benefit of PEO GCS’s input and advice. Jacobs has the specific program knowledge base and the essential knowledge of how the PPBE process works within the Pentagon. *Jacobs has unique capability to accomplish the required tasks, as outlined below:

(5) Support funding synchronization for Abrams recapitalization. The Abrams recapitalization process depends on Operation and Maintenance, Army (OMA) funding provided by G-4 and Weapons and Tracked Combat Vehicles (WTCV) funding provided by G-8, to be budgeted by both offices in very specific amounts and phased in at very specific points in time so that the right appropriation is used to fund the appropriate work efforts. Without this careful synchronization of the various fund types, the Army could not afford to recapitalize the tanks and may be at risk of misappropriation. The synchronization of OMA and PA WTCV funding is being tracked at the PEO level as the highest risk to the Abrams program. Jacobs currently leads on-going synchronization meetings between Army G-4 and Army G-8 to assure that the both the OMA and PA WTCV funding streams are sufficient and timely to execute the complete tank build.

Disruption of those synchronization efforts could put the production program at great risk. *

6. Market Research: Market research was conducted by PD MBTS and ACC-WRN in

November 2014. The research consisted of contacting Omnibus BPA holders Booz Allen, Tolliver, PD Systems, Leidos (SAIC) and Camber Corporation to determine what

Commented [c11]: OPSEC expertise related to this requirement currently existed on their staffs, and what could be obtained in the marketplace. These BPA holders were selected from the total as they have received and demonstrated the most experience with Knowledge Based Services of this type since the inception of Omnibus IIII. Each of these firms replied that they had no one on staff meeting the qualifications required of the position, primarily because of the experience and established relationship requirement. Further, all stated that they could not meet the full requirements of the position at award, that they would need several months to develop the required relationships and understand the myriad processes for staffing PM MBTS documents at all of the required levels. Although industry expressed interest, no other contractor is able to provide the required services at the level of quality required as discussed in Section 5. based on the critical need to have the existing contractor support PD MBTS, it is in the best interest of the Government, for the reasons stated in Section 5 above, to grant this sole-source approval because the services are so unique and specialized, no other contractor is capable of providing them.

7. Other Facts:

a. Jacobs has been performing this effort successfully since 2008 and has been intricately involved with the development of PD MBTS programs. To date, there have been no negative performance issues.

8. Actions to Increase Competition: No actions to increase competition are planned at this time, since no other contractors have, the capabilities to meet the Government’s scope of work requirements for this effort. The marketplace will continue to be surveyed to determine if another contractor could fulfill this requirement. Any information received will be considered to determine if a competitive acquisition should be conducted or to determine potential future requirements. The Government is having Government personnel work with the Jacobs employee to learn this function with the intent of being able to assign these duties to one or more Government employees by the conclusion of this contract with the intent of no longer having to rely on contractor support for these services.
