Limited Source Justification - Multiple Award Task Order Contract Under OMNIBUS III Contract W56HZV-09-A-A904

1. Contracting Activity: U.S. Army Contracting Command – (ACC-WRN)

2. Description of Action: This Limited Source Justification authorizes the use of an exception to the fair opportunity process for ACC-WRN. A contract action is proposed to be awarded to Jacobs Technology Incorporated as a logical follow to contract number W56HZV-09-A-A904 Task Order 0036. This new Time and Materials Task Order contract will support technical and administrative services for missions in Operation Enduring Freedom (OEF) for the Mine Resistant Ambush Protected (MRAP) Family of Vehicles (FOV). Jacobs Technology Incorporated is a Blanket Purchase Agreement (BPA) holder under the OMNIBUS III Multiple Award Task Order (MATO) Contract. In accordance with the Independent Government Cost Estimate (IGCE), the Program Management office for MRAP anticipates a total estimated contract value of $5,805,700 for this action to be funded with FY14 Army Operation and Maintenance (O&M) funds.

3. Description of Supplies/Services: The contractor provides PM MRAP the capability to perform the following technical and administrative services; Program Management, Logistics, Engineering, Quality Assurance Reviews, Administrative, Training, and Coordination with MRAP Directorate of Combat Development (DCD). The MRAP Program Office was established to rapidly field MRAP Vehicles to military units in OCONUS locations subject to active combat situations. As such, execution of this mission was of the highest Army priority. The MRAP PM is currently drawing down the wartime effort and only requires the technical and administrative services for a short timeframe beyond the end of the period of performance for Task Order 0036. This short term service contract will be used to support the PM in meeting mission requirements.

Jacobs Technology Incorporated is currently performing Task Order 0036 on a Firm- Fixed price Level of Effort basis. Due to the uncertainty associated with the wartime drawdown, the proposed task order of this logical follow on will be a new task order awarded on a Time and Materials basis.

The period of performance will consist of a twelve month base ordering period and one six month option period using FAR Clause 52.217-8.

4. Authority Cited: This acquisition is conducted pursuant to the authority of 40 U.S.C. 501 and FAR Part 8.405-6(a)(1)(i)(c) “Limited Sources” pertaining to Multiple Award Schedule Program; “In the interest of economy and efficiency as a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole source or limited-sources procedures.”

In accordance with DFARS 208.405-70(b), the Government determines that in addition to FAR 8.405-6(a)(1)(i)(C), the circumstance found in FAR 16.505(b)(2)(i)(C) also exists, “The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.”

5. Reason for Authority Cited: Extending the current task order via a logical follow on is in the government’s best interest to preserve economy and efficiency. The current contract vehicle, Omnibus III approved for use in awarding commercial services for PM MRAP is set to expire 06 February 2014. The Afghanistan drawdown is expected to be completed and no further contract services will be required after the eighteen month timeframe proposed for this action.

The Strategic Service Solutions (S3) contract, the successor to the Omnibus III, is not reasonably anticipated for award until March of 2014. An average of 6 to 8 months to compete and award a task order would result in the earliest possible task order award on the S3 contract occurring in the September 2014 time frame. An eighteen month extension to the current task order, which ends in February 2014, would provide a final contract to complete the MRAP efforts in an efficient and economical manner.

A portion of this task order entails the Afghanistan mission for 3 people which is scheduled to end on 30 September 2014. A cost avoidance by using a logical follow-on for seven months of the effort to replace three OCONUS personnel is approximately $12,000 (which includes de-processing of current employees and processing of new employees). There is also a three week overlap of two contracts (incumbent and ramp up of new contractor) for labor costs, for an additional $12,500. Therefore, the total cost avoidance by maintaining the same contractor is approximately $24,500.

Documentation and work efforts required under a new task order could be expected to be of lesser quality associated with a new contractor to obtain the required level of expertise.

Award to any other source under the current available contract vehicle would result in a substantial duplication of cost and reduced quality causing unacceptable delays to the government that are not expected to be recovered through competition.

6. Market Research: Market research was conducted from March 2013 through July 2013 by the MRAP Program Office in conjunction with ACC-WRN and in accordance with Federal Acquisition Regulation Part 10.002. Knowledgeable individuals within Government were contacted in April 2013 to identify potential market requirements to meet this specific requirement IAW 10.002 (b)(2). This requirement is currently being accomplished under OMNIBUS BPA W56HZV-09-A-A904 Task Order 36. The Contracting Officer reviewed the tasks awarded under the OMNIBUS III BPA contract and compared it to the scope of work for this requirement. The Contracting Officer identified that a BPA Task Order award under the GSA schedule based contract vehicle is the best option for completing the Government’s requirement. The market research results showed that in the interest of economy and efficiency, a logical follow-on was identified for this limited period of performance as the most effective strategy to avoid substantial duplication of cost and reduced quality as well as unacceptable delays yielding a total cost avoidance of $24,500 by maintaining the same contractor.

7. Other Factors: Jacobs Technology Incorporated is currently performing this requirement for PM MRAP under an existing contract therefore Jacobs Technology Incorporated has the required experience and knowledge base to perform the aforementioned support. Ongoing PM MRAP program requirements will not be properly executed according to cost, schedule, and performance if this requirement is not extended.

8. Actions to Increase Competition: Duplicative training and procurement costs, unacceptable delays and a shortened period of performance on the current contract mechanism necessitate the extension of this task order in the interest of economy and efficiency. The Afghanistan Drawdown is expected to be completed and the particular contract services are not anticipated after the eighteen month timeframe of this proposed action. If there is a need for this requirement beyond the anticipated eighteen month timeframe, it will be competed under the TACOM Strategic Service Solutions (TS3) Contract.
