CMO Control Number: 2016-112 Program: Abrams System Technical Support (STS) and Sustainment System Technical Support (SSTS)
DEPARTMENT OF THE ARMY
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Army Contracting Command-Warren (ACC-WRN), Warren, Michigan, is the contracting activity for this action.
2. Description of Action: This justification requests approval to award additional hours and material for the sole-source contract W56HZV-13-C-0017 to General Dynamics Land Systems (GDLS) to provide System Technical Support (STS) and Sustainment System Technical Support (SSTS) services. The STS and SSTS contract modification is necessary through current contract expiration of 28 February 2017 to allow for the new STS contract to be executed. This modification will support the Abrams Tank Systems Family of Vehicles (FoV) across the acquisition lifecycle, derivative systems, and Foreign Military Sales (FMS) tanks. Derivative systems are the Wolverine, Assault Breacher Vehicle (ABV), and Joint Assault Bridge (JAB) systems. These three systems are United States military operated vehicles that are based on the Abrams Main Battle Tank chassis.
This modification will be on a Cost-Plus-Fixed-Fee (CPFF) Level of Effort (LOE) basis using Fiscal Year (FY) 15-17 Procurement Appropriation, Army (PAA); FY15-17 Research, Development, Test, and Evaluation (RDT&E); FY16-17 Operation and Maintenance, Army (OMA); FY16-17 Operation and Maintenance (O&M), United States Marine Corps (USMC); Army Working Capital Fund (AWCF); and FMS funding. The total additional estimated hours are 784,963. The dollar value of this action is estimated to be $92.6M.
3. Description of Supply and Services: The purpose of this acquisition is to provide material and engineering and logistics support for the production and fielding of Abrams tanks. The proposed contract will also include requirements for services such as Field Service Representatives (FSR), engineering for previously fielded vehicles, and post-production software maintenance. Man-hours are also included for requirements from additional Army sites and Program Executive Offices (PEO), such as Program Manager (PM) Soldier to integrate Mounted Soldier System components into the Abrams FoV, PM Joint Battle Command-Platform for network equipment, PM Bridging, and the USMC.
a. The STS Engineering support includes:
• Configuration Management
• Field Problem Analysis
• Design and Development of Abrams platform improvements and enhancements
• Investigation and Trade Studies
• System Integration consisting of human factors of safety and ergonomics and Sustainment System Technical Support (SSTS) duplication of cost to the Government that is not expected to be recovered through subsequent competition.
f. Currently, GDLS has the required personnel with years of experience working on each of the systems listed above to perform the required STS and SSTS tasks.
An award to any other source would result in a substantial duplication of cost to the Government that would not be recovered through competition.
6. Efforts to Obtain Competition:
a. Effective Competition: For reasons stated in paragraphs 5 and 8, effective competition is not anticipated for this acquisition.
b. Subcontracting Competition: In accordance with FAR 5.201(c), this action will be synopsized in Federal Business Opportunities (FedBizOpps) to improve small business access to acquisition information and enhance competition by identifying contracting and subcontracting opportunities. The Government Procuring Contracting Officer and Administrative Contracting Officer will continue to monitor the prime contractors’ subcontracting plan throughout the contract to ensure compliance. The contract also will include the Small and Small Disadvantaged Business clauses required by the FAR and the Defense Federal Acquisition Regulation Supplement (DFARS) to maximize subcontracting opportunities. The contract will contain the following clauses: FAR 52.244-5, “Competition in Subcontracting,” which will ensure GDLS selects subcontractors (including suppliers) on a competitive basis to the maximum practical extent consistent with the objectives and requirements of the contract; FAR 52.219-8, “Utilization of Small Business Concerns”; FAR 52.219-9, “Small Business Subcontracting Plan”; and DFARS 252.219-7003, “Small Business Subcontracting Plan.”
7. Actions to Increase Competition: The Government has no plans to increase competition beyond synopsizing the acquisition. GDLS is the developer, integrator, and manufacturer of the Abrams tank vehicle and as such is the only practical source that can provide the technical and logistical support without duplication of costs that are not expected to be recovered through competition.
8. Market Research: To gauge the most current market conditions for acquisition of Abrams Tank Systems FoV STS and SSTS services, ACC-WRN published a Market Survey on FedBizOpps on 26 April 2016 to evaluate the capability of new sources to perform the tasks currently included under the STS contract. The Market Survey included questions related to Logistical Support, Engineering Support, Configuration Management, Product Assurance Support, Capability Maturity Model Integration (CMMI) Support, and Obsolescence Support. The Market Survey closed 9 May 2016 and no responses were received. Additionally, pursuant to FAR 10.002(b)(2), continuous surveillance of the marketplace is conducted by PD Main Battle Tanks and Sustainment System Technical Support (SSTS)
iii. The authority used for the above non-competitive actions is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
iv. Paragraph 7 (Actions to Increase Competition) of the previous J&A stated that the Government is not contemplating further competition for the Abrams STS requirement. GDLS is the developer, integrator, and manufacturer of the Abrams tank vehicle and is the only practical source that can provide the technical and logistical support.
v. No prior awards were accomplished by full and open competition.
vi. No unusual patterns have been revealed by the procurement history.
vii. The most recent procurement was non-competitive pursuant to FAR 6.302-1. GDLS is the OEM and the sole producer of the Abrams Tank System and its derivative vehicles. GDLS is the only source with the engineering and logistical expertise required to support the tank production line and fielded Abrams tanks. Additionally, GDLS is the only source capable of providing the services described without a substantial duplication of costs that are not expected to be recovered through competition.
b. Other facts: None.
