CMO Control # 10-197
JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Agency: US Army Contracting Command, TACOM Contracting Center-Warren, CCTA-AHXA, Warren, MI 48397-5000.
2. Description of Action: A new contract with Hodges Transportation, doing business as Nevada Automotive Test Center (NATC) of Carson City, NV, on a Firm Fixed Price basis. The action will be funded with United States Marine Corps Research Development Testing and Engineering (USMC RDT&E) funds. The estimated amount of the proposed contract is $600,000.
3. Description of Supplies/Services: The proposed contract is for the generation of data reflecting the capability of the Light Armored Vehicle Family of Vehicles (LAV FOV based on updated metrics/terrains of the USMC mission profile. The resulting data will be used by Program Managers Office, Light Armored Vehicles (PMO LAV) to generate the requirements for a survivability upgrade in a subsequent competitive contract.
4. Authority Cited: 10 USC 2304(c)(1), as implemented under FAR 6.302-1: "Only One Responsible Source".
5. Reason for Authority Cited: The USMC mission profile is defined, and refined, by Combat Development & Integration, Headquarters Marine Corps (CD&I, HQMC). The profile has recently been updated to reflect global USMC deployments and operations. It is broken down into five main “Mission Areas” (representing the full spectrum of potential, global Areas of Operation for the USMC), with a further breakdown by percentage to the type of road. The five main Mission Areas are: Costa Rica, Norway, Korea, Philippines, and Southwest Asia. The roads are broken down into:
Primary, Secondary, Trails, and Cross-Country. Each Mission Area has a uniquely characterized breakdown between these four road categories. These breakdowns collectively encompass the USMC mission profile, but individually, they can be expressed numerically through a wave number spectrum range for each type of terrain. NATC is the only known facility with the combination terrains and courses that represent all components of the USMC mission profile.
NATC has the unique ability to test vehicles on their own 6,000 acre facility, which includes 3,000 miles of test courses, skid pads for vehicle dynamics evaluations, a large tilt table, established slopes, fording pits, obstacles, and extremely unique on-site ranges for direct live-fire blast/survivability tests. There is no known commercial or government site with the combination of test environments, equipment, and instrumentation to simulate the USMC mission profile and record vehicle capabilities. It would be physically and financially impractical for any test facility to recreate the terrain and instrumentation available at NATC. Pursuant to FAR 6.302-1(a)(2)(ii)(B), an award to any other source would result in a duplication of cost to the Government that could not be recovered through competition.
6. Efforts to Obtain Competition: This acquisition will be synopsized in the FedBizOps pursuant to FAR Part 5.201 and will include Note 22, which allows interested firms the opportunity to identify their interest and capability to respond to the requirement or submit proposals.
7. Action to Increase Competition: PM-LAV continually seeks out information and sources able to compete and meet the requirements of this technology. The data that is obtained in this characterization testing will be used to tailor the requirements of a follow-on competitive contract to upgrade the survivability of the LAV FOLAV by means of an enhanced power pack and suspension system.
8. Market Research: PM-LAV has performed ongoing market research to identify sources for this type of effort. Their market knowledge and assessments of the capabilities of potential sources is continuously updated as a result of information gathered from the following:
• Internet web searches
• Contacts with knowledgeable experts in the field, in industry and government, regarding market capabilities to meet the requirements.
• Attendance at technical conferences and symposiums
In the past year, PM LAV has attended the following:
- Jan 2011 – Integrated Product Team (IPT) meeting with Director, Operational Test & Evaluation (DOT&E).
- Feb 2011 – Program Update with Marine Corps Operation Test & Evaluation Agency
(MCOTEA).
Aug 2011 - Tank Automotive Research, Development and Engineering Center (TARDEC).
No Government or commercial test facilities with all of NATC’s terrain and test / recording capabilities were identified.
9. Interested Sources: No other sources have written to express an interest in this acquisition.
However, all notices required by FAR 5.201 shall be administered, as appropriate, in conjunction with this acquisition.
10. Other:
a. Subcontracting Competition: NATC is a Small HUB Zone contractor. Since NATC is a small business, a subcontracting plan will not be required. In an effort to ensure subcontracting competition, the contract shall include the following provisions: FAR 52.244-5, “Competition in Subcontracting” and FAR 52.219-8, “Utilization of Small Business Concerns”.
11. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the J&A are accurate and complete to the best of my knowledge and belief.

12. FAIR AND REASONABLE COST DETERMINATION: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The contractor’s proposal will be reviewed using cost/price analysis to determine whether the costs are reasonable.
